Sometimes—but there is no blanket permission. Before rerunning a YouTube gaming stream with copyrighted music, confirm that you have rights to broadcast and archive the music, that the game publisher permits the intended use of its game content, and that YouTube’s systems will not interrupt the live stream or claim the replay. These are separate questions; a “yes” to one does not settle the others.
Why a rerun needs more than a game purchase
Buying a game, or hearing a song in its soundtrack while playing, does not by itself establish that you can rebroadcast and archive that music. YouTube’s Livestream terms and conditions place responsibility on the creator to have the rights needed for live and archived content, including music licensing rights. The terms say: “You represent and warrant that you have all necessary rights for the exploitation of the Live Content on the Google Services throughout the world, including, without limitation, music licensing rights from artists, record labels, publishers (including public performance licenses) and any other royalty participants.”
Check the exact game and track, the applicable rights, and the countries where viewers can access the stream or replay. A game publisher’s permission to stream gameplay may not cover a separately licensed song in the game.
Separate the three permission and enforcement questions
- Do you have legal permission or a valid copyright exception? This depends on the rights and terms for the exact music and your intended use.
- Does the publisher permit streaming or monetizing the game content? Publisher policies can govern gameplay footage, but they do not necessarily clear every musical work included in the game.
- Will YouTube interrupt the live broadcast or claim the replay? Platform detection and rights-management actions are distinct from a legal determination of permission.
Permission in one category does not prove permission in another. YouTube says monetizing game footage may depend on commercial-use rights granted by the publisher; that is platform monetization guidance, not a complete decision about copyright ownership or whether a particular use is lawful. Original game score and licensed-in songs are not the same
YouTube’s Content ID policy treats an original video game soundtrack as a recording created primarily for use in a game, such as an original score or background music. Its policy says references for these soundtracks are valid only when delivered under the game publisher’s content owner. It expressly excludes popular music licensed for inclusion in a game from that original-soundtrack category. A licensed-in commercial song may therefore involve a music rights holder or license separate from the game publisher’s rights. See YouTube’s Content ID policy.
Do not assume that a publisher’s general streaming permission covers every track, or that a track’s presence in a game makes it safe for an archived rerun. Verify the exact track’s terms separately, especially if the replay will remain available or be monetized.

What can happen while the stream is live and after it ends
During the live broadcast
YouTube says it scans live streams for matches to third-party content. If it detects a match, it may replace the live picture with a placeholder, warn the creator, or temporarily interrupt or terminate the stream if the use continues. A license does not necessarily prevent interruption: YouTube advises licensed creators to ask the rights owner to add their channel to its Content ID allowlist, and notes that a stream can still be interrupted without allowlisting.
After the stream becomes a replay
If you choose to archive the broadcast, YouTube says Content ID claims are made after the live stream is complete: “Content ID claims are only made after you complete your live streams, if you decide to archive the video.” That means a live stream that was not stopped is not proof that its replay is cleared. Fair use and other possible routes to use music
Fair use is not an automatic exemption for gaming streams. In the United States, YouTube describes it as a case-specific assessment involving the purpose and character of the use, the nature of the work, the amount used, and the effect on the work’s market. Courts decide fair use; Content ID cannot. Other countries have different exceptions and fair dealing rules, so a U.S. fair-use analysis should not be treated as a universal rule. A short clip, credit, disclaimer, or entertainment purpose alone does not establish clearance. See YouTube’s fair use guidance and YouTube’s copyright basics.
YouTube lists permission, applicable copyright exceptions, public-domain material, Creative Commons terms, and music from the YouTube Audio Library or Creator Music as possible routes. None guarantees avoiding a claim or strike. Read the terms for the particular track and intended use. In particular, YouTube’s Creator Music usage terms say revenue-sharing tracks cannot be used in live streams; do not treat such a track as clearance for a livestream or rerun.

Checklist before you rerun or publish the replay
- Identify the exact game, track, music rights holder if known, and countries where the broadcast and replay will be available.
- Read the game publisher’s current streaming and monetization policy. Separately check the license or rights terms for any popular music licensed into the game.
- If relying on a license, confirm that it covers livestreaming, archived viewing, monetization if intended, the relevant territories, and your channel. Ask the rights owner to allowlist your channel in Content ID where applicable.
- If rights remain unclear, mute or remove the track from the replay, replace it with music whose terms expressly allow the intended use, or do not publish the replay. YouTube suggests removing or replacing nonessential claimed music with suitable Audio Library tracks.
- If you receive a Content ID claim, treat it as a platform rights-management action, not a court ruling on fair use. Dispute only if you have a defensible rights or exception basis; YouTube does not decide the legal merits of a fair-use claim.
Common mistakes and what to do instead
- “I bought the game, so I can rebroadcast everything in it.” A purchase does not establish all music broadcast and archive rights. Check publisher rules and any separate music license.
- “The live stream stayed up, so the replay is safe.” Archived streams can receive Content ID claims after the broadcast. Review the replay and address any claim or unclear music rights before relying on it.
- “It is the game’s own soundtrack, so every track is covered by the publisher.” Original game score and popular music licensed into a game can have different rights holders and Content ID treatment. Identify which kind of track it is.
- “I have a license, so YouTube cannot interrupt me.” A rights owner may need to allowlist the channel for Content ID, and YouTube says interruptions can still occur without allowlisting. Contact the rights owner and keep documentation of the license.
- “Credit, a disclaimer, or a short clip makes it fair use.” None is an automatic clearance rule. Assess the applicable law and the actual use; do not rely on a label or clip length alone.
