Usually, wearing smart glasses is different from using them to record. Whether you may wear or activate them depends on the country, the device’s functions, the setting, and the rules set by the venue or employer. UK Government statements say people may lawfully use smart glasses in public spaces, but that is not a worldwide rule—and harmful recording can be a crime. Check local law and the specific policy before recording.
Wearing smart glasses is not the same as recording with them
A pair of smart glasses may have a camera, microphone, livestreaming, biometric or location features, or other data functions. A rule that permits wearing glasses does not necessarily permit activating those features. Before using them, establish what the device is doing and whether it stores, transmits, analyzes, or shares information.

The UK Government said in a parliamentary answer on September 9, 2026, that people may lawfully use smart glasses in public spaces, while warning that harmful non-consensual recording may amount to offences such as harassment, stalking, or voyeurism. Sharing intimate images without consent is also a crime. Read the Government’s statement on smart glasses and privacy. Laws on recording, audio, data protection, and sharing images vary by jurisdiction, so being outdoors or visible to others does not make every recording lawful.

Can you wear smart glasses in a store or venue?
Do not assume that a shop or attraction open to the public has no photography conditions. The property controller may set rules for entry and use of the premises. Check signs and entry terms, and ask staff or management if the policy is unclear. If asked to stop recording or leave, comply rather than escalating a dispute.

That is one attraction’s policy, not a rule for every retailer or venue.
Can your employer ban smart glasses at work?
Check the staff handbook, device and recording policies, confidentiality rules, and expectations for meetings before wearing or activating the glasses. A workplace may restrict a device because of what it can capture or transmit, even where wearing it elsewhere is permitted.
UK workplace guidance says employers must make workers aware of monitoring and explain why; it gives sending an email as one example. Separate guidance says employers cannot monitor workers everywhere, citing toilets as an example. See the worker guidance on monitoring and data rights and employers’ responsibilities for workplace monitoring.

Policies can cover more than video. The School of Visual Arts’ policy, version 2026.09.17, covers wearables capable of recording audio or video or capturing biometric or environmental data. It prohibits covered workers from wearing or using such devices while performing job duties, in meetings or classrooms, or in settings involving interactions with students, colleagues, or the public, regardless of physical location. The policy also provides for approved uses and accommodations. This is an example of one US institution’s policy, not a general legal rule for workplaces. Read the School of Visual Arts smart-glasses policy.
What about schools and children?
Schools need to consider privacy, personal-data protection, and safeguarding when camera-enabled wearables may capture children or student information. UK Department for Education guidance says its existing image and CCTV guidance remains relevant to wearable technology, and that policies should address staff, parents, carers, and visitors. See the Department for Education guidance on photographing and filming pupils.
Do not record children at school—or use audio or data features there—unless the school’s rules and the circumstances expressly permit it. Visitors and parents should check the school’s policy rather than assuming that a phone or wearable-camera rule applies only to employees.

Public places and sensitive premises
Public-space rules depend on local law and the purpose and manner of recording. The UK Government’s statement supports lawful use in public spaces in the UK, but identifies harmful conduct that may be criminal; it does not establish a global right to record everyone in every public setting.

Some premises impose additional restrictions even where recording might otherwise be lawful. The House of Lords says recording on its estate is not permitted without appropriate authorisation and has described a review of its smart-glasses policy. Quick Recap
A quick check before wearing or using them
- Identify the jurisdiction. Do not apply a UK statement or a single US institution’s policy as a rule for another country or employer.
- Check who controls the setting. Read venue signs and terms, or the workplace or school policy. Ask the responsible staff member if the rule is unclear.
- Know which functions are active. Distinguish simply wearing the glasses from recording video or audio, livestreaming, or enabling AI, biometric, location, or data-transmission features.
- Take extra care in sensitive settings. Meetings, confidential discussions, schools, health spaces, and situations involving children or personal data call for particular caution.
- Respond to objections promptly. Stop recording and ask the responsible person about the applicable policy.
- Ask about accommodations. If you need the glasses for accessibility or another accommodation, contact the employer or institution about its process instead of assuming a blanket ban applies.
