Sometimes. “Open-weight” describes how model parameters are distributed, not a universal legal permission. Before using a model in a paid product, internal service, hosted API or redistribution package, identify the exact release, read its license and model card, and check every linked usage policy or application requirement. Commercial permission under a license is also separate from regulatory duties that may apply to your company, market and AI system.
What “open-weight” tells you—and what it does not
An open-weight model makes trained parameters (weights) available for download or use under stated terms. Those terms can allow local inference, fine-tuning or redistribution, but the label itself does not promise any of them. “Open-weight” is therefore a distribution description, not a single license category.

Some releases use familiar licenses such as Apache 2.0. Others use modified licenses, research-only terms, provider-specific agreements or acceptable-use policies that add conditions. Two releases from the same organization can have materially different rights. A repository’s source code license may also differ from the license covering the model weights.
The practical question is not “Is this model open?” It is: For this exact version, may my organization perform this exact commercial activity in this exact market, subject to which conditions?

Commercial use is a license question, not a label
Permissions can differ by activity
Read the terms against the activity you intend to perform. “Commercial use” can cover operating a model inside your business, embedding it in a paid application, offering model access to customers, fine-tuning and selling a derivative, or redistributing the weights. A license may treat those activities differently.
- Internal use: running weights for employees or business workflows.
- Commercial product: embedding inference or generated features in a product sold to customers.
- Hosted service: serving the model or a fine-tune through an API or other paid access.
- Redistribution: giving customers or partners the original weights, modified weights or a packaged model.
- Modification: fine-tuning, quantizing, merging or otherwise creating a derivative model.
- Attribution and notices: preserving copyright, license, policy or notice files when distributing software or weights.
Do not infer that permission for one activity covers the others. A model can be usable internally while its redistribution terms require an additional agreement.
Linked policies can limit a permissive license
OpenAI describes its gpt-oss models as Apache 2.0. Its official wording says Apache 2.0 allows broad use, modification and redistribution, including commercial use, subject to the gpt-oss usage policy. The policy is part of the compliance review, not optional reading.
Provider documentation may also impose revenue, user, geography, safety or application restrictions. Treat every linked acceptable-use policy, terms page, application form and model-specific notice as part of the conditions you must evaluate.

These examples also show why a provider-wide assumption fails. License terms can change between releases, and a README summary may point to a separate agreement that controls the weights.
A seven-step commercial-use review
- Pin the exact release. Record the model name, parameter size or variant, version or commit, download location and provider page. “Model family” is too broad for a legal decision.
- Collect the controlling documents. Save the license text, model card, repository notices and every linked acceptable-use policy, terms page, application form or commercial agreement. Note publication and access dates.
- Map your intended activities. Write down whether you will run the model internally, fine-tune it, expose an API, embed outputs in a paid product, redistribute weights or provide a hosted service. Ask the license about each activity separately.
- Check conditions and thresholds. Look for attribution, notice preservation, patent language, restrictions on fields of use, derivative-model rules, user or scale limits, geographic terms and revenue thresholds. A threshold stated for one model or license family must not be generalized to another.
- Separate weights from outputs. Permission to use or redistribute weights does not settle copyright, privacy, publicity, confidentiality or other third-party rights in generated outputs. The available provider materials do not establish a universal answer to output-rights questions across jurisdictions.
- Classify your role and markets. Determine whether your company is acting as a model provider, distributor, modifier, AI-system provider or deployer. List every country or economic area where the model or integrated system is placed on the market or put into service.
- Document and re-check. Keep the exact license version, model card, policy links, approvals and interpretation used for the decision. Re-review before a major model update, redistribution change, new market or material product change.
License rights and regulatory compliance are separate checks
A license answers a private-rights question: what the licensor permits under stated conditions. Regulation can impose duties even when the license permits commercial use. Passing one check does not prove that the other is satisfied.
Who can be covered in the European Union
The European Commission’s “General-Purpose AI Models in the AI Act – Questions & Answers” says providers placing general-purpose AI models on the Union market are covered whether they are established in the EU or in a third country. It describes “placing on the market” as making a model available for the first time on the Union market in a commercial activity, whether or not a price is charged.
The relevant role may therefore arise before a customer pays. If your organization first makes a model available in the EU as part of a commercial activity, assess whether you are a provider under the applicable rules. If you integrate a general-purpose model into an AI system, obligations can attach to the resulting system as well.

Documentation duties for providers
The Commission FAQ lists provider duties that include technical-information documentation, information for downstream providers, a copyright-compliance policy and a publicly available, sufficiently detailed summary of training content. General-purpose models with systemic risk have additional duties, including assessment and mitigation, evaluations, serious-incident tracking and reporting, and cybersecurity measures.
The FAQ says the Article 53(1)(a) and (b) documentation duties to the AI Office, national competent authorities and downstream providers do not apply when a model is released under a free and open-source license and its parameters (including weights), architecture information and usage information are publicly available. The stated exception does not apply to general-purpose AI models with systemic risk.
The Commission says provider obligations apply from August 2, 2025, with special rules for models placed on the market before that date. Use the current AI Act text and Commission guidance for your exact release date, role and system context.

The Commission also notes that downstream modification does not automatically make every modifier a provider of a modified model. That is a classification question based on the facts, not a blanket exemption. Document what you changed, what you make available and how the AI system is offered before concluding which duties apply.

Common commercial scenarios
Running weights inside a company
Internal use may be the narrowest distribution scenario, but it still requires checking the license, usage policy, data-protection obligations, security controls and sector rules. Restricting access to employees does not erase policy prohibitions or regulatory duties.
Embedding a model in a paid application
Confirm that commercial use, modification and service provision are allowed. Preserve required notices in the application or documentation, and check whether your product’s users, data or industry create additional restrictions under the usage policy or local law.
Offering a hosted API
Determine whether the terms permit serving the model to third parties and whether rate, user, revenue or geography conditions apply. Your infrastructure choice—such as vLLM, Ollama, llama.cpp, cloud GPUs or self-managed GPUs—does not change the license, although it affects operational security and cost.

This is usually a higher-risk review because recipients receive the model itself. Check whether redistribution is allowed, whether downstream recipients must receive the same license and notices, and whether a separate provider agreement or application is required. Record the precise base model and fine-tuning changes.
Pitfalls that cause avoidable compliance failures
- Reading only the repository’s source-code license: model weights can be governed by a different agreement.
- Assuming “open source” means unrestricted: modified licenses and usage policies can add conditions.
- Generalizing a provider’s threshold: Mistral’s US$20 million monthly-revenue condition is described for certain modified-MIT models, not all models.
- Using an old announcement: the May 2024 Codestral example does not establish current terms.
- Ignoring linked policies: Apache 2.0 permission for gpt-oss is expressly subject to its usage policy.
- Confusing output rights with weight rights: a model license does not provide a universal answer for third-party rights in outputs.
- Stopping after license review: EU AI Act and other regulatory duties depend on role, market and system context.
- Failing to preserve evidence: without the version, date and documents reviewed, a later audit cannot reconstruct your decision.
How to compare candidates for a business deployment
Build a comparison sheet using only verified values for each exact release. Include:
- release name, version and source;
- weight license and any source-code license;
- linked usage policies, terms and application requirements;
- commercial-use, modification, fine-tuning and redistribution permissions;
- attribution and notice obligations;
- revenue, user, geography or scale thresholds;
- provider support and deployment options;
- your role, target markets and likely regulatory classification.
The available official materials support a licensing and compliance comparison, not a ranking of model quality, performance or total cost. Make those decisions separately using validated technical and financial testing.
Bottom line for a commercial launch
You can use some open-weight AI models commercially, but only after clearing the exact release and its conditions. Start with the weight license and model card, follow every linked policy or application requirement, distinguish internal use from redistribution, and then perform a separate regulatory review for your role and markets. Re-check the documents whenever the model, product or deployment geography changes.
