A game jam or art competition can prohibit generative AI even when the human-edited result might qualify for copyright protection. Check the exact edition’s rules, definitions and disclosure requirements before submitting.
In the United States, copyright and contest eligibility are separate questions. Human creative choices, arrangement and substantial modification can support protection, while prompts alone generally do not. This guide explains how to determine whether your artwork is eligible, what to disclose and how to document your process.

Contest permission comes before copyright analysis
Entering a contest is a contractual eligibility decision made by the organizer. Copyright is a legal question about rights in an expressive work. Passing one test does not satisfy the other.

It can disqualify a project even if an artist later adds enough original work for some portion of the image to be copyrightable.

Conversely, a contest may permit AI assistance but require disclosure, process files or proof that every external asset is licensed. Permission to enter does not automatically transfer ownership, grant a commercial license or resolve whether a particular output can be registered with the U.S. Copyright Office.
Read the edition-specific rules
Rules can change between seasons, categories and organizers. Open the rules for the exact event and edition, not a remembered policy from an earlier jam. Search for definitions of AI, generative AI, AI-assisted, assistance, assets and original work. Also check the submission agreement, community guidelines and any technical- art or soundtrack-specific appendices.
Look for restrictions beyond final images
Some policies address only final project assets; others cover brainstorming, code, writing, concept images, textures, voices, music and team communications. A rule that allows AI for ideation may still ban generated material in the shipped build. If the text is unclear, obtain a written answer from the organizer before the deadline and keep that answer with your project records.

Do not assume that a small edit changes a prohibited asset into an allowed one. If the policy bans generative AI “in the creation” of the project, a generated background may remain covered even after extensive retouching. If the policy permits assistance, ask whether the organizer evaluates the finished pixels, the production process or both.
U.S. copyright: what can be protected
The U.S. Copyright Office’s Part 2 report, issued January 29, 2025, states that “the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” The key issue is human authorship: a person must determine sufficient expressive elements in the material claimed as a work.
Human-authored expression can qualify
Protection may extend to human-authored material that is perceptible in the output, and to creative arrangement or modification of generated material. Examples can include a character design drawn by the artist, an original environment assembled from separately created elements, a distinctive sequence of edited frames, or a heavily transformed composite whose expressive choices are controlled by the human creator.

The protection covers the human contribution, not automatically every machine-produced element. A registration or infringement claim should identify which portions were created by people and which were generated.

Prompts alone are usually insufficient
Typing a prompt, choosing among returned images or making minor adjustments generally does not provide the human authorship required for the output’s purely generated features. The Office’s guidance focuses on whether the user determined the expressive details, rather than on the amount of effort, time or expense spent prompting.
What §102 excludes
Section 102 of Title 17 protects original works fixed in a tangible medium, including pictorial, graphic, sculptural and audiovisual works. It does not protect ideas, procedures, processes, systems or methods of operation. In a game, that means the written rules, game concept and method of play are not protected by copyright merely because they are implemented in software. Original artwork, text, sound recordings and audiovisual material can be protected when they contain sufficient original authorship.

Disclosure obligations in the United States
The Copyright Office’s March 16, 2023 guidance says applicants have a duty to disclose AI-generated content in works submitted for registration. If an applicant omits that information, the public record may need to be corrected. This registration disclosure is separate from whatever a game contest requests during entry.
Contest disclosure
Use the organizer’s designated field, checkbox or statement. If no field exists, ask where the disclosure belongs and whether it should be included in a readme, credits file or submission notes. State what tool was used, which assets contain generated material and what human work was added. Do not wait for a later copyright filing to reveal use when the contest requires disclosure at entry.

Copyright-registration disclosure
If you later apply to register the game or its art in the United States, identify the AI-generated portions and describe the human-authored material being claimed. The Office’s guidance is concerned with an accurate public record; disclosure does not automatically destroy protection for the human portions.
A documentation workflow that protects your eligibility
Use this process whenever the rules permit AI or are ambiguous enough to require clarification.
- Capture the governing text. Save a dated copy or PDF of the contest rules, submission agreement and relevant definitions. Record the edition, category and deadline.
- Classify every tool. List image generators, upscalers, editing features, writing assistants, code tools and stock or reference services. Note the model or version where the service provides one.
- Keep the creation log. Record prompts, dates, source images, settings, outputs retained and discarded, and the person who made each decision. Screenshots or exported histories are useful when a service does not preserve them indefinitely.
- Separate layers and files. Preserve original sketches, photographs, masks, vector paths, paint-over layers, compositing files and final exports. Name generated layers so a reviewer can distinguish them from human-created content.
- Describe substantial edits. Note what you redrew, selected, arranged, composited, recolored or animated. Explain how those choices determine the expressive result rather than simply saying “edited.”
- Check licenses and terms. Review commercial-use, attribution, redistribution, output-ownership and training-data provisions for each tool and external asset. Save the terms that were in force when you created the work; online terms can change.
- Ask for a written ruling when needed. Send the organizer a concise description of the exact use, such as “a generated background retained after paint-over,” and request a yes-or-no eligibility answer. Keep the reply with your records.
- Submit the required disclosure. Use the organizer’s form and wording, identify affected assets and attach process evidence if requested. Be consistent across the entry form, credits and project files.
- Prepare for an audit or challenge. Retain the logs, source files, licenses and organizer correspondence for the period specified by the rules or, if none is stated, for as long as the project is promoted or distributed.
How common scenarios should be handled
“I used AI only for a background”
A background is still an asset in the project. If the contest bans generative AI in any part of creation, it can trigger disqualification. If assistance is allowed, disclose the background, identify the model and explain your edits. Do not describe it as entirely hand-painted if generated pixels remain.
“I generated concepts, then redrew everything”
The answer depends on the rule’s scope. A policy limited to final assets may permit private concept references; a policy covering creation or assistance may not. Keep the concepts and sketches, disclose them when required and obtain written clarification if the wording is uncertain.
“I used an AI tool to remove a background or upscale a sprite”
Utility features can still fall under a contest’s definition of AI. Identify whether the feature creates new pixels, fills missing areas or merely applies a deterministic transformation. The organizer’s definition controls eligibility, not the marketing label attached to the feature.
“My teammate used AI and did not tell me”
Team representations normally cover the whole project. Ask every contributor to list tools and retained outputs before submission. Under a rule like the Just Play Game Jam statement, an undisclosed teammate’s use can make the team’s representation inaccurate.
“The output looks unique, so can I claim it?”
Visual uniqueness is not the legal test. Copyright analysis asks which expressive elements a human author determined. A unique-looking result can still contain unprotectable generated features, while a modest-looking human arrangement can receive protection in that arrangement.

Compare contests using the questions that affect risk
When choosing between events, build a side-by-side record instead of relying on a general “AI-friendly” label.

These questions matter because contest rules are organizer-specific and the cited copyright guidance is U.S.-focused. A contest in another country may apply different authorship, disclosure, moral-rights or consumer-contract standards. Treat the governing law and the current edition’s text as controlling.
Common mistakes and how to correct them
- Relying on a social-media summary: Replace it with the current official rules and submission agreement.
- Assuming “AI-assisted” is a safe category: Describe the actual operation and retained output; labels are not universal.
- Disclosing only in a future copyright application: Make the contest disclosure at entry when required.
- Claiming the entire image as human-created: Separate generated portions from your original drawing, arrangement and edits.
- Ignoring tool terms: Verify commercial use, attribution, redistribution and output provisions for each service.
- Deleting the working files: Preserve layers, prompts, source images and dates until the contest’s dispute or retention period ends.
- Submitting after an ambiguous verbal answer: Request written clarification that quotes the exact proposed use.
What the current U.S. guidance does—and does not—settle
The Copyright Office’s AI initiative drew more than 10,000 public comments by December 2023, and its 2025 Part 2 report explains the human-authorship approach. That guidance clarifies how copyrightability is evaluated; it does not create a universal contest policy or guarantee registration for every AI-assisted image.
The available authorities establish U.S. federal treatment and provide one official contest example. They do not establish a single rule for every platform, country, organizer or future edition. For a non-U.S. contest, consult the local rules and applicable law; for a high-value release or dispute, obtain advice from a qualified lawyer in the relevant jurisdiction.
