Can You Use a Musician’s Face or Voice in an AI Video? Copyright and Publicity Rights Explained

Usually, not without permission. If viewers can reasonably recognize a musician in an AI-generated face, voice, name or likeness, obtain a written license before releasing a commercial video. Then clear every separate copyrighted work you use, including the composition, lyrics, sound recording, photograph, music-video footage and artwork. A musician’s consent may not cover rights held by a label, publisher, photographer or estate. Copyright, publicity rights, false-endorsement rules, contracts, state statutes and platform policies can apply at the same time.

The practical answer for an AI musician video

Making the pixels or audio with an AI system does not make a recognizable person’s identity free to use. The key question is whether an ordinary viewer could reasonably identify the musician and infer that the person appeared, supplied the voice or approved the message. That can be true even when every frame and syllable is newly generated.

For a paid advertisement, sponsored post, product placement, monetized channel or other promotional release, treat a recognizable face or voice as permission-sensitive. Get a written agreement with the person or the person’s authorized rights holder before production is finished. The agreement should expressly cover synthetic or AI use rather than merely granting conventional photography or recording rights.

Permission for the identity is only one clearance. A generated singer may still imitate a protected recording, reproduce lyrics, incorporate a photograph or use footage from a music video. Those works have their own copyright owners and licenses.

Two different legal layers: copyrighted works and personal identity

Copyright protects works, not a person’s fame

Under 17 U.S.C. §106, a copyright owner has exclusive rights to reproduce a protected work, prepare derivative works, distribute copies, publicly perform the work and publicly display it. An AI production can implicate those rights when it copies or incorporates a song, lyrics, a master recording, a photograph, music-video footage or other protected material.

For example, prompting a system to reproduce a particular chorus, uploading a commercial recording as a voice reference, or inserting a musician’s photograph into a generated scene can involve different copyrighted works. The composition and lyrics are generally separate from the sound recording. A music video may contain additional audiovisual, photographic, choreography and design rights.

Copyright ownership does not automatically give someone control over every depiction of their face or sound. Conversely, a performer’s permission to use a likeness does not automatically license the song, recording or photograph that the performer helped create.

Publicity and digital-replica rights protect identity interests

Publicity rights govern commercial exploitation of a person’s name, voice, signature, photograph or likeness. They arise primarily under state statutes and common law, so the applicable rules can depend on the state connected to the creator, subject, audience or distribution. A realistic synthetic voice or face may be treated as a digital replica even when it is not copied from a single existing recording.

The U.S. Copyright Office’s Part 1 report, released July 31, 2024, describes digitally created or manipulated video, images and audio that realistically but falsely depict an individual. The Office recommended that Congress enact a federal right protecting all individuals during their lifetimes from the knowing distribution of unauthorized digital replicas, with licensing rules, remedies and First Amendment safeguards. That recommendation is not an enacted nationwide statute, so it does not replace state law today.

What federal policy does—and does not—settle

There is no single federal statute that resolves every AI face-or-voice scenario. Existing copyright law can apply to copied works, while state publicity claims, false endorsement, contract provisions and other doctrines may address the identity or the impression of sponsorship. Whether a particular use is lawful depends on the material used, the message, the audience, the jurisdiction and the surrounding facts.

The Copyright Office received over 10,000 comments in its AI inquiry by December 2023. Its later reports show that the legal framework is still developing:

Date Development What it means for a video creator
July 31, 2024 Part 1 report on digital replicas Recommends a federal right against knowing distribution of unauthorized digital replicas; it is a policy recommendation, not current federal law.
January 29, 2025 Part 2 report on copyrightability of generative-AI outputs Addresses when AI-assisted outputs may receive copyright protection; it does not grant permission to use another person’s identity.
May 9, 2025 Part 3 on generative-AI training, released in pre-publication form Examines training issues; it does not clear a finished video’s face, voice or underlying music.

The Office’s July 2024 release summarized its position this way: “Given the gaps in existing legal protections, the Office recommends that Congress enact a new federal law that protects all individuals from the knowing distribution of unauthorized digital replicas.” The wording is a recommendation to lawmakers, not a license for creators to proceed without consent.

State examples that can change the analysis

Tennessee’s ELVIS Act

Tennessee signed the ELVIS Act on March 21, 2024. It adds voice protection to the state’s personal-rights framework and targets unauthorized AI misuse of musicians’ voices and likenesses. A release connected to Tennessee therefore deserves a state-specific review instead of relying on a generic “deepfake” policy.

Tennessee Governor Bill Lee described the rationale in official signing coverage: “Artists have intellectual property. They have gifts. They have a uniqueness that is theirs and theirs alone, certainly not artificial intelligence.” The statement reflects the policy goal; the statute’s actual coverage and remedies control a particular dispute.

New York and California examples

New York Civil Rights Law §50-F defines and regulates highly realistic computer-generated digital replicas. California Civil Code §3344 protects a person’s name, voice, signature, photograph or likeness. These examples demonstrate why the subject’s location, the production company’s location and the audience’s location can matter. A lawyer should identify every materially connected jurisdiction for a high-value launch.

When written permission is the safest route

Use a signed license whenever the musician is recognizable, the content promotes a product or service, or the video could make viewers believe the musician participated or endorsed it. Do not rely on a verbal approval, a casual direct message or a platform’s upload permission.

Terms to put in the license

  • Identity: Name the person and specify whether the grant covers the face, voice, name, signature, photograph, likeness or all of them.
  • AI and synthetic methods: State that the permission includes machine-generated, cloned, altered or simulated performances, not only ordinary filming and recording.
  • Media and formats: List the finished video, trailers, still images, audio-only extracts, social clips, thumbnails and future technical formats you actually need.
  • Territory and term: Define the countries or regions and the start and end dates. Address whether archived posts may remain online after the term.
  • Commercial uses: Identify advertising, sponsorship, paid promotion, product placement, branded content and monetized channels separately when appropriate.
  • Edits and approval: Set rules for script changes, voice or face alterations, captions, translations and the person’s approval rights.
  • Disclosure and takedown: Specify how synthetic content will be labeled and how either party can request correction, suspension or removal.
  • Authority and chain of title: Confirm that the signer has authority to grant the rights, and retain documents showing that authority.

Have counsel in the relevant jurisdiction review the document when the release has substantial budget, reach or reputational stakes.

Clear the music, images and footage separately

Make a rights inventory before generating or editing. For each element, identify the owner and obtain the required permission:

  • Composition: The melody and musical arrangement may be controlled separately from a recording.
  • Lyrics: Reproducing or displaying lyrics can create an additional permission issue.
  • Sound recording (master): A label or another owner may control the particular recorded performance.
  • Photographs and artwork: The photographer, agency or artist may own rights even when the musician appears in the image.
  • Music-video footage: The audiovisual work can contain several layers of ownership beyond the performer.

If the system generated an entirely new song and image, that may reduce copying concerns, but it does not by itself eliminate identity, endorsement or publicity-rights questions. Keep the prompts, reference files, licenses and export history so you can show what was used.

Commercial releases carry different risk from commentary

Planned use Why the risk changes Questions to answer before release
Advertising, sponsorship or product placement The video is designed to sell or promote something, making implied endorsement especially significant. Would a reasonable viewer think the musician approved, appeared in or recommends the product? Is there a signed license covering that campaign?
Monetized entertainment or social content Revenue, sponsorship and audience scale can make identity exploitation more apparent. Does the agreement cover the channel, territory, term, clips and paid amplification?
News or documentary Reporting and public-interest context may support expressive uses, but they do not automatically excuse copied music or a misleading synthetic appearance. Is the depiction necessary, accurately labeled and limited to the reporting purpose?
Criticism or commentary Discussion of a musician may receive stronger speech protection than an ad, while copied works can still raise copyright issues. Are you commenting on the person or merely using the identity to attract attention?
Parody Parody can be expressive, but whether a use qualifies and whether it copies too much are fact-specific questions. Can viewers understand the joke or criticism, and could they still believe the musician endorsed the message?

These categories are practical risk indicators, not automatic safe harbors. The same synthetic clip can be treated differently depending on its wording, placement, audience and commercial context.

Why fair use is not an automatic defense

Fair use is a fact-specific copyright doctrine. It may be relevant to criticism, comment, news reporting or parody, but it does not automatically authorize a realistic digital replica of a singer or the use of a famous voice in an advertisement. Fair use also addresses copyright in works; it does not erase every state publicity, false-endorsement or contract claim.

Analyze the actual material copied, the purpose and character of the use, how much was taken and the effect on the market. A claim that “the video is AI-generated” does not answer those questions. Nor does making the video yourself prove that you own every element in it.

A release workflow that reduces avoidable mistakes

  1. Describe the depiction. Write down whose face, voice, name or likeness appears, how realistic it is and whether a viewer could identify the person without a caption.
  2. Classify the message. Mark the project as advertising, sponsorship, monetized entertainment, news, documentary, criticism or parody. Record any product claims and calls to action.
  3. Map the jurisdictions. Note where the creator and company operate, where the musician is connected, and where the video will be targeted or distributed.
  4. Inventory source material. List every song, lyric, recording, photograph, music-video clip, logo and reference file supplied to the AI system or edit.
  5. Obtain identity permission. Secure a written license covering the person’s image, voice, name and synthetic use, with media, territory, term, paid promotion, edits, approval and takedown terms.
  6. Obtain work licenses. Clear the composition, lyrics, master, photograph and footage with their respective owners. Do not assume the performer can grant these rights.
  7. Check the output. Review the face, voice, wording, captions and context for accidental endorsement, false statements or an implication that the musician participated.
  8. Apply disclosures. Follow the platform’s synthetic-media labeling, takedown and impersonation rules, and any disclosure duties that apply to the release.
  9. Preserve records. Store the signed agreements, authority documents, permissions, prompts, reference files, edit decisions, disclosures and final exports with dates and version numbers.
  10. Escalate before launch. Obtain jurisdiction-specific legal review for a high-value campaign, a highly realistic replica, a disputed permission or a release aimed at multiple states.

Common questions in real projects

Can I use an AI version of a singer if I made the video myself?

Creating the video yourself establishes who made the file, not who controls the depicted identity or embedded works. A recognizable synthetic singer still requires an identity-rights analysis, and any copied music, image or footage needs separate clearance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I clone a musician’s voice?

A cloned or simulated voice can be treated as a digital replica or protected voice likeness, especially when listeners can identify the musician. Obtain written consent that expressly covers voice cloning, synthetic generation, distribution and the intended commercial context.

Do I need permission to use a celebrity’s face in an AI advertisement?

For an advertisement, assume yes when the person is recognizable. The central risk is that viewers will infer endorsement or participation. A license should identify the campaign, channels, territory, term, edits and paid promotion.

Is a deepfake music video automatically copyright infringement?

Not automatically. Copyright depends on what protected works were copied or incorporated. The same video can still create publicity, false-endorsement or contract issues even if no existing song, photograph or footage was copied.

Does fair use cover an AI parody of a singer?

Not automatically. Parody and criticism can be relevant to fair use, but the analysis is fact-specific and does not eliminate every identity or endorsement claim. The video’s purpose, amount copied, audience understanding and market effect all matter.

Bottom line for creators and publishers

A recognizable musician’s AI face or voice should be treated as a licensed identity, not as a generic visual or sound effect. Clear that permission separately from the composition, lyrics, recording, photograph and video. Because federal protection is unsettled and state rules differ, label synthetic content where required, preserve a complete chain of title and obtain local legal review before a consequential release.
