Can your employer refuse your annual-leave request?
Annual leave is not a day off you can simply take without approval. Fair Work Ombudsman guidance says employees need to request annual leave before going on leave, and an employer can refuse a request only if the refusal is reasonable. What if November 19 is a public holiday where you work?
Public holidays are separate from annual leave. Employees generally have a right to be away from work on a public holiday, although an employer may make a reasonable request that they work. A public holiday that falls during paid annual leave is not counted as annual leave. Whether the date is a public holiday depends on the relevant location and calendar; no state-specific holiday collision is established here.
