You may have a separate claim under state law, depending on the company’s role, what happened, the law where you live, and any harm you suffered. A breach notice or possible HIPAA violation does not by itself establish a right to recover money.
Why the company’s role matters
“Company” does not tell you which privacy rules apply. HIPAA governs defined covered entities—such as many health care providers, health plans, and health care clearinghouses—and their business associates when they handle protected health information in that role. A consumer health app or personal health record service may fall outside HIPAA but be subject to other rules. HHS explains the distinction and the FTC Health Breach Notification Rule’s potential application to certain health-record vendors and related service providers in its guidance on consumer health information and HIPAA/FTC coverage.

Even when an organization is covered by HIPAA, an exposure is not automatically a proven HIPAA violation. The nature of the information, how it was used or disclosed, and the circumstances of the incident matter. For a breach of unsecured protected health information, the HIPAA Breach Notification Rule generally treats an impermissible use or disclosure as a breach unless the regulated organization demonstrates a low probability that the information was compromised through the required risk assessment, subject to rule exceptions. HHS describes that framework in its Breach Notification Rule guidance.
Which legal route might apply?
| Route | Who acts | What it can address |
|---|---|---|
| Direct HIPAA lawsuit | An individual plaintiff | HIPAA does not give individuals a private right of action to sue for a HIPAA violation. |
| State-law claim | The affected person | A possible claim under the law of the relevant state; available theories, elements, remedies, and deadlines vary. |
| HIPAA complaint | HHS Office for Civil Rights (OCR) | Government review of alleged noncompliance by an entity and conduct covered by HIPAA or Part 2. |
| FTC enforcement | Federal Trade Commission | Potential regulatory action involving certain consumer health businesses covered by FTC rules; it is not the same as an individual damages lawsuit. |
| State attorney general action | A state attorney general | Public enforcement of HIPAA Privacy and Security Rules on behalf of state residents, as authorized by HITECH. |
Why you generally cannot sue under HIPAA itself
HIPAA assigns enforcement to government authorities; it does not create an individual right to bring a lawsuit for a HIPAA violation. In J.R. v. Walgreens Boots Alliance, Inc., the Fourth Circuit concluded that HIPAA does not expressly create a private cause of action and rejected a negligence-per-se theory based on HIPAA in that case. The decision is available from the U.S. Court of Appeals for the Fourth Circuit.

- SHIELD YOUR PRIVACY WITH THE ID DEFENDER ROLLER STAMP: Tired of worrying about your personal information falling into the wrong hands? The ID Defender Roller Stamp offers a simple yet effective solution. With a unique wide camouflage pattern, it quickly and easily conceals sensitive data on a variety of surfaces.
- PRIVACY PROTECTION: useful not only as an ADDRESS BLOCKER or ID POLICE, but also keeps away preying eyes from invoices, authority documents, checks, bank statements and many more.
- SIMPLE TO USE: Just remove the cover and swipe. The wide swipe makes it easy to cover sensitive information.
- VERSATILE APPLICATION: Ideal for a variety of documents, including contracts, court documents, shipping labels, tax returns and more.
- LONG-LASTING INK: The high-quality ink works on both glossy and standard paper and provides up to 330 feet of coverage.
That rule is about suing under HIPAA; it does not decide whether the same conduct supports a distinct claim under state law. A court may reject a direct HIPAA claim while still considering whether another legal duty or agreement was violated.
When a state-law lawsuit may be possible
Depending on the state and facts, a lawyer might assess theories such as negligence, breach of confidentiality, breach of contract, or a privacy-related claim. These are possible categories, not claims available in every state or a prediction that a court will allow one. The elements, defenses, available remedies, and filing deadlines depend on the jurisdiction and the particular cause of action.

- How to Refill the Ink: there are 4 pieces of ID stamp refills, each is about 1.5 ml, you just need to unscrew the cap of the ink bottle (not disposable, you can close the cap for next time of use), then insert it into the hole on the side of the stamp, then turn it upside down, about 5 minutes later, the most of the ink will be replenished to the security roller stamp
For example, a Northern District of California order in Ward v. Mochi Health Corp. described differing views among California federal courts about using HIPAA to support negligence per se. The court allowed that theory to proceed at the pleading stage under its application of California law. That is a district-court ruling at an early procedural stage—not a nationwide rule or a finding that the defendant was ultimately liable. Read the Northern District of California order.

Do not assume that every claim requires proof that someone actually viewed or misused the information, or that exposure alone establishes compensable harm. Those questions depend on the claim and jurisdiction. Evidence of access, misuse, financial loss, medical consequences, discrimination, or other concrete effects may be important to evaluating a particular case, but the governing legal standard must be checked locally.

How to report a possible HIPAA violation to HHS
An OCR complaint is a request for regulatory review, not a personal lawsuit for damages. HHS says anyone may submit a written complaint alleging noncompliance with HIPAA or Part 2. OCR can investigate only entities and conduct within the applicable rules. The complaint should identify the entity and describe the act or omission. HHS generally requires filing within 180 days of when the complainant knew of the alleged violation, but OCR may extend that period for good cause. See HHS instructions for filing a health information privacy or security complaint.
What a breach notice does—and does not—mean
For a breach of unsecured protected health information covered by HIPAA, covered entities generally must notify affected individuals without unreasonable delay and no later than 60 days after discovering the breach. A business associate generally notifies the covered entity; the covered entity is responsible for notices to individuals and HHS, with media notice required in specified circumstances. HHS’s Breach Notification Rule guidance also explains the additional media-notice and Secretary-reporting requirements when a breach affects more than 500 individuals.

These are organizational notification duties. Receiving a notice does not establish that you can sue under HIPAA, prove a state-law claim, or recover damages. Likewise, a company’s failure to send a notice is not, by itself, a determination that an individual has a viable private claim.

What to do if your information was exposed
- Save the notice and communications. Keep copies of letters, emails, app messages, and any explanation of what information was involved.
- Record the timeline. Note when you learned of the exposure and when the company says it discovered the incident. These dates can matter for reporting and legal deadlines.
- Identify the organization and its role. Determine whether it was a health provider, plan, business associate, app, personal health record service, or another kind of company. Its role helps identify which rules may apply.
- Document the information and consequences. Record the categories of data involved and any related fraud, financial loss, medical effects, discrimination, or other impact. Keep supporting records.
- Check state-specific law and deadlines. A privacy or data-breach attorney in the relevant state can assess possible claims, proof requirements, and limitation periods. There is no single filing deadline that applies to every claim described here.
- Consider the appropriate regulator. If the organization and conduct may fall under HIPAA, use OCR’s complaint process. If it is a consumer health service outside HIPAA, FTC rules may be relevant; the applicable regulator depends on the facts.
Who can enforce HIPAA besides HHS?
HITECH authorizes state attorneys general to bring civil actions on behalf of residents for violations of HIPAA’s Privacy and Security Rules. This is enforcement by a public official, distinct from an individual filing a private claim. HHS summarizes that authority on its State Attorneys General page.
