The studio remains responsible for human review, testing, security, intellectual-property rights, engine and model contracts, and platform disclosures. AI use does not automatically give the code copyright protection, prove that it is licensed, or exempt the game from Steam’s content rules.
What “ship” legally and practically means
“Ship” has several separate gates. Passing one does not pass the others:

- Distribution: the game must satisfy the store’s content, disclosure, consumer-protection and technical requirements.
- Contracts: your engine, coding assistant, model provider, asset service, contractors and employees must permit the intended commercial use.
- Rights: you need defensible rights in code, art, sound, writing, localization and other material, plus a way to respond to infringement claims.
- Quality and safety: the studio must find and fix defects, vulnerabilities, performance problems and license violations whether a human or an AI system produced the first draft.
An AI-generated file can therefore be part of a commercial build, but “the model made it” is not a release justification. Treat every accepted output as a contribution that requires normal engineering and legal controls.

Human creative control is the U.S. test
The U.S. Copyright Office’s Part 2 report, dated January 29, 2025, states: “The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements.” The report identifies human-authored material, a creative arrangement of elements, and meaningful modification as examples of contributions that can support protection. A prompt by itself is not enough.

This is a question of what is protected, not whether you may sell the game. You can distribute a work containing material that lacks exclusive copyright protection, but you may have less ability to stop others from copying that material. The analysis also varies by country; the U.S. position should not be presented as a worldwide rule.
The Office reported reviewing more than 10,000 responsive comments during its AI study. That figure describes participation in the study, not a safety or approval threshold for an individual game.
Separate human and AI contributions in a registration
When registering a U.S. work, applicants should identify the human-authored contribution, exclude more-than-de-minimis AI material from the claim, and not list the AI system as an author or co-author. Keep a version history showing what a person designed, selected, arranged, edited or rewrote. A registration that simply claims an entire AI-produced codebase can create an avoidable dispute over the scope of protection.
Code copyright is only one part of ownership
Copyright does not answer every ownership question. A contractor’s agreement, employee-assignment clause, confidentiality obligation, model-provider terms, open-source license or engine agreement can control what you may use and redistribute. Read those documents independently of the copyright analysis.
Who is accountable for AI-written code?
Microsoft’s developer guidance puts the operational rule plainly: “The code your AI agent generates is code you ship, and you are accountable for everything in your app regardless of how it was written.” Your team must read and understand each accepted change, test it as thoroughly as hand-written code, and fix defects or security issues.
Review the behavior, not just the syntax
AI output can compile while implementing the wrong game rule, mishandling save data, exposing an endpoint, leaking secrets, creating an infinite loop or introducing a race condition. Require a human owner for every merged change. Review interfaces, error handling, permissions, memory lifetime, network calls, serialization, platform APIs and failure paths.

Use ordinary engineering gates
- Run unit and integration tests for gameplay systems, services and tools.
- Perform regression testing after generated changes touch shared systems.
- Test performance on the minimum supported hardware, including loading, frame time, memory and network behavior.
- Run security checks on authentication, payments, telemetry, multiplayer traffic, save files and build scripts.
- Review generated build-time tools and scripts; code that never ships in the executable can still compromise credentials or the release pipeline.
- Remove or rewrite code when its behavior, provenance or license cannot be established.
Can an AI assistant copy open-source code?
It can produce code that resembles existing open-source code. Microsoft advises commercial developers to apply the same open-source compliance checks used for any third-party code. Do not assume that a fresh-looking response is original or license-free.

Audit each dependency and suspicious snippet
- Generate a complete dependency inventory for the game, editor extensions, servers, plugins, native libraries, build tools and scripts.
- Record each package version and its license, including transitive dependencies.
- Check attribution, notice-file and source-distribution obligations before shipping.
- Use code-search or similarity review for distinctive generated snippets, especially networking, cryptography, compression, database and platform-integration code.
- Replace code when you cannot determine its origin or comply with the applicable license.
- Package the notices and source offers required by the licenses, and keep the audit report with the release records.
License compliance is separate from copyright registration. A work can contain human-authored code and still violate a third-party license if its conditions were ignored.
What must be disclosed on Steam?
Steamworks distinguishes development assistance from player-facing generative content. Its generative-AI section says efficiency gains from AI-powered development tools are not the focus. In other words, using an assistant to help write or refactor code is not, by itself, the same disclosure category as shipping AI-generated material for players to consume.
Pre-generated player-facing content
If AI produced art, sound, narrative, dialogue, voice, localization or another asset included in the shipped game, describe that use in Steam’s Content Survey as required. Steam reviews pre-generated content under the same promise that the game will not contain illegal or infringing material that applies to other content.
Live-generated player-facing content
If the released game generates content during play using an AI system, disclose it and document guardrails against illegal output. Your controls should address prompts, model responses, moderation, logging, reporting, fallback behavior and what happens when the service is unavailable. A live system needs an operational plan, not merely a statement that a filter exists.

Code assistance versus content disclosure

Complete the Content Survey truthfully. A coding workflow that never produces player-facing content should not be described as live in-game generation, while a game that does generate content during play should not hide behind the fact that the model was also used for programming.

Do engine and model terms allow commercial use?
Every component has its own contract. Unity’s published AI principles state that users own input and output data from Unity AI tools and describe tracking and auditing generated content for intellectual-property and commercial considerations. That statement applies to those Unity tools under their applicable terms; it does not establish the policy of another engine, assistant or model provider.
Check these clauses before production
- Commercial-use grant: does the plan permit selling the game and distributing generated output worldwide?
- Ownership and license: who receives rights in inputs, outputs, fine-tuned material and improvements?
- Indemnity: does the provider offer infringement support, and what exclusions or caps apply?
- Data retention: are prompts, source code, crash logs or proprietary assets retained or used for training?
- Confidentiality: can unreleased code, customer data and licensed assets be sent to the service?
- Audit and export: can you retrieve usage logs, model versions, prompts and generated files if a dispute arises?
- Change terms: can the provider alter ownership, training or commercial-use language during development?
Read the current terms for the edition and region you actually use. A free trial, enterprise plan, hosted API and locally run model may have materially different conditions.
A release workflow that makes AI use defensible
1. Inventory every AI touchpoint
List generated or AI-assisted code files, art, sound, music, text, translations, voice, design documents, tests, shaders, editor tools, build scripts and automated fixes. Include material generated by contractors and anything produced in a prototype that was later copied into the commercial branch.
2. Preserve provenance
For each material contribution, record the tool and model name, version, date, account or plan, useful prompt or instruction, output, human edits, reviewer and final file hash or commit. You do not need to retain every casual autocomplete, but preserve enough evidence to explain a material contribution and reproduce a rights decision.
3. Establish human contribution
Document the person’s design decisions, selection among alternatives, arrangement, edits and integration. Keep briefs, sketches, source files, review comments, pull requests and commit history. These records help distinguish a human-authored game structure from an unmodified model output.
4. Review and test code
Apply the same pull-request rules, test coverage, static analysis, security review and performance budgets used for human-written code. A reviewer should be able to explain what a function does and why it is safe before it merges.

5. Run the license audit
Produce the dependency inventory, investigate similar snippets, satisfy notices and source obligations, and replace anything with unclear provenance. Keep the final report and shipped notices together.
6. Reconcile contracts
Check engine, assistant, model, asset, employment and contractor agreements against the release territory, platforms, monetization model, confidentiality needs and support period. Resolve conflicts before content is locked.
7. Prepare the rights file
Maintain licenses, permissions, contributor assignments, model terms, human-authorship records, asset provenance and takedown-response contacts. This file is useful for a copyright registration, store inquiry, investor diligence or an infringement complaint.
8. Complete platform disclosures
Answer Steam’s Content Survey based on what players receive, distinguishing fixed AI-generated assets from live generation. For live systems, retain the moderation and guardrail design, test results and incident process.
9. Recheck before release
Platform and vendor policies change. Re-read the terms and disclosure questions immediately before submission, and record the versions that governed the release candidate.

How AI-assisted development compares with conventional development

Conventional development may reduce some provenance questions, but it does not remove open-source, contractor, engine, security or platform obligations. The useful comparison is the strength of the controls, not the marketing label attached to the workflow.
Common failure modes and fixes
“The model wrote it, so we do not need to understand it.”
Why it fails: accountability follows the shipped application. Fix: reject changes no reviewer can explain, add tests for the behavior, and assign an owner.
“AI code is automatically public-domain or automatically ours.”
Why it fails: copyright protection depends on human contribution, while contracts and third-party licenses impose separate duties. Fix: preserve human-authorship evidence and perform the same license review used for external code.
“Steam only cares whether we used AI to code.”
Why it fails: Steam’s relevant distinction is player-facing generated content. Fix: disclose fixed or live AI-generated art, sound, writing, localization and other content in the Content Survey, and document live-output guardrails.

What a defensible launch decision looks like
Proceed when the studio can show, file by file and asset by asset, who made the creative decisions, what terms authorize commercial use, which licenses apply, how the code was tested, and what players will see. Hold or replace any contribution whose provenance, contract permission, security behavior or platform disclosure cannot be established.
That standard permits productive AI assistance without treating it as a legal shortcut. The final product is still the studio’s release, and the studio—not the model—answers to players, platforms, licensors and regulators.
