Usually, you cannot resell, lend, or inherit a digital game license. Buying a download normally gives your account permission to use the game, not ownership of a transferable copy. Sharing features can grant limited access on approved devices, but they do not move the license to another person. If future resale or straightforward lending matters, a physical disc or cartridge is generally the clearer option, subject to local law and the title’s technical requirements.
What you actually buy when you purchase a digital game
A digital storefront transaction normally creates a contract between you and the platform or publisher. The platform records an entitlement on your account; it does not hand you a separate copy that you can detach, give away, or sell independently. Your ability to download and play depends on the account, the platform’s authentication systems, and any additional publisher or game-server terms.

This distinction explains why paying the same price as a boxed release does not produce the same legal rights. A physical buyer possesses a particular disc or cartridge. A digital buyer generally receives permission to use software under stated conditions. Those conditions can include personal use, a ban on transfer, revocation, regional limits, and continued compliance with account rules.
How the major storefront terms describe the transaction

These clauses are the providers’ baseline rules. A game publisher can add separate conditions, and consumer-protection or succession law in your country may override a term in a particular situation. Check the current agreement for the storefront, your region, and the individual game before relying on an exception.

Can you resell a digital game?
In ordinary circumstances, no. Because the entitlement is an account-bound license rather than a transferable copy, there is usually nothing you can legally detach and deliver to a buyer. Selling your entire account is not a clean workaround: platform terms commonly prohibit account transfers, and handing over an account also exposes payment details, personal data, achievements, messages, and every other purchase on it.
A marketplace listing, gift code, or unused key can be different from an activated account license. If a provider expressly permits transfer of an unredeemed code, that permission controls. Once a code has been redeemed to an account, the resulting entitlement normally follows the account rules. Never assume that a key bought from a third party is transferable, legitimate in your region, or supported after a dispute.
Why a refund is not the same as resale
Storefront refund programs, where available, return a purchase to the provider under that provider’s conditions. They do not create a secondary market. A refund can also remove access to the game and related downloadable content, so keep records of the transaction and read the applicable time, playtime, and regional requirements before requesting one.

Can you lend a digital game to a friend?
Not in the ordinary sense of handing over a copy for someone else to use. PlayStation’s cited terms expressly prohibit loaning content, and Steam describes accounts and subscriptions as strictly personal except for expressly permitted functions. Giving a friend your password can violate those rules and can trigger security checks, lockouts, or loss of access.
Xbox Home-console sharing is controlled access, not a transfer
Microsoft separates a user license from a device license. The user license stays associated with the purchasing Microsoft account. A device license can attach to a designated Home console, allowing another profile using that console to play eligible purchases under Microsoft’s sharing rules. This arrangement is limited to the approved console setup; it does not give the second person ownership, a detachable copy, or a right to move the game to their own account.
Home-console settings and sharing policies can change, and limits may apply to how often the Home console can be changed, which content qualifies, and whether online services or downloadable content are available to the other profile. Treat the feature as a convenience for a household or controlled device, not as a sale or a permanent loan.

What “game sharing” does and does not do
- It can authorize play through an account, console, family feature, or other mechanism the provider documents.
- It does not usually change the name of the license holder.
- It does not create a resale right or allow the recipient to download the game independently after the sharing arrangement ends.
- It can stop working when an account is removed, a device is de-designated, credentials change, or the provider revises its rules.
Can someone inherit your digital game library?
Inheritance is not automatic. A will can identify your accounts, devices, and wishes, but it cannot by itself rewrite a provider’s personal, non-transferable, or revocable license. An executor or beneficiary may therefore inherit the hardware and the financial records without acquiring a contractual right to download or play every game attached to the deceased person’s account.

The outcome can depend on the provider’s current account procedures, privacy and identity-verification rules, the publisher’s separate terms, and the succession law where the person lived. Some services may help an estate close an account or release limited information; that is different from transferring the game license. Do not promise an heir that an executor can simply change the account holder.
Prepare an estate record without exposing passwords
- List each platform account identifier, the associated email address, and the country or region on the account.
- Record purchase receipts, subscription details, two-factor-authentication recovery methods, and support-case numbers in a secure estate document.
- Inventory physical discs, cartridges, consoles, and boxed codes separately from digital entitlements.
- State who may access devices and records, while storing passwords in a reputable password manager or other protected method rather than in an openly circulated will.
- Instruct the executor to contact the provider using its published bereavement or account-closure process and to follow identity, privacy, and local probate requirements.
This documentation can preserve evidence of purchases and make account administration possible, but it cannot guarantee that a digital library will pass to an heir.

What U.S. law says about physical copies
Section 109(a) of Title 17 of the United States Code says the “owner of a particular copy” lawfully made under copyright law may “sell or otherwise dispose of the possession of that copy.” That first-sale principle is why an owner can generally sell or lend a lawfully purchased game disc or cartridge as an object.
The statute also restricts commercial rental, lease, or lending of computer programs, while providing exceptions for programs embodied in certain limited-purpose video-game computers. A private person lending a console game to a friend is not the same as operating a commercial rental business, but the exact legal result depends on the facts and the jurisdiction. First-sale doctrine does not convert an account license into ownership of a digital copy, and it does not override a game’s separate activation or server requirements.

Checks to make before buying digitally
- Read the storefront agreement. Look for “licensed, not sold,” personal-use language, transfer restrictions, revocation clauses, and account-closure provisions.
- Check the game’s own terms. Publisher rules may govern activation keys, user-generated content, virtual items, downloadable content, and online services.
- Identify technical dependencies. Confirm whether the title needs a platform account, one-time code, persistent internet connection, launcher, or a server that could eventually shut down.
- Separate the base game from add-ons. DLC, season passes, subscriptions, and virtual currency can have different entitlements and may not follow a physical copy or another account.
- Decide whether future transfer matters. If you expect to sell, lend, or give the game away, choose a physical release and verify that it does not rely on a previously redeemed code.
- Keep purchase evidence. Save receipts, order numbers, and the account region so support or an estate representative can identify the transaction.
Common situations and the likely result
You bought a game years ago and want to sell it
You normally cannot list the activated entitlement as a transferable product. You can ask the storefront about a qualifying refund, but a refund is controlled by its policy and is not a private sale.
Your child wants to use your library
Use the platform’s documented family, household, or device-sharing feature if one exists. Keep the purchasing account secure, understand which profile receives achievements and online access, and do not represent the arrangement as a transfer of ownership.
You are administering a parent’s estate
Secure the devices and records, locate the account region and receipts, and contact the provider through its estate or privacy process. Expect that hardware and physical media may be distributable even when digital licenses are not.
A platform account is suspended or closed
Follow the provider’s appeal or recovery process and preserve proof of purchase. A paid transaction does not necessarily create a continuing right to download when the governing license is suspended, revoked, or tied to an unavailable account.
Bottom line for buyers
Digital games are usually permissions attached to an account, not personal property that can be sold, lent, or passed on like a book. Platform sharing can provide narrowly defined access, but it leaves the license with the original account and can change over time. Physical media offers the clearest path to resale or ordinary lending, although activation codes, online servers, regional rules, and local law still matter. Plan digital purchases as long-term access to a service, keep estate records, and verify the exact terms before spending money when transferability is important.
