You may be allowed to distribute or monetize an AI-generated track under a music service’s terms, but that permission is not the same as copyright ownership—and it does not clear lyrics, samples, voices, or other material you used. Whether the track qualifies for copyright protection depends on the human creative contribution and the law that applies. You must also meet the current rules of your distributor and destination platforms.
Can I release AI-generated music on Spotify?
AI involvement alone does not establish that a track is barred from Spotify. Release depends on the rights and service terms that apply to your track, your distributor’s rules, and Spotify’s policies. A distributor may accept AI-made music while still requiring you to have the necessary rights and follow the destination platform’s rules.

Spotify’s September 25, 2025 announcement described measures addressing claims of unauthorized AI voice cloning and fraudulent deliveries to another artist’s profile. Spotify also describes AI Persona badges for artist identities it has reviewed and identified as AI-generated, and says AI credits can be added through a distributor. These measures concern identity, credits, and platform handling; they do not establish that every AI track will be accepted, or that an accepted track is protected by copyright.

Before delivery, verify the current rules of both your distributor and Spotify. DistroKid, for example, says it accepts music made with AI tools subject to its own rules and destination services’ guidelines; its examples include not impersonating another person without permission. That is a distributor-specific policy, not a guarantee that any particular release will be accepted.

Can I monetize a song I made with AI?
Potentially, if the generator’s terms permit commercial use in the circumstances in which you made and downloaded the track, and you have rights to all included material. A commercial-use grant is permission under a contract to attempt monetization—such as distributing or selling a track. It does not by itself mean copyright exists, guarantee a distributor or platform will accept the track, or make third-party material yours.
Suno as an example: plan and timing matter
Suno’s guidance is one service-specific example, not a rule for all generators. Its December 17, 2025 help guidance says its paid-plan commercial-use grant permits monetization through distribution, traditional sales, and more, and that Suno does not claim a share of royalties. Suno’s September 4, 2026 help page describes songs made while subscribed to its Pro or Premier plans as owned by the user under its terms, while noting that copyright protection may still not apply.

| How a Suno track was made | What Suno says about use | Important qualification |
|---|---|---|
| Made on the free plan | Suno says free-plan tracks are for noncommercial use. | Starting a paid subscription later does not retroactively grant commercial-use rights for a track made earlier on the free plan. |
| Made while subscribed to Pro or Premier | Suno says paid-plan songs receive commercial-use rights; its September 4, 2026 help page describes those songs as owned by the user under its terms. | The grant remains subject to Suno’s terms and conditions, including applicable download and use requirements. Suno does not guarantee copyright will vest. |
Suno’s terms add conditions: its commercial-use grant applies to a permitted download through an approved channel, and certain remixes are excluded from commercial use. Its terms also say similar output may be generated for other users. Check the terms that applied when the track was created and downloaded, rather than assuming a current plan description covers earlier work. A paid plan does not clear lyrics, samples, or other material you did not have permission to use.
If I pay for an AI music generator, do I own the song?
That depends on what “own” means and on the service’s contract. A service may assign or describe certain rights in an output, or grant permission to use it commercially, without guaranteeing that copyright protects the output. Suno’s distinction is illustrative: its September 4, 2026 help page says songs made while subscribed to Pro or Premier are owned by the user under its explanation of its terms, but separately cautions that the material may not qualify for copyright protection. Read the terms for the particular service, plan, track, and download; do not treat the word “ownership” as a copyright ruling.

Also separate rights in the generated output from rights in material you supplied. If a track includes someone else’s lyrics, a sample, a voice, or other protected material, your subscription does not itself provide permission to use that material. Suno says a creator should be the exclusive rights holder of all material being monetized, including lyrics.
Can I copyright a song made entirely by AI?
In the United States, the U.S. Copyright Office’s January 29, 2025 report summary says copyright protection for generative AI output depends on a human author determining sufficient expressive elements. Human-authored expression that is perceptible in the output, or a sufficiently creative human arrangement or modification, may qualify. Merely writing prompts does not, by itself, establish the human authorship the Office requires.

That does not mean any use of AI makes a song uncopyrightable. The Office says AI assistance in a creative process, or AI-generated material included in a larger human-generated work, does not automatically prevent copyright protection. The relevant question is what expressive elements a person created or contributed—not simply whether an AI tool was involved.

Suno’s September 4, 2026 help page gives its own U.S.-law explanation: it says music made 100% with AI, without human-written lyrics or music, would not qualify for copyright protection, while user-written lyrics remain the user’s. It also notes that some regions or registrars may treat Suno as an instrument. That is Suno’s explanation, not a substitute for the Copyright Office’s guidance or advice about another jurisdiction. Copyright eligibility and registration standards can differ outside the United States.

Can I use AI-generated music in YouTube videos?
Possibly, but confirm both the rights to the track and the disclosure rules for your delivery route. YouTube’s music-partner guidance tells partners to disclose generative AI use in content delivered to YouTube. It describes “Fully Gen AI,” “Partly Gen AI,” and “No Gen AI” designations in DDEX or CSV delivery metadata. In its examples, a prompt-generated downloaded track is fully AI-generated; an AI-generated bassline beneath human vocals and instruments is partly AI-generated.
That guidance addresses metadata delivered by music partners. It should not be read as a universal instruction for every creator uploading directly to YouTube. Check the current instructions that apply to your account and method of delivery. Separately, a disclosure category does not grant you permission to use someone else’s lyrics, recording, voice, or likeness.
What to check before releasing or monetizing a track
- Identify the relevant plan and dates. Record which generator and account tier applied when the track was made and downloaded. A later subscription may not change the rights for an earlier output.
- Read the applicable terms. Check commercial-use permission, any ownership language, download conditions, remix restrictions, and whether the permission covers your intended use.
- Document your human contribution. Keep lyrics, drafts, project files, and records of your melody, performance, arrangement, edits, or other creative work. These may help establish what you contributed if copyright eligibility is at issue.
- Clear material you did not create. Confirm permission for lyrics, samples, voices, likenesses, and other included material. Do not imitate a real person’s identity or voice without permission.
- Check the release route. Verify your distributor’s current AI-content policy and the destination platform’s delivery, disclosure, and identity rules before submitting.
- Get jurisdiction-specific guidance when the stakes justify it. For a copyright registration or a high-value release, consult the relevant local copyright office or a qualified lawyer in the applicable jurisdiction.
What Spotify’s payout figures do—and do not—tell you
In its September 25, 2025 announcement, Spotify said its total platform-wide music payouts were $1 billion in 2014 and $10 billion in 2024. Those figures are not an estimate of what an individual creator will earn, a payout figure for AI-made music, or a promise that a particular track will be accepted or monetized.
