Using AI does not by itself prevent you from publishing or monetizing a game. But permission to release a game, ownership of its creative content, and eligibility for copyright protection are separate questions. The answer depends on what AI created, what people contributed, the rights and terms that apply to the shipped material, and the rules of each storefront and jurisdiction where you distribute it.
Publishing permission and copyright protection are different questions
A game can be publishable even if some AI-generated material does not qualify for copyright protection. The key is whether you have the rights needed to use the material and whether the game meets applicable laws and storefront rules. Conversely, copyright protection for your own contributions does not guarantee that every asset is free of third-party claims.

Check the AI provider’s current terms, any relevant licenses or restrictions, and the rules of the storefront.
- Can you claim copyright in it? That depends on the human authorship in the particular material and the law that applies.
- Will the platform accept it? Storefronts may require content declarations, rights assurances, safeguards, or review, independently of copyrightability.
What the U.S. Copyright Office says about AI-made game content
In its January 29, 2025 report, the U.S. Copyright Office said that prompting alone does not establish human authorship of the expression generated by an AI system. Copyright may apply where a person determines sufficient expressive elements, contributes perceptible human-authored material, or makes a sufficiently creative arrangement or modification of AI output. The Office also said that using AI as an assistive tool, or including AI-generated material in a larger human-authored work, does not automatically make the larger work unprotectable.
#1 Best Overall
For a game, consider each contribution rather than treating the entire project as one indivisible asset. Human-written code, story, level design, editing, selection, or arrangement may qualify for protection if it meets the ordinary legal requirements. An image, track, or passage generated with little or no human expressive contribution may not itself receive U.S. copyright protection. The Office’s general guidance does not determine the status of a particular game’s assets.
This is U.S. guidance, not a worldwide rule. Copyright laws and their application differ by jurisdiction, and the Copyright Office describes AI copyright questions as subjects of ongoing study.

What Steam requires developers to disclose
Steam’s Content Survey asks developers to describe AI services used during development or included in the product. Its categories distinguish between content created with AI during development and shipped with the game, and content generated by AI while the game is running.

| Steam category | What it covers | What to disclose |
|---|---|---|
| Pre-generated | Player-consumed content made with AI assistance during development and shipped with the game. | Describe how the AI was used to create the shipped content. |
| Live-generated | Content generated by AI while the game is running. | Describe the implementation and the safeguards intended to prevent illegal content. |
Steam says it reviews AI-generated output as it reviews other content and expects the game to comply with the developer’s declarations. Its onboarding guidance also says developers must not publish content they do not own or have adequate rights to, or content that violates applicable law. Steam reviews the store presence and build before release. A disclosure is therefore not a substitute for rights clearance or platform review.
Google Play and European Union rules need a narrower reading
Google Play
Google Play’s AI-Generated Content policy addresses generative-AI apps and requires developers to prevent prohibited or harmful output and follow other Play policies. Its examples include apps whose central feature is generating AI content. The policy does not, by itself, establish a dedicated AI-disclosure requirement for every game that used AI only during development. Check the current policy against the game’s functionality, especially if players can generate content through the game.
European Union
European Commission materials describe AI Act transparency obligations and a code of practice concerning machine-readable marking and detection of certain AI-generated or manipulated content, as well as transparency measures for particular kinds of text. Those materials do not establish a universal labeling obligation for every AI-assisted game asset. Whether an obligation applies depends on the content and context, so verify current EU guidance for the specific game and its distribution.

How to check an AI-assisted game before release
- Inventory what ships. List the AI-generated material, what people substantially changed, and what players will see or hear. Keep drafts and records of human selection, editing, and arrangement; they can help document the contributions relevant to authorship.
- Review the provider’s current terms. Check the terms for commercial use and any relevant licenses, restrictions, or warranties. Do not assume that access to an AI tool makes every output commercially usable.
- Review rights risks in the assets. Look for material that may reproduce protected expression, branding, or a person’s likeness. A storefront declaration does not clear those rights.
- Complete each storefront’s current declarations. For Steam, accurately describe pre-generated and live-generated content; if content is generated live, describe the safeguards intended to prevent illegal output.
- Check the laws where you will offer the game. U.S. Copyright Office guidance does not resolve the rules in every country or every legal issue involving AI-generated material.
Choosing between AI workflows
If you are deciding how to use AI in development, compare workflows on the points that affect rights, documentation, and release readiness:
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →- Human control: How much expressive choice does a person make in the final image, writing, music, or other content?
- Commercial-use terms: What do the provider’s documented terms allow, and what restrictions or conditions apply?
- Provenance: Can you identify which generated material made it into the build and audit how it was selected or changed?
- Live-generation safeguards: If players can trigger generation, what measures are in place to prevent illegal or otherwise prohibited output?
- Platform requirements: What declarations, rights assurances, and review steps apply on each target storefront?
These checks help you assess the release risks; they cannot guarantee that an asset is non-infringing or that a platform will approve the game.
