Can you list a side hustle on LinkedIn while employed? Employer policies and disclosure rules explained

Yes, you may be able to list a side hustle on LinkedIn while holding a full-time job—but LinkedIn is not a permission slip. Your employment contract, handbook, moonlighting or exclusivity policy, conflict-of-interest rules, confidentiality and intellectual-property agreements, and local law determine what you can do. If the side business competes with your employer, overlaps with its customers or regulated work, uses employer information or resources, or could look like divided loyalty, disclose it and obtain the required written approval before promoting it publicly.

The safest sequence is to review the rules, document the side hustle and any overlap, obtain written guidance where required, and then create a factual LinkedIn entry that clearly separates the two roles.

What determines whether you can list it

A LinkedIn experience entry is a public statement about your work. It does not, by itself, authorize outside work. Permission comes from the terms governing your employment and from any professional or sector-specific duties.

  • protect confidential information and assign work-related intellectual property; and
  • avoid soliciting clients, staff, or business opportunities through the employer.

Acas explains that restrictive covenants are normally enforceable only when they are clear, specific, and time-restricted, while warning that this area of law is complex. Its 2026 guidance also cites a UK lower-earnings limit of £129 per week for an exception relating to exclusivity clauses. That figure is a UK rule and does not automatically apply to another country, employment status, or contract.

Conflict rules include appearances

A conflict is not limited to an actual financial gain. Ofgem states that even the perception of a conflict can damage its reputation. The General Medical Council (GMC) says professionals must be open and honest about interests that may conflict—or be seen to conflict—with their duties. UK Civil Service guidance treats a risk that judgment could be influenced as a conflict even where no actual benefit has occurred.

Apply the same practical test to LinkedIn: could a reasonable reader think your side business is an employer service, that you are using inside knowledge, or that your employer’s decisions could benefit your business? If yes, treat the issue as a disclosure question before you publish.

Sector and role can add duties

Public-sector, medical, financial, regulated, and fiduciary roles often have stricter disclosure requirements. GMC guidance requires openness about interests in public professional communications. UK Civil Service rules require declaration and documented mitigation, and prohibit using official information or position to advance private interests. CFA Institute Standard IV(B), updated in April 2024, requires written consent from all parties before accepting compensation that competes with or might reasonably be expected to create a conflict with an employer’s interests.

When a side hustle is lower risk

A side activity is easier to separate when it serves a different market, operates outside working hours, uses your own equipment and accounts, and has no connection with your employer’s customers, suppliers, products, decisions, or confidential information. Examples might include teaching a hobby subject to the general public while working in an unrelated industry, or selling original artwork without using employer systems or contacts.

“Unrelated” is not a legal conclusion, however. A side business can become relevant after a promotion, a new client, a change in products, or a move into a regulated role. Recheck the position whenever one of those facts changes.

Red flags that call for disclosure or approval

  • Competition: the side hustle offers a similar product or service, targets the same buyers, or could take an opportunity the employer would pursue.
  • Customer or supplier overlap: you sell to, advise, negotiate with, or make decisions affecting people connected to your employer.
  • Confidential information: the business relies on pricing, road maps, customer lists, code, processes, research, or non-public strategy learned at work.
  • Resource use: you work on the business during paid time or with employer devices, software, facilities, data, accounts, or assistants.
  • Brand confusion: your profile, logo, title, or wording could imply employer sponsorship or an official partnership.
  • Divided loyalty: your side activity could influence—or appear to influence—your recommendations, purchasing, hiring, investment, clinical, regulatory, or public decisions.
  • Restricted relationships: you plan to solicit employer clients, colleagues, candidates, or suppliers, or use introductions made through your job.

Decision framework: list now, seek approval, or wait

Option When it fits Main control
List after a documented no-conflict check The contract permits outside work, there is no meaningful competitive or customer overlap, and resources and information remain separate. Use a separate business identity and factual description; retain your written assessment.
Seek written approval first The policy requires approval, overlap is arguable, the work is regulated, or a reasonable reader could perceive divided loyalty. Tell HR, your manager, compliance, or the designated ethics contact what the business does and request a written decision and safeguards.
Keep it off LinkedIn temporarily You cannot confirm the policy, approval is pending, or the public listing could expose confidential information or create a misleading endorsement. Do not promote the activity until the restriction or uncertainty is resolved; obtain local legal advice if necessary.

This is a risk-management framework, not a substitute for interpreting your contract or local law.

Step-by-step check before editing your profile

  1. Collect the governing documents. Save the signed contract and current versions of the handbook, ethics code, outside-work policy, confidentiality and IP terms, and client-restriction clauses.
  2. Describe the side hustle precisely. Record its services, customers, sector, expected hours, compensation, tools, business entities, and every source of information it will use.
  3. Map the overlap. Compare the activity with your employer’s products, customers, suppliers, competitors, regulated entities, and decisions you influence. Include future customers you might reach through LinkedIn.
  4. Test actual, potential, and perceived conflicts. Ask whether the side business could benefit from your position, whether your judgment could be questioned, or whether someone could mistake it for an employer service.
  5. Request written guidance where needed. Send a factual request to HR, your manager, compliance, or the ethics officer. Ask whether approval is required, what limits apply, and whether recusal, non-solicitation, or other controls are needed. Keep the response with your records.
  6. Create the entry only after clearance. Use the independent business name, accurate dates, and a neutral description. State that the work is independent if that is true, without suggesting employer endorsement.
  7. Audit the rest of your profile. Review the headline, About section, posts, portfolio links, recommendations, and direct messages for confidential information, employer branding, client solicitation, or claims made during work time.
  8. Reassess on change. Repeat the check after a promotion, new side-hustle service, new client, employer move, policy revision, or change in law.

How to disclose a side hustle clearly

A useful disclosure gives the reviewer enough information to identify a conflict without burying the request in marketing language. CFA guidance says a disclosure should include the terms of the additional-compensation agreement, the nature of compensation, its approximate amount, and its duration. An employee-facing request can adapt that level of detail:

  • confirmation that no employer time, equipment, data, confidential information, client list, or branding will be used; and
  • proposed safeguards, such as recusal from specified decisions, geographic or customer limits, and a promise not to solicit employer relationships.

Be accurate rather than reassuring. If overlap exists, identify it and propose a control. A short, candid disclosure is more useful than claiming there is “no conflict” without explaining the basis.

How to write the LinkedIn entry

Use a separate identity and factual wording

List the side business under its actual business name or your own name, select the correct employment type, and use dates that reflect when the activity began. Describe what you do, who you serve in broad terms, and the independent nature of the work. Do not copy the employer’s slogan, product language, logo, or job title.

Keep confidential details out

Do not include customer names, unpublished performance figures, internal processes, source code, pricing, road maps, case details, or screenshots from employer systems. A public profile can reveal information even when the audience is limited to connections.

Separate time, equipment, and accounts

Use personal accounts, devices, storage, payment systems, and communication channels, and work outside paid hours. Follow any policy that is stricter than this baseline. Keeping a simple calendar and expense record can help demonstrate separation if a question later arises.

Avoid implied endorsement

Do not say that your employer “supports,” “partners with,” or “uses” the side business unless an authorized agreement says so. If the employer’s name appears in your profile because it is your current job, make the side-business description independently understandable.

Can an employer make you remove it?

Possibly. An employer may rely on a clear contract term, an applicable policy, confidentiality or IP obligations, a conflict finding, or a legitimate instruction protecting customers and business information. Whether a demand is enforceable depends on the wording, your worker status, the industry, and the jurisdiction. A request to remove a profile entry is not automatically lawful or unlawful.

Ask for the reason and the specific clause or policy in writing. Preserve the original entry and correspondence, avoid deleting evidence while a dispute is active, and obtain advice from an employment lawyer, union, professional regulator, or relevant authority in your jurisdiction. Do not retaliate by publishing confidential material or soliciting clients.

Jurisdiction and worker-status limits

There is no worldwide rule that answers this question. Employment law can differ by country, state, province, sector, and worker classification. The U.S. Department of Labor’s independent-contractor rule took effect on March 11, 2024, but that classification rule does not override a private employer’s contract or outside-work policy. A person classified as an employee, contractor, officeholder, civil servant, clinician, or regulated professional may face different duties.

UK guidance, including the £129-per-week exclusivity exception cited by Acas, should not be exported to another legal system. If your documents use governing-law or forum clauses, note them when seeking advice. A cross-border side business may also create tax, licensing, data-protection, or professional-registration obligations that are separate from LinkedIn.

What to do if approval is denied

  1. Read the denial and identify whether it relies on exclusivity, competition, confidentiality, performance, working-time, or reputational risk.
  2. Ask whether a narrower activity, customer restriction, schedule, recusal, or non-solicitation undertaking would remove the concern.
  3. Request the final position and appeal route in writing, especially if the policy provides one.
  4. Do not advertise the side hustle as approved while the issue is unresolved.
  5. Obtain independent, jurisdiction-specific advice before breaching a direction, resigning, or signing a new restriction.

Practical questions to ask yourself

  • Would I be comfortable showing the exact LinkedIn wording to my manager, a regulator, and a customer?
  • Could any sentence be read as using my employer’s authority, information, or endorsement?
  • Can I prove that the work is done on my own time and systems?
  • Have I disclosed relationships that a reasonable outsider might regard as relevant, even if I believe I can remain impartial?
  • What event would trigger a fresh review, and have I set a reminder to perform it?

Bottom line

You can often list a side hustle while employed when your contract permits it and the activity is genuinely separate. The public listing should come after—not instead of—the required disclosure or approval. Check the documents, evaluate real and perceived conflicts, protect information and resources, separate the brands, and get written, local advice when the wording or risk is uncertain.

Frequently Asked Questions

Do I have to tell my employer about every side business?

Not universally. You must follow the contract and policies that apply to you. If they require disclosure, or if the activity could compete, overlap with customers, use confidential information, involve regulated work, or appear to affect your judgment, disclose it before promoting it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I add an LLC to LinkedIn without naming my employer?

Omitting your employer does not remove contractual or conflict duties. Review the applicable rules, disclose where required, and make sure the LLC entry does not imply endorsement, use confidential information, or target restricted relationships.

What if my employer has no written moonlighting policy?

Other contract terms and general duties may still apply, including confidentiality, intellectual property, fidelity, non-solicitation, working-time, and professional-regulatory obligations. Ask HR or compliance for written guidance before public promotion when overlap is plausible.

Is a LinkedIn post different from an Experience entry?

Both are public communications. A post can reach a wider audience and make promotional claims, while an Experience entry is a continuing representation of your work. Neither one creates permission, and both should follow the same disclosure, confidentiality, and branding controls.
