Sometimes—but there is no single U.S. permit that makes every autonomous-vehicle road test legal. Federal vehicle-safety law applies, and state rules can set separate requirements for the vehicle, operator, permit, and test conditions. The answer depends on where and how the vehicle will be tested.
What determines whether a test is legal?
A public-road test must satisfy the requirements that apply to the vehicle and the planned operation. Relevant details include the state and local jurisdiction, whether a human safety driver is present, whether the activity is testing or public deployment, the vehicle’s federal compliance or exemption status, and any limits on routes or operating areas.

A permission issued by one state does not authorize testing in another. Rules may also distinguish testing from passenger service or commercial deployment, so do not assume that authorization for one activity covers another.

Federal vehicle-safety requirements do not disappear because a vehicle is being tested. NHTSA’s 2016 Federal Automated Vehicles Policy states that entities must comply with federal law and applicable NHTSA regulations before operating vehicles on public roadways, in testing as well as normal operation. Because that policy is historical, check current federal requirements for a specific test.
NHTSA describes federal oversight that includes vehicle safety requirements, defects, recalls, and enforcement. Its guidance for automated driving systems discusses safety practices such as system safety, operational design domain, object and event detection and response, and fallback behavior. NHTSA says that this guidance is voluntary and has no compliance requirement or enforcement mechanism as guidance; that does not waive separate binding federal obligations. See NHTSA’s Automated Driving Systems page for its guidance and federal-state roles.
States set different operational rules
States may regulate driver licensing, vehicle registration, testing permits, operator credentials, allowed operating areas, disclosures, and crash reporting. Three official state examples illustrate why a general yes-or-no answer is not enough; they are not a complete state-by-state survey.
| Jurisdiction | What the official source establishes | What to verify |
|---|---|---|
| California | The California DMV says a manufacturer with a permit to test with a safety driver is authorized to test on any public road in California. The DMV distinguishes safety-driver testing permits from driverless testing permits. The permit-holder page dates its listed permit-holder information to September 17, 2026. | Check current DMV requirements and the specific permit category. The authorization described applies in California, not elsewhere. |
| Arizona | ADOT publishes requirements for autonomous vehicles testing or operating without a driver. Its guidance discusses federal compliance and required submissions, and says the department may issue a cease-and-desist letter when specified submissions are missing. Read the ADOT requirements. | Determine whether the planned vehicle and operation fall under the driverless rules; do not infer that every test configuration has identical requirements. |
| Nevada | Nevada’s statute and administrative regulations address autonomous-vehicle testing and highway operation. The regulations include testing credentials, and the statute includes crash-reporting provisions. NRS Chapter 482A and NAC Chapter 482A provide the relevant texts. | Check the currently effective provisions and whether they apply to the vehicle and test. |
Local restrictions, road conditions, and other road-use rules may add relevant limits. Confirm the rules for every jurisdiction and road segment on the planned route.

NHTSA’s Automated Vehicle Safety page says states currently permit a limited number of self-driving vehicles to conduct testing, research, and pilot programs on public streets, while NHTSA monitors safety through its Standing General Order. That description is not a nationwide authorization for any particular vehicle or test.

The official sources establish that requirements depend on the jurisdiction and setup; they do not determine whether an unspecified proposed test is permitted. For a concrete operation, consult the current official rules for the relevant state and local authorities, and seek qualified legal counsel. The vehicle, operator, route, and test purpose all need to be assessed against the rules that apply.
