Usually not if U.S. sanctions law applies and the recipient is a blocked person or an entity blocked through its ownership. A crypto transfer is not a sanctions loophole: the U.S. Treasury’s Office of Foreign Assets Control (OFAC) says the obligations are the same for digital currency and fiat. A transfer may be allowed only when an applicable license, authorization, exemption, or other permission covers that specific transaction. The answer depends on the people and entities involved, the governing sanctions program, and the transaction’s jurisdiction and purpose.
Does OFAC sanctions law apply to cryptocurrency?
Yes. OFAC’s FAQ 560, dated March 19, 2018, says: “Yes, the obligations are the same.” Its digital-currency guidance covers virtual currency, sovereign cryptocurrency, and digital representations of fiat currency. Where U.S. sanctions prohibit a transaction with a blocked person or prohibit dealing in their property, using Bitcoin or another crypto-asset does not change the rule.

For people subject to OFAC rules, prohibited conduct can include unauthorized transactions with blocked persons, evading sanctions, causing a violation, or attempting one. Whether a particular transaction is prohibited depends on the sanctions program and the facts; not every person described informally as “sanctioned” is subject to the same restrictions.

Who must consider U.S. sanctions?
OFAC rules generally apply to U.S. citizens and permanent residents wherever they are, all individuals and entities in the United States, and entities organized under U.S. law, including their foreign branches. Some sanctions programs also reach certain foreign subsidiaries owned or controlled by U.S. persons. A non-U.S. person may face restrictions for conduct such as causing or conspiring to cause a U.S. person to violate sanctions, evading sanctions, or engaging in conduct covered by a particular program.

OFAC FAQ 11, updated August 21, 2024, describes who must comply; the regulations for the specific program determine its reach. Identify the sender’s citizenship, residence, location, and organizational status, as well as any U.S. persons or intermediaries involved, rather than assuming that a transfer is outside U.S. rules because it is made abroad or directly between wallets.
Does a sanctions-list match automatically answer whether a transfer is prohibited?
No. Start by identifying the actual recipient and any relevant ownership or property interest, then determine which sanctions program applies and what it prohibits. A program may block property, prohibit a specified service or class of transaction, or impose other restrictions. Some programs also provide licenses, authorizations, or exemptions for defined activity; none should be assumed to cover a proposed transfer without checking its terms.

Check ownership as well as the recipient’s name
Under OFAC’s 50 Percent Rule, an entity is blocked if one or more blocked persons own, in aggregate, at least 50 percent of it, directly or indirectly. The entity need not appear separately on the sanctions list. A name search alone therefore may miss a blocked company or other entity. Ownership facts matter, and an indirect ownership chain may require careful review.
Do not treat a wallet-address search as legal clearance
OFAC’s Sanctions List Search can return an exact address match when an address hash is entered. An exact match is relevant, but no exact match does not establish that the recipient is unblocked, that an address belongs to the person claimed, or that the transaction is permitted. Identity, beneficial ownership, intermediaries, and other program restrictions still need consideration.

What should you check before sending crypto?
- Determine the relevant jurisdiction. Identify the sender’s citizenship, residence, location, and organizational status, along with any U.S. or other applicable sanctions nexus.
- Identify the recipient and ownership. Verify who controls the destination and whether a listed or blocked person has a direct or indirect interest in the recipient or its property.
- Read the applicable restriction. Establish whether the relevant measure blocks the person’s property or instead restricts a particular transaction, service, sector, location, asset, provider, or platform.
- Consider intermediaries and purpose. Check whether the transaction could cause or facilitate a covered person’s violation, or evade a prohibition.
- Verify any permission. Confirm that a specific license, general authorization, statutory exemption, or other permission applies to the actual parties, asset, purpose, and transaction.
- Pause if a material fact is uncertain. Check current official lists and program rules, and consult qualified sanctions counsel or an international trade compliance adviser before proceeding.
A wallet provider’s acceptance of a transaction, a blockchain explorer’s display, or the apparent absence of an address match is not a legal determination that a transfer is permitted.
How does the European Union treat crypto transfers?
The EU has a separate sanctions framework; U.S. rules should not be treated as a complete statement of EU law. European Commission guidance on Russia-related measures says crypto-assets can fall within the relevant definitions of “funds” and, potentially, “economic resources.” As a result, prohibitions on making funds or economic resources available to listed persons can apply to crypto-assets as they do to other covered property.

The EU’s restrictions are also program-specific. Materials published in July 2026 describe additional, specific restrictions concerning certain crypto-assets, providers, and platforms in the Russia context. Those measures do not establish that every EU sanctions program prohibits every crypto transfer. For a proposed transaction, identify the applicable EU measure, parties, asset, provider, and any relevant authorization or exemption; do not extrapolate a Russia-related rule to all EU sanctions.

If a U.S. person determines that they hold virtual currency that must be blocked, OFAC FAQ 646 says they must deny all parties access to it, maintain appropriate controls, and meet reporting requirements. OFAC says the virtual currency does not need to be converted to fiat or placed in an interest-bearing account. The holder must report blocked virtual currency within 10 business days and annually for as long as it remains blocked.

These are handling duties for property already held; they do not authorize sending it to a blocked person or returning it without applicable authorization or the end of the prohibition. Follow the relevant program’s requirements and seek qualified advice if you are unsure whether the property must be blocked.
What are the possible consequences of an unauthorized transfer?
OFAC can impose civil penalties under a strict-liability standard in many cases, so civil liability may apply even when a person did not know, or have reason to know, that the transaction violated sanctions. OFAC says it considers the totality of the circumstances, including compliance controls and remedial measures. Penalty amounts vary and are adjusted; check the current rules rather than relying on a fixed figure.
OFAC’s Virtual Currency Industry Compliance Guidance, released October 15, 2021, discusses risk-based compliance and enforcement exposure. The consequences of a particular transaction depend on the applicable authority and facts, including the person’s conduct and any relevant license or exemption.
What is the practical answer?
If U.S. sanctions jurisdiction applies, do not send crypto to a blocked person or deal in blocked property unless you have confirmed that a specific authorization, exemption, or other permission covers the transaction. If EU rules may apply, assess that framework separately. For a real proposed transfer, resolve identity, ownership, jurisdiction, and program-specific restrictions before sending; an address search or a wallet provider’s decision is not enough to establish legality.
