In the United States, owning a PSP game does not automatically make a download from an unofficial website legal. A redownload delivered through the account or service that authorized a digital purchase is a different situation from downloading a game image supplied by an unrelated website. Making your own operational or archival copy can also involve different rules, but U.S. Copyright Act §117 is limited and does not create a general “download anything I own” exception.
The answer can change with the way you acquired the game, who supplied the file, whether copy protection was bypassed, the applicable Sony license terms, and your country’s law. This is general information for U.S. readers, not a determination about a particular set of facts.

Start by identifying which kind of download you mean
“Downloading a PSP game I own” can describe three legally different actions. Treating all three as a single backup question is the source of most confusion.

The practical test is not simply “Do I own the game?” Ask who provided the file, what permission accompanied it, how the copy was made, whether an access control was bypassed, and which country’s law applies.

When an official redownload is the straightforward option
Sony’s PSP documentation describes downloading products available through PlayStation Store with a PlayStation Network account. It identifies Memory Stick media and the PSP’s system storage as possible destinations. That describes an account-based delivery process, not a promise that every old PSP game remains on sale or that every account can redownload every past purchase.
Check the entitlement before looking elsewhere
- Sign in with the PlayStation Network account that was used for the original digital purchase.
- Look in the account’s purchased-content or download area for the specific PSP title.
- Confirm the title, region, edition and device are supported by the current store or account interface.
- Read any current download or license notice before starting the transfer.
- If the PSP manual’s destination choices are available, insert compatible Memory Stick media first when you want the game saved there; otherwise use the system-storage option presented by the software.
If the entitlement appears and the service delivers the file, that is materially different from obtaining a ready-made image from a ROM site. If the entitlement is missing or the title is no longer offered, do not treat an unofficial download as legally equivalent merely because you paid for the game years ago. Store catalogs, account recovery rules and device support can change.
What U.S. Copyright Act §117 actually permits
Section 117 of the U.S. Copyright Act addresses copies of computer programs made by the owner of a copy. It permits an additional copy or adaptation when that copy is an essential step in using the program with a machine. It also permits a copy made solely for archival purposes, subject to conditions.

Operational copy
An operational copy is tied to using the program with a machine. The statute does not say that every file downloaded from the internet is an essential-step copy. A court would look at the specific program, the source of the copy, the method used and the purpose for which it was made. Do not turn the statute into the rule “I own it, so I can download it.”
Archival copy
An archival copy must be made solely for preservation and must be destroyed if your continued possession of the program ends. If you transfer an eligible copy made under §117, the statute limits that transfer: the exact copy must go with the original copy and all rights in the program. Selling or giving away a backup while keeping the original does not fit that condition.
Why a third-party file is different
Section 117 speaks about a copy made by or authorized by the owner of a copy under stated conditions. It does not expressly establish a general right to obtain a pre-made game image from an unrelated website. A third party may have copied and distributed the file without permission, and your possession of a UMD does not cure that separate act of distribution.

Whether creating a personal image from a UMD is permitted can depend on the facts and on other law. The statute does not answer every question about the tools used, technical protections, or distribution. For a high-value dispute, ask a lawyer who handles copyright and software licensing.

Copyright-copying rules and anti-circumvention rules are related but not identical. You might argue that a particular copy serves an archival purpose and still face a separate question about bypassing encryption, authentication or another technological access control.
In the United States, the current regulation at 37 C.F.R. §201.40 lists narrow video-game exemptions. The exemptions include defined circumstances such as certain games whose external server authentication has ended, for specified local-play purposes, and preservation activities by eligible libraries, archives and museums. They are not a blanket personal exemption that lets someone download an unauthorized game image because they own the disc.

The exact exemption language, qualifying purpose and eligible person or institution matter. A rule aimed at preserving a game in a museum collection should not be assumed to cover a personal download for ordinary play. Regulations and their interpretations can change, so check the current text when the distinction is important.
Sony’s license terms add contractual restrictions
Sony’s U.S. PlayStation terms describe PlayStation content as licensed on a limited, personal, private, non-transferable and non-commercial basis. The terms restrict reproduction and transfer except where the agreement or an express Sony permission allows them. They also prohibit bypassing or circumventing encryption, security, digital-rights-management or authentication mechanisms.

Even if you believe a particular copy might fall within a copyright exception, using an account or service can still be subject to the terms accepted for that service. Sony can revise its terms, so read the version that applies to your account and region.

How emulators fit into the analysis
PPSSPP’s documentation explains that PSP games were distributed on UMD and through PlayStation Store, and it separately describes free demos and homebrew games. The emulator is software; the game image is a separate item. PPSSPP’s ability to open a file you supply does not establish that the file was lawfully obtained.
Using an emulator with a demo, homebrew title, an authorized download or a copy whose creation and use are lawful is a different issue from downloading a copyrighted commercial game from an unauthorized source. Installing an emulator therefore does not resolve the copyright or anti-circumvention questions.
A practical decision process before you download
- Record how you acquired the game. Note whether it was a physical UMD, a digital purchase, a gift, a rental or another arrangement. A physical disc and a digital account entitlement are not interchangeable.
- Identify the supplier. An official account download has a different authorization trail from a file posted by an unknown site or person.
- Check the current account and regional store. Look for the title under the purchasing account and verify that the device and region are supported. Do not infer present availability from an old receipt or manual.
- Separate copying from circumvention. If making or using the copy requires bypassing encryption, authentication or DRM, analyze the anti-circumvention rule independently of §117.
- Apply the narrow §117 conditions. For an operational copy, ask whether it is an essential step in using the program. For an archival copy, ensure the purpose is solely preservation and understand the destruction and transfer conditions.
- Read the applicable Sony terms. Check the current U.S. terms, or the terms for your country, for reproduction, transfer and security restrictions.
- Check local law. If you live outside the United States, do not assume §117 or the U.S. exemptions apply. Copyright exceptions and anti-circumvention rules differ by jurisdiction.
- Keep evidence. Save purchase records, account screens and the source of any file. Documentation cannot legalize an unauthorized copy, but it helps distinguish an official entitlement from an unexplained download.
Common PSP scenarios

Storage media can solve a hardware problem, not a licensing problem
The PSP manual’s instructions make compatible Memory Stick media relevant when an authorized download needs storage. Depending on the PSP model and setup, a Memory Stick PRO Duo card or an appropriate adapter may be needed. Verify compatibility before buying; legacy hardware has model-specific limits.

What can happen if the source is unauthorized
Downloading from an unofficial site can expose you to more than a copyright dispute. The file may be altered, bundled with malware or mislabeled, and the site may collect account information. Sony can also enforce account or platform terms separately from any statutory claim. These practical risks are reasons to prefer an official account route and to avoid entering PlayStation credentials on sites that are not Sony services.
There is no universal answer for every country or every PSP title. The strongest general U.S. conclusion is narrow: an authorized redownload is not the same as a third-party ROM, §117 contains specific operational and archival permissions rather than a blanket download right, and bypassing technical protections requires a separate anti-circumvention analysis.
