Creating your own clone is different from using or licensing it
A private experiment with your own recordings raises different issues from publishing a clone, putting it in an advertisement, licensing it for a project, or using it instead of a paid performance. The official sources discussed here focus on specified unauthorized uses, commercial exploitation, public distribution, and contract conditions; they do not identify a general prohibition on a person creating a private clone of their own voice.

That is a limited U.S.-focused conclusion, not a guarantee that every recording, model, or use is lawful. The answer may depend on your state, the provider’s location, the source of the recordings, any agreements you have signed, and what you do with the generated voice. This is a set of state examples, not a complete survey of U.S. law.

State laws illustrate why the details matter
Tennessee: specified unauthorized voice uses
Tennessee’s ELVIS Act amendments provide civil liability for specified knowing unauthorized uses of an individual’s voice, publication or transmission of an unauthorized voice or likeness, and certain tools whose primary purpose is producing an identifiable person’s voice or likeness without authorization. The key distinction for self-cloning is that these provisions concern lack of authorization; they do not themselves establish that a person cannot authorize use of their own voice. New York: certain replica agreements tied to in-person work
New York General Obligations Law § 5-302 defines a digital replica as a digital simulation of a person’s voice or likeness so close that a layperson cannot readily distinguish it from the authentic voice or likeness. It addresses enforceability of some agreements when a replica is used instead of work the individual would otherwise have performed in person. Under the statute’s conditions, a provision may be void and unenforceable if its intended use is not reasonably specific and the individual was not represented by counsel or a qualifying labor organization. This is a rule for particular agreements, not every personal voice-cloning transaction. Read the New York statute.
Illinois: digital-voice protections and a contract amendment
Illinois has a Digital Voice and Likeness Protection Act addressing unauthorized replicas. Public Act 104-0282 amends certain agreement provisions for new performances fixed on or after January 1, 2026. Its precise requirements and applicability depend on the statute and the facts of the agreement; consult the Illinois public act and current code when assessing a specific situation.

Federal policy does not settle every question
The U.S. Copyright Office’s 2024 report on digital replicas recommended federal legislation and analyzed existing state approaches. It said, “Although there are reasonable arguments for each approach, the Office recommends against preempting state laws for several reasons.” That policy report is not a complete survey of current federal statutes. The Federal Trade Commission says existing consumer-protection laws apply to AI-enabled voice-cloning misuse and discusses fraud and biometric-data risks. Neither source, by itself, resolves every federal-law question about self-cloning. See the Copyright Office report and the FTC discussion of voice-cloning risks.

- Whether your recordings may be used to train or improve the service.
- How long recordings and voice models are retained, and whether you can request deletion.
- Who can access the samples or model, including whether sharing is enabled by default.
- What rights the provider claims over generated audio and which uses its license permits.
- Whether deletion of recordings also removes a trained model or copies already shared with others.
The FTC identifies misuse of biometric data as one risk associated with voice-cloning technology. The sources reviewed do not establish one uniform classification for every voice recording across all states, so do not assume that an app’s description of its data practices settles the legal question.

- Use: the projects, characters, products, or contexts covered.
- Duration: how long permission lasts and whether it renews.
- Compensation: what payment applies to creation, reuse, or later licensing.
- Replacement: whether a replica can stand in for work you would otherwise perform.
- Control: who can approve new uses and what happens when permission ends.
SAG-AFTRA describes consent and intended-use protections in certain covered member agreements. Those union protections do not automatically apply to nonmembers or every work arrangement; see SAG-AFTRA’s AI contract resources. New York’s statute and Illinois’s amendment also show why contract language can matter in specific professional settings.
When to get legal advice
For a personal experiment, start by limiting access to the clone and understanding the service’s data and license terms. If you plan to release the voice publicly, use it in advertising, sell or license access, or agree to a replica clause as a performer or worker, consult an attorney familiar with the relevant state law and contract. The state examples above are not a substitute for checking the law that applies to your circumstances.
