Usually, yes—but not simply because an app is called “open source.” You may independently recreate its functionality, or copy code under the exact license that covers it, provided you meet that license’s conditions. Copyright still protects source-code expression and other creative assets, while names, logos, data, fonts, and documentation may have separate rights. The safe path is to identify every component, determine what you are actually copying, preserve notices, satisfy source-code and copyleft duties, and clear branding before release. Because the result depends on the code, licenses, assets, distribution model, and country involved, a commercial launch with unresolved questions warrants advice from software-copyright counsel.
What “clone” means legally
“Clone” can describe several very different projects. A clean-room implementation reproduces behavior after studying publicly observable features, but uses newly written code and newly created expressive material. A fork copies upstream files and changes them. A new product may also reuse a library, icons, screenshots, text, fonts, datasets, or documentation without copying the application’s main code. Those facts matter more than the label attached to the project.

The U.S. Copyright Office draws the central boundary: copyright protects original expression embodied in a computer program, but not ideas, program logic, algorithms, systems, methods, concepts, or layouts. Its software FAQ similarly distinguishes protected software expression from unprotected facts, ideas, systems, and methods of operation. That means a feature list or general workflow can often be implemented independently, while copying distinctive source code, artwork, wording, icons, or other expressive material can infringe even when the resulting product has a different name.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThe boundary is fact-specific. Two implementations that perform the same task may be lawful independent works, or one may be substantially copied from the other. Similar screens can also raise questions about artwork, text, icons, and trade dress even when the underlying code is new. Do not treat a functional resemblance as proof of legality, and do not assume that changing variable names or rearranging files makes copied expression independent.

Open source is permission with conditions
“Open source” is not a waiver of copyright. An approved open-source license grants permissions to use, modify, and share software subject to its terms. The Open Source Definition requires permission for modified and derived works and access to source code in the preferred form for modification, but each license chooses its own conditions.
Start with the exact license
- Read the repository’s LICENSE file. Record the precise license name and version rather than relying on a project description or a badge.
- Inspect files individually. SPDX identifiers and copyright headers can reveal that a repository contains components under different licenses. Existing copyright notices should not be removed or altered.
- Inventory everything shipped. Include dependencies, generated code, build tools, assets, fonts, data, documentation, and hosted content, not just the main application files.
- Look for special terms. Check exceptions, linking provisions, patent clauses, attribution requirements, trademark policies, and source-distribution language.
- Keep a provenance record. Note the upstream commit, files copied, files rewritten, modifications made, and components that will reach users.
A project can therefore be lawful under one license and noncompliant under another, even when the code is identical. The license text, applicable version, and the way you combine components control the result.
Permissive licenses versus copyleft
Permissive licenses generally allow commercial reuse, modification, and proprietary additions when their notice, disclaimer, and other conditions are met. Copyleft licenses also allow modification and redistribution, but require covered derivative works to preserve specified freedoms. “Copyleft” is not one universal rule: GPL, LGPL, MPL, EPL, and AGPL differ in coverage, linking treatment, and source obligations.
| Project approach | What is copied | Typical downstream duties | Can additions remain proprietary? | Network-service issue |
|---|---|---|---|---|
| Clean-room implementation | Independently written code and newly created expressive assets | No upstream license duties for material that is genuinely independent; third-party components still carry their own terms | Generally possible, subject to components and other rights | Depends on the licenses of any components actually used |
| Fork under a permissive license | Upstream code under its stated permissive license | Retain copyright and license notices, include required license text, preserve disclaimers, and follow any NOTICE or attribution terms | Usually, if the license conditions and compatibility requirements are met | Ordinary hosting is not automatically a source-distribution event, but other licenses and architecture can change the analysis |
| Fork under GPL | GPL-covered code and modifications | Covered distributed versions must remain under GPL; provide the corresponding source and required notices with distributed binaries | Not for code that forms part of the covered derivative; separate components may require a different analysis | Merely allowing network interaction without transferring a copy is not conveying under GPLv3, but distribution to users triggers GPL duties |
| Fork under AGPL | AGPL-covered code and modifications | GPL-style copyleft and corresponding-source obligations, plus the AGPL’s network-service source offer when its conditions apply | Not for covered derivative code | Users who receive the program’s functionality over a network may be entitled to the source offer |
Commercial use is not the same as permission to ignore conditions. A company can sell a permissively licensed product while still violating the license by deleting notices, omitting a required license copy, or misusing a trademark.

What GPL distribution requires
GPLv3 defines propagation broadly to include copying, distribution with or without modification, and making a work available to the public. “Conveying” is propagation that enables another party to make or receive copies; mere network interaction without transfer of a copy is not conveying.
If you distribute a GPL-based clone as an installer, appliance, downloadable package, or binary supplied to customers, the source obligation is tied to the exact binary you shipped. The GNU FAQ explains that commercially distributed binaries must provide source as the GPL requires, and that the source must correspond to the distributed binary. Publishing only the unmodified upstream repository is not enough when your build contains changes.
Prepare a corresponding-source package
- Include the complete source for the GPL-covered work and your modifications.
- Include build scripts, configuration, and interface-definition material required to build and install the shipped version.
- Preserve the GPL text, copyright notices, and other required notices.
- Keep a reproducible record of the version, patches, dependency revisions, and build process that produced the binary.
- Use the source-delivery method and written offer language permitted by the applicable GPL version.
Do not promise source for code you do not have the right to provide, and do not ship a binary whose source package omits generated or interface material needed to recreate it when the license requires that material.

Can a GPL or AGPL clone be SaaS?
“We only host it” is not a universal exemption. The first question is whether users receive a copy. If customers download or otherwise receive the program, ordinary GPL distribution rules can apply. If users only send requests to a service and never receive a copy, GPLv3’s definition of conveying may not be triggered by that interaction alone.

AGPL adds a network-sensitive condition. Its terms can require an offer of corresponding source to users who receive the covered program’s functionality over a network. A hosted AGPL fork therefore needs a user-facing source mechanism designed for that obligation, not merely a private copy of the repository. Linking, plugins, and tightly integrated services can also affect whether code forms a covered work. Have counsel examine the deployment architecture when the service is commercial, distributed to customers, or assembled from components under different licenses.
Attribution, notices, and SPDX records
Attribution normally means preserving the original copyright and license information, not adding a vague “uses open source” sentence. SPDX identifiers communicate which license applies to a component, but they do not replace copyright notices; existing notices should remain intact.
For Apache-2.0 components, the official license text calls for including a copy of the license and addressing NOTICE information where applicable. Its boilerplate also preserves copyright, license, and disclaimer language. A practical attribution package should therefore contain:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- A component inventory mapping each dependency or copied file to its SPDX identifier, version, and copyright owner.
- Full license texts, or durable access to them where the license permits that approach.
- Original author and copyright notices, with your own notice added only for your original changes.
- Required NOTICE and attribution text, including Apache-2.0 material when applicable.
- Any source-code offer or corresponding-source information required by a copyleft license.
Place these materials where users can actually find them, such as a third-party notices screen, documentation page, or distribution directory that is shipped with the product. Keep the inventory synchronized with releases; an attribution file that covers version 1.0 may be inaccurate for version 2.0 after dependencies change.

Names, logos, screenshots, and data need separate clearance
Permission to copy code does not automatically grant permission to use the original app’s name or logo. Trademark rights can restrict confusingly similar branding even when the software license is permissive. Choose a distinct product name and visual identity unless you have separate permission.
Review every non-code item independently:
- Screenshots and artwork: may be protected expression or trademark presentation.
- Documentation and text: may have their own copyright license and attribution terms.
- Icons, fonts, and themes: often come from separate licenses with embedding or redistribution limits.
- Datasets and hosted content: can carry database, privacy, contractual, or terms-of-use restrictions.
- Logos and product names: require trademark clearance regardless of the code license.
Replacing a logo does not cure copied documentation or unlicensed fonts, and rewriting code does not grant rights to the original screenshots or data.
How much code can you copy?
There is no safe percentage or line-count rule. Copyright analysis turns on protected expression, the license, and the circumstances of copying—not on whether you copied less than a particular fraction of a repository. A small but distinctive function, UI illustration, or block of documentation can be protected, while a large amount of unoriginal configuration may present a different issue.

Best Value
Launch workflow for a compliant clone
- Freeze provenance. Save the exact upstream commit, release archive, LICENSE files, and per-file notices used for the build.
- Build the inventory. Record components, versions, SPDX identifiers, copyright owners, dependencies, generated code, assets, fonts, data, and documentation.
- Classify the implementation. Mark each part as independently written, copied under a license, generated, or supplied by a third party.
- Resolve compatibility. Check whether combined licenses permit your intended linking, packaging, modification, and distribution model.
- Prepare user materials. Assemble license texts, NOTICE information, attribution, disclaimers, and any corresponding-source offer before release.
- Test the shipped artifact. Verify that the source package, notices, and build information match the exact binary or container image users receive.
- Clear non-code rights. Approve the product name, logo, screenshots, documentation, datasets, fonts, and hosted content separately.
- Escalate unresolved issues. Obtain software-copyright advice for ownership disputes, patent concerns, trademark similarity, license incompatibility, or an AGPL/GPL architecture that will serve customers.
Common failure modes
Relying on a repository badge
A badge may be stale or cover only part of a mixed-license repository. Read the license files and headers for the specific version you use.
Publishing only upstream source
A modified GPL binary requires source corresponding to that binary. Include your patches, build material, and interface information rather than pointing users to an unchanged upstream project.
Assuming SaaS avoids every copyleft duty
Distribution, linking, and AGPL network provisions require separate analysis. Hosting alone does not answer those questions.
Keeping the original brand
Open-source code permission does not resolve trademark rights. Rebrand and replace protected assets unless you have independent permission.
Deleting notices during a rewrite
Independent code does not erase obligations for third-party components that remain in the product. Preserve the notices attached to those components.
Bottom line
You can usually clone an open-source app legally by either implementing its unprotected functionality independently or complying exactly with the licenses covering copied code. The decisive work is component-level: identify what was copied, preserve notices, meet permissive-license or copyleft conditions, provide corresponding source when distribution requires it, address AGPL network terms where applicable, and clear names and other assets separately. There is no universal “percentage of code” safe harbor, and the final answer remains dependent on the jurisdictions, versions, architecture, and evidence in your particular project.
