Can You Keep a Fossil You Find in Canada? Ownership and Permit Rules Explained

Sometimes—but there is no single Canada-wide rule. Whether you can keep a fossil depends on the province or territory, who manages the land, whether the site is protected, and whether the specimen is common or scientifically significant. Before moving it, identify the exact location and land manager and check the rules that apply there. The examples below explain British Columbia rules and Parks Canada visitor rules; they are not a survey of every Canadian jurisdiction.

Can you keep a fossil you find in Canada?

There is no reliable yes-or-no answer without knowing where the fossil was found. Access to land, permission to collect, ownership of a specimen, and permission to sell or move it across a border are distinct questions. A label such as “public land” or “Crown land” does not, by itself, mean fossil collecting is allowed.

First identify the precise parcel and its administrator. Then check the applicable provincial, territorial, federal, park, or protected-area rules. Also distinguish picking up a loose surface fossil from digging or otherwise disturbing the ground: a rule allowing limited surface collection does not automatically authorize excavation.

What applies in British Columbia?

Limited recreational surface collection

British Columbia allows recreational collection of small amounts of common fossils from the land surface, using hand tools, subject to access, safety, land-use, and other legal restrictions. The Province describes common fossils as types that are not scientifically significant and are abundant enough that taking a few would not deplete the site. Check the Province’s collection and use guidance, last updated May 1, 2026, before collecting.

This is a narrow allowance, not a general collecting right on Crown land. The Province warns that resource authorizations may make an area unsafe or incompatible with collecting, and recreational access guidance does not override other legislation. B.C. says common fossils collected recreationally may be kept for personal use only; they must not be sold or removed from British Columbia.

Significant or uncertain finds

Do not collect significant fossils, including vertebrate fossils. Leave unusual, rare, or scientifically important specimens where they are. The Province asks people to report sites with vertebrate fossils or trackways, exceptionally preserved or diverse fossils, and important new fossil sites. For an unusual or rare find—or a site with only a small quantity—contact the Royal BC Museum, a local museum, or the B.C. Fossil Management Office, as directed in the provincial guidance.

Why “Crown land” is not enough

In B.C., fossils on Crown land are generally administered under the Land Act unless another government portfolio administers the land. B.C. explains that its 2005 Mineral Definition Modification Regulation excluded fossils from the Mineral Tenure Act definition of “mineral,” while preserving earlier titles and leaving limestone, dolomite, coal, petroleum, and natural gas outside the fossil definition. Land administered under parks or other statutes has separate requirements. See the Province’s fossil management overview, last updated May 1, 2026.

Can you take a fossil from a national park?

No—not as a visitor in a Parks Canada-administered national park or national historic site. Parks Canada says collecting fossils and other natural or historic objects is illegal there. If you find a fossil, leave it in place and report it to park staff. The rule is stated in Parks Canada’s visitor guidance.

Some areas also have specific access restrictions. For example, a Parks Canada bulletin issued June 5, 2024, says the Mount Stephen fossil beds and surrounding area in Yoho National Park are closed unless visitors are accompanied by an authorized Burgess Shale guide. The bulletin states a maximum penalty of $100,000 and remains in effect until further notice. Check the current park bulletin before visiting because closures and access conditions can change.

Do you need a permit to collect fossils?

Recreational collecting

There is no Canada-wide permit answer. In B.C., the limited recreational allowance for common fossils applies only within its stated conditions; it does not authorize collecting in protected areas or on land governed by other rules. In Parks Canada-administered places, visitors may not collect fossils. Check with the actual land manager before moving a specimen, and do not assume that a permit for one purpose or place applies elsewhere.

Scientific research in Parks Canada places

Parks Canada has a separate research and collection permit process for activities otherwise prohibited at its administered locations. A permit authorizes only the approved project, site, period, objects, and conditions; it is not a general recreational collecting licence. The Parks Canada research and collection permit guide, modified November 14, 2023, says fossil finds or evidence of past human occupation must be reported immediately to the Superintendent and left undisturbed until inspected by a Parks Canada paleontologist or archaeologist.

A research permit does not transfer ownership to the researcher. Parks Canada says natural objects collected under permit remain Crown property and are on loan to the permit holder, subject to the permit terms and final disposition.

Scientific research in British Columbia

Research collection in B.C. follows an approval route distinct from recreational surface collection. The Province’s scientific research collection guidance, last updated March 21, 2025, says fossils collected for research must be returned to a recognized B.C. fossil repository after study, and prior approval is required under the applicable route.

What to do when you find a fossil

  1. Stop before moving it. Do not dig, pry, or remove an uncertain specimen. Protected-site and significant-fossil rules can prohibit collection even when an object appears loose.
  2. Record the location without disturbing the find. Note the park, road, trail, or other location details and take a photograph from where you are, if safe and allowed.
  3. Identify the land manager. Determine whether the site is private, provincial or territorial Crown land, federal land, or protected land, and contact that administrator or landholder.
  4. Report important or uncertain finds. In a Parks Canada place, tell park staff. In B.C., follow the Province’s reporting guidance or contact the Royal BC Museum, a local museum, or the B.C. Fossil Management Office for unusual or rare finds.
  5. Confirm the applicable rules before collecting. Ask specifically about surface pickup versus excavation, specimen significance, personal use, and any restrictions on sale or removal from the jurisdiction.

What if the fossil was found on private land or outside B.C.?

Do not apply B.C.’s limited recreational allowance to another province, territory, or a private property. The answer depends on local law, the landholder’s permission, and whether the precise location has protected status or other special rules. Ask the relevant provincial or territorial authority and the landholder before collecting; permission to enter private land is not automatically permission to remove a fossil.
