In the United States, the risk depends on what the image depicts, whether someone is identifiable, consent, what the sharer knew or intended, the harm caused, and the law that applies. A qualifying nonconsensual intimate deepfake, a defamatory or privacy-invasive image, or an image used to commit fraud can create legal exposure. This is a general U.S. overview, not legal advice; state laws differ.
When can sharing a fake image create legal trouble?
“Fake image” is not one legal category. An obviously satirical edit, a realistic image falsely depicting a person in a damaging situation, an intimate deepfake, and a forged financial document raise different questions. Falsity alone does not settle whether sharing is unlawful.

For a particular image, the most useful starting questions are:

- What does it depict? Consider whether it is an ordinary edit, an intimate image, an impersonation, or something used to deceive someone in a transaction.
- Can a person be identified? The federal intimate-image provisions distinguish rules for adults and minors.
- Was publication authorized? Agreeing to have an image made, or sending it privately, does not necessarily mean agreeing to have it published to others.
- What did the sharer know or intend? Relevant laws can turn on knowledge, intent to cause harm, or disregard of a person’s lack of consent.
- Where did it happen, and in what context? State rules and speech protections vary, and some federal intimate-image provisions have specific public-concern conditions.
What does federal law say about intimate deepfakes?
The TAKE IT DOWN Act, enacted May 19, 2025, added criminal provisions to 47 U.S.C. § 223 and a platform notice-and-removal process at 47 U.S.C. § 223a. It covers specified nonconsensual intimate depictions, including certain digital forgeries—not every AI-generated or edited picture.

The Act defines a digital forgery as an intimate depiction of an identifiable person made or altered with technology so that, viewed as a whole by a reasonable person, it is indistinguishable from an authentic depiction. The statute sets out different elements for adult authentic depictions, adult digital forgeries, and depictions involving minors.

These are summaries, not a complete statement of the statute. It includes exceptions, and the applicable elements must be assessed against the facts. Under 47 U.S.C. § 223, penalties differ by offense: specified adult offenses can carry up to two years, while specified offenses involving minors can carry up to three years.

Can someone sue over a fake or AI-generated picture?
Possibly. Federal criminal liability and a civil lawsuit are separate questions. Under 15 U.S.C. § 6851, DOJ describes a federal civil action for sharing an intimate image without consent when the defendant knew the person did not consent or recklessly disregarded that fact. A court may order the sharing to stop and, in applicable circumstances, award damages of up to $150,000, plus attorney’s fees and court costs. The law has limited exceptions.

For a nonsexual fake image, state law may provide a claim if it falsely portrays an identifiable person in a damaging way or invades their privacy. Defamation, false light, privacy, and likeness claims vary by state and depend on the details, including applicable speech protections. The U.S. Copyright Office’s 2024 digital-replicas report discussed gaps in existing protections and recommended a new federal law against knowing distribution of unauthorized digital replicas. That was a policy recommendation, not a rule making every unauthorized replica unlawful.

Does forwarding an image count, or only making it?
The federal provisions discussed here address publication or sharing as well as the underlying depiction. Someone who did not create an image should not assume that forwarding it is legally risk-free. Consent to creation or private delivery is not necessarily consent to wider publication, and the relevant federal civil remedy focuses on whether the person who shared the image knew of, or recklessly disregarded, the lack of consent.
Whether a specific forward meets a statute’s elements depends on the image, the sharer’s knowledge and conduct, and the circumstances. The TAKE IT DOWN Act’s criminal rules have their own requirements; they do not make every repost of every fake image a crime.

What should someone do if an intimate image is shared without consent?
- Preserve relevant evidence. Keep available records of the post and related communications. Avoid spreading the image further while documenting the issue.
- Use the platform’s designated reporting process. Under 47 U.S.C. § 223a, covered platforms must provide a process for an identifiable person or authorized representative to request removal of a nonconsensual intimate depiction.
- Submit a valid removal request. FTC guidance says covered platforms must remove qualifying material and known identical copies within 48 hours after a valid request. The FTC enforces compliance; eligibility depends on whether the material meets the law’s definition.
- Seek legal or support assistance. DOJ’s Office on Violence Against Women lists support resources and attorney assistance for image-based sexual abuse. A lawyer in the relevant jurisdiction can assess civil and criminal options.
What about political images, satire, or images used for fraud?
Political and election-related images
The FBI has said synthetic content may generally be protected speech, while noting it may investigate when reported facts indicate potential federal criminal violations. Election laws also vary by state. The available federal guidance does not establish that every political deepfake is illegal nationwide; concerns about a possible state or local election-law violation should be directed to local law enforcement.

Context matters. A clearly satirical image is not automatically treated like a realistic false depiction intended to harm someone. Whether a particular post creates exposure still depends on the applicable law, the content, and the surrounding circumstances.

Images used to deceive someone
A fake picture used as part of a scheme to obtain money or otherwise defraud someone raises a different issue from merely sharing an obviously satirical image. Federal counterfeiting laws, for example, prohibit specified fraudulent making or passing of U.S. obligations or securities; they are not a general ban on sharing false pictures.

How to assess a specific image before sharing it
- Check whether it is intimate. If it depicts an identifiable person in an intimate context, do not share it unless you have a sound basis to believe publication is authorized.
- Separate permission to create from permission to publish. A private message or agreement to be photographed does not by itself establish consent to public distribution.
- Ask whether the person could be identified and harmed. A realistic fake that attributes damaging conduct to someone can raise state-law issues even when it is not an intimate image.
- Consider your purpose and what you know. Intent, knowledge, and harm are relevant under some of the federal provisions and may matter under state law.
- Check jurisdiction-specific rules. Defamation, privacy, election, and likeness laws are not uniform across the United States. If there is a real dispute, consult a lawyer licensed in the relevant state.
