Usually, a brewery closing does not automatically create a right to a cash refund. Your realistic options depend on what you prepaid, the contract, your state’s law, whether the closure is temporary or part of a bankruptcy, and how you paid. A credit-card purchase for goods or services that were not delivered as agreed may qualify for a Fair Credit Billing Act billing dispute, but written notice generally must reach the card issuer within 60 days after the first statement showing the error.
Gift cards, prepaid beer-club memberships, event deposits and advance orders are legally different. Treat each as a separate claim, preserve your records, and act before a card-dispute or bankruptcy deadline passes.

First determine what “closed” means
A taproom being dark for a week is not the same as a company dissolving or filing bankruptcy. Check the brewery’s own notice, social-media accounts, landlord or successor announcements, and the bankruptcy court docket if a filing has been reported. A temporary shutdown may still leave a valid business able to deliver your order or honor a card later. A permanent closure may leave only a claim against the business or its bankruptcy estate.

Temporary closure or ownership change
Ask in writing whether the brewery will reopen, transfer obligations to a buyer, move production, or designate another location for redemption. Do not assume a purchaser must honor old gift cards, club benefits or deposits unless it expressly agrees to do so. Save the response, including any promised reopening or transfer date.

Bankruptcy or liquidation
Bankruptcy turns ordinary collection into a court-supervised process. You may need to file a proof of claim by a deadline set in the case. The amount you list should be supported by your receipt, contract, card statement and proof that the promised beer, event, merchandise or other service was not delivered. A claim can be valid yet recover little or nothing if the estate has few assets or higher-priority creditors.
Match the remedy to the prepaid item
| What you paid for | What you can request | Key evidence | Main limitation |
|---|---|---|---|
| Gift card or certificate | Redemption by the brewery or an expressly accepting successor; a card-payment dispute; a bankruptcy claim; a state consumer complaint | Card number, purchase receipt, balance and closure notice | Federal term limits do not make a closed brewery solvent or guarantee cash |
| Prepaid membership or beer club | Cancellation and a refund for undelivered benefits under the agreement; a credit-card billing dispute for services not delivered as agreed | Membership terms, renewal record, benefit schedule and delivery history | No nationwide rule guarantees a full prorated refund |
| Event, catering, keg, merchandise, tour or special-release deposit | Written demand for the unearned deposit; card dispute; bankruptcy claim; state complaint | Signed contract, invoice, payment proof, event date and cancellation or closure notice | Priority in bankruptcy is limited and repayment is not assured |
| Cash, check, debit card or bank transfer | Contract demand, state-law remedies, bank-specific dispute process and possibly a bankruptcy claim | Receipt, transfer confirmation and non-delivery proof | Credit-card billing-error protections and deadlines do not automatically apply |
Gift cards: federal protections are not a refund guarantee
Federal gift-card rules generally cover retail gift cards and bank gift cards. Under 15 U.S.C. §1693l-1, an expiration date generally cannot be earlier than five years after issuance or the last load. Dormancy or inactivity fees require inactivity, clear disclosures and timing limits. Those rules regulate the card’s terms while the issuer is operating; they do not require a closed brewery, an insolvent owner or a bankruptcy estate to redeem the balance or pay cash.
What to do with an unused card
- Confirm the remaining balance and save a photograph or scan of both sides of the card.
- Send the brewery a dated written request asking whether it will redeem the card, transfer it to a successor or refund the balance. Keep the delivery confirmation and any reply.
- Search for a bankruptcy case and calendar the proof-of-claim deadline. Follow the court’s instructions rather than sending documents only to the former taproom.
- If you bought the card by credit card, ask the issuer whether the original transaction can be disputed because the promised redemption is unavailable. Give the issuer the transaction date, amount and evidence of closure or refusal.
- File a complaint with your state attorney general or consumer-protection office when the business is unresponsive. A complaint can create regulatory pressure but does not guarantee payment.
In the 2025 Iron Hill closure, Pennsylvania’s attorney general advised customers to dispute unused gift-card purchases with their card companies and file a consumer-protection complaint. Reporting about that case also described gift-card holders in bankruptcy as unsecured creditors. That example illustrates the risk; it is not a promise that every card dispute will succeed.

Prepaid memberships and beer clubs
A membership is generally a contract for future benefits rather than a gift-card balance. Benefits may include monthly beer allocations, a mug, discounts, event access or merchandise. Find the agreement you accepted and check its term, automatic-renewal language, cancellation method, substitution rights, delivery schedule and refund clause.
If benefits stop before the term ends
- List each benefit you paid for and mark what was delivered, partially delivered or never provided.
- Send a written cancellation and refund request. State the date benefits stopped, identify the unused period and request the amount attributable to undelivered benefits under the agreement.
- Attach the membership terms, payment record and delivery history. Keep a copy and proof of delivery.
- For a credit-card payment, send a separate billing-error notice to the issuer if the charge represents services not delivered as agreed. The federal notice window is generally 60 days after the first statement containing the charge.
There is no nationwide rule identified here that promises a full prorated membership refund. Your contract and applicable state law control the calculation, and a card issuer can reject a dispute if the documentation does not show nonperformance or if the notice is late.
Deposits and advance orders
Deposits for a private event, catering, keg, merchandise, tour or special-release beer are advance payments for a specific future performance. If the brewery closes before performing, write to the legal business address and any announced owner, successor or trustee. Demand the unearned amount and attach the contract, invoice, payment proof, event or delivery date and closure notice. Say exactly what was not supplied and provide a deadline for a written response.

North Carolina’s Department of Justice warns that business closures can leave customers with lost deposits and unfilled orders. It recommends paying the smallest practical deposit and contacting the card issuer promptly about a chargeback when a business closes. That is practical guidance, not a guarantee that a bank will reverse the transaction.

Separate delivered value from the missing performance. For example, if a brewery provided catering but cancelled the room rental, document the price allocated to each component and request only the unperformed portion unless the contract provides another remedy. Avoid inflating the claim; a precise calculation is easier for a card issuer, regulator or bankruptcy trustee to evaluate.
Credit-card disputes and chargebacks
The Fair Credit Billing Act covers a credit-card charge for goods or services that were not delivered as agreed. CFPB Regulation Z likewise treats a charge for property or services not accepted or not delivered as agreed as a billing error. These rules apply to credit cards and revolving credit, not automatically to cash, checks, debit cards or bank transfers.

Use the federal notice procedure
- Identify the statement that first showed the disputed charge and count 60 days from the date that statement was sent.
- Send written notice to the billing-dispute address specified on the card statement, not merely to a customer-service email or telephone number.
- Include your name and account information, the transaction date and amount, and a clear explanation that the brewery closed or failed to deliver the described goods or services.
- Enclose copies, not originals, of the receipt, contract, membership terms, closure announcement, cancellation request and proof of non-delivery.
- Keep the letter, enclosures and proof of delivery. Continue following the issuer’s instructions while it reviews the claim.
The 60-day period concerns the written billing-error notice; do not wait for a promised reopening if the deadline is approaching. A chargeback is a payment remedy, not a ruling that the brewery owes money. The issuer may ask for additional records, and success is not assured.
If the brewery has filed bankruptcy
CFPB’s official interpretation of Regulation Z says that when the merchant is in bankruptcy, a consumer may assert the qualifying claim directly with the card issuer and does not have to file a bankruptcy claim for that card dispute. That does not eliminate the issuer’s normal requirements or the need to send timely written notice. If you also pursue a separate unpaid balance, follow the bankruptcy court’s claim procedure for that amount.

Gift-card holders are commonly unsecured creditors. They share in whatever remains after secured claims and higher-priority expenses, so a valid claim may produce only a small distribution or none. Keep the claim amount limited to the balance or undelivered value you can document.

Under 11 U.S.C. §507(a)(7), certain consumer deposits for undelivered goods or services can receive limited priority. The California attorney general has described a $3,025 priority cap in its consumer-bankruptcy guidance and cautioned that priority does not guarantee full repayment when a business closes permanently. The applicable cap and eligibility should be checked against the law and case documents in effect for your bankruptcy case.
“Bankruptcy does not grant debtor companies blanket freedom from their commitments and obligations to their customers and creditors.” — California Attorney General Xavier Becerra
Finding the case and filing deadline
Look for the brewery’s exact legal name, not only its taproom name, in the federal bankruptcy court docket. Read the court notice for the case number, claims agent, claim form and bar date. Submit the form with supporting records and retain the confirmation. If no case appears, continue documenting your demand and monitor official notices; do not assume that a social-media closure announcement itself is a bankruptcy filing.

State complaints and other avenues
Your state attorney general, consumer-protection office or equivalent agency may accept a complaint about an unredeemed card, failed membership or lost deposit. Include a concise timeline and copies of your records. The agency can contact the business, identify a successor or publish case-specific instructions, but it cannot promise a refund or replace a court claim.
State contract, gift-card and automatic-renewal laws vary. The state where the transaction occurred, the brewery’s contract and sometimes the consumer’s residence can affect which rules apply. A local consumer-law attorney or legal-aid office can explain those choices when the amount is substantial.
Quick Recap
A practical action plan
- Classify the payment: write down whether it was a gift card, membership, event or merchandise deposit, or an undelivered order.
- Assemble proof: save receipts, card numbers, statements, agreements, invoices, emails, closure notices and delivery records in one folder.
- Ask for a solution: contact the brewery, successor or trustee in writing about redemption, transfer or refund.
- Protect the card deadline: if a credit card paid for goods or services not delivered as agreed, send the written billing-error notice within 60 days of the first statement showing the charge.
- Check for bankruptcy: search the court docket and calendar the proof-of-claim deadline if a case exists.
- Escalate appropriately: file a state consumer complaint and seek legal advice when the amount or contract warrants it.
- Keep expectations realistic: no available national statistic establishes what percentage of brewery cards or deposits are recovered after closure, and no remedy guarantees payment.
Common mistakes that reduce your options
- Waiting for an indefinite reopening and missing the 60-day credit-card notice period.
- Assuming the federal five-year gift-card rule creates a cash-refund entitlement.
- Sending a dispute without the contract, receipt or proof that the promised item was not delivered.
- Treating a membership’s unused service period as though it were a gift-card balance.
- Assuming another brewery or a buyer must honor the old business’s cards, rewards or club benefits.
- Filing a bankruptcy claim without checking the legal entity, claim form and deadline.
