Can you change jobs, work remotely, or start a business on an H-1B visa?

Yes, but none of these actions is automatic. Changing employers generally requires the new employer to file a Labor Condition Application (LCA) and Form I-129 petition. Some people already maintaining valid H-1B status may use portability to begin the new job after a qualifying filing, before approval. Remote work depends on the actual address where duties are performed and whether the employer’s petition and LCA support that location. You may own a controlling interest in a company that petitions for you, but ownership by itself does not authorize you to work for that company.

These rules are fact-specific U.S. immigration requirements, not individualized legal advice. Have the worker and employer’s immigration counsel review the filing, status, worksite and ownership facts before any job change, move or business activity begins.

Can I change jobs on an H-1B?

Usually, a new employer must file its own H-1B case. The process generally includes a new LCA and a Form I-129 petition describing the offered employment. Your existing approval is tied to the petitioning employer and the approved employment, so accepting a different position is not the same as transferring a résumé from one company to another.

How H-1B portability can change the timing

USCIS materials describe portability for certain workers who are already in valid H-1B status. If the new employer files a qualifying petition, an eligible worker may be able to start the new job when the petition is properly filed rather than waiting for an approval notice. This is conditional, not a blanket right for every H-1B holder or every filing.

Eligibility can depend on maintaining status and on the new petition meeting the applicable requirements. A defective filing, a status problem or a mismatch between the worker and the offered employment can affect whether beginning work is protected. Do not treat a receipt notice or a general statement that “H-1B transfers are portable” as a substitute for a case-specific review.

A safer job-change sequence

  1. Confirm your current position. Review your latest approval notice, I-94 record, passport and recent pay records. Note the petition validity dates and the employer named in the approval.
  2. Give the new employer the complete facts. Disclose prior immigration filings, any gaps in employment, changes in status and the location where you will actually work.
  3. Have the new employer prepare the LCA and Form I-129. The petition should describe the offered role, worksite and requested validity period accurately.
  4. Confirm the filing date and eligibility to start. Ask counsel whether the filing qualifies for portability in your circumstances and what evidence must be retained. Do not rely on an informal promise that the case will be approved.
  5. Keep the filing record. Preserve the receipt, the filed forms, the LCA information, employment offer and pay records. These documents help show what was filed if questions arise later.

If you are not eligible for portability, the new employer may need to wait for approval before employment begins. The fact that a company has offered you a job does not itself authorize work.

Can I work for two employers?

USCIS reference materials state that an H-1B worker may work for more than one employer when each employer files its own LCA and petition. That framework can matter for a second job, a consulting arrangement or employment connected with a separate venture. Each proposed role still has to qualify, and the two employers’ filings must accurately describe the duties, locations and schedule. A side project is not automatically covered by the petition for your main job.

Can I work remotely on an H-1B?

Remote work is a worksite question, not a simple feature of the visa label. The relevant facts include the physical address where you perform the duties, the geographic area associated with that worksite, what the employer reported in the petition and LCA, and whether the arrangement changes after approval.

Why the actual address matters

USCIS Form I-129 instructions address off-site assignments and direct petitioners to answer questions about those assignments and advise the beneficiary about the placement. USCIS administrative decisions also analyze the place where work is actually performed and whether the LCA supports that location. A home office, another city or another state can therefore raise different issues from occasional travel to a customer site.

The available authorities do not establish that every home-work arrangement is automatically covered by an existing filing, nor do they establish that every home address always requires an amended petition. The answer depends on the location and facts of the particular employment, as well as current Department of Labor requirements.

Before working from home or moving

  1. Write down the exact work address. Include the street address, city, state and expected start date. “Remote in the United States” is not precise enough for an immigration review.
  2. Describe the expected duration. Tell the employer whether the arrangement is occasional, open-ended or connected to a planned relocation.
  3. Ask whether the address is already covered. The immigration team should compare it with the worksite and geographic area listed in the petition and LCA.
  4. Ask what employer action is required. Depending on the facts, the employer may need additional notice, an LCA step or a petition filing. Do not choose among those options yourself.
  5. Wait for written instructions. Keep the employer’s analysis and any notice or filing confirmation before beginning the new arrangement.

Common remote-work scenarios

Scenario What to check Why it matters
Working from the approved office Whether duties and address still match the petition and LCA No location change may have occurred, but the employer should still confirm the facts.
Working from a home in the same area Exact home address, actual duties and existing LCA coverage Geographic similarity does not by itself prove that the home is covered.
Moving to another city or state New address, geographic area, move date and duration The move can change the worksite analysis and may require employer action.
Regular customer-site work Off-site assignment details and the location where work is performed Form I-129 instructions specifically address off-site assignments.

Historical USCIS decisions are useful illustrations of worksite analysis, but they are not a substitute for current Department of Labor guidance. The exact notice, wage and LCA obligations for a particular home address or relocation should be confirmed before the move.

Can I start or own a business while on an H-1B?

USCIS modernization materials recognize a beneficiary-owner structure: a U.S. company can petition for a beneficiary who has a controlling interest, subject to the applicable regulatory parameters. USCIS Form I-129 instructions define a controlling interest as more than 50 percent ownership or majority voting rights.

Ownership and work authorization are different

You can hold an ownership interest without being authorized to perform services for that company. The company must qualify as the H-1B petitioner, offer a qualifying position and document the employment arrangement in a petition. Incorporating a company, investing money, serving as an owner or receiving an ownership interest does not, by itself, give permission to run the business, provide services, sign contracts as an employee or perform the duties described in the proposed role.

The petition must establish a bona fide position and satisfy the requirements that apply to the proposed H-1B employment. USCIS’s small-entity guide on the H-1B modernization final rule describes parameters and evidence considerations for beneficiary-owner petitions. The company’s corporate structure and the beneficiary’s voting and ownership rights should therefore be reviewed together with the job duties and the employer’s ability to file.

Validity limits for a controlling owner

Under the Form I-129 instructions edition dated January 17, 2025, when the beneficiary has a controlling interest, USCIS states that an approved petition may be limited to a validity period of up to 18 months. The instructions also state that the first extension may be limited to up to 18 months. Those limits are different from assuming that an owner automatically receives the longest period available in an ordinary H-1B case.

Because the ownership percentage, voting rights, proposed role and petition structure all affect the analysis, get advice before incorporating for the purpose of employment, taking an operating role or having the company file. Do not begin working for the company while waiting to see whether a petition will be approved.

Compare the three situations before you act

Situation Facts to verify Practical conclusion
New employer Current H-1B status, new employer’s LCA and petition, filing date and portability eligibility A change may be possible, but starting before approval is conditional.
Remote work or relocation Exact address, actual duties, existing LCA, employer notice and any filing analysis Never assume that every remote location is covered; have the employer review it first.
Own or start a business Ownership percentage, voting rights, petitioner structure, proposed position and supporting evidence Beneficiary ownership is contemplated, but ownership alone does not authorize work.

Questions to answer with your immigration team

  • What is my current status, and is my existing H-1B employment still valid?
  • Has the new employer prepared and filed the required LCA and Form I-129?
  • If I want to start before approval, do I specifically qualify for portability?
  • Where will I physically perform the work on each day of the arrangement?
  • Does the current petition and LCA cover that address and geographic area?
  • Is the proposed business the actual petitioner, and does it document a bona fide qualifying position?
  • Do my ownership percentage or voting rights create a controlling interest under the Form I-129 definition?
  • Could the beneficiary-owner validity limits apply to the initial approval or first extension?

What the current source materials do—and do not—settle

The Form I-129 instructions cited here are the January 17, 2025 edition. USCIS’s small-entity guide is dated December 19, 2024 and discusses the H-1B modernization final rule. USCIS employer-change reference materials published approximately in 2024 describe portability and multiple-employer principles. Historical USCIS administrative decisions discuss worksites, but they do not replace current Department of Labor instructions.

No single rule in these materials answers every home-office, relocation, wage or notice question. Those duties can turn on the actual address, the employer’s LCA and the timing of the change. The practical rule is to disclose the complete facts before acting, obtain the employer’s written immigration analysis and keep working only within the employment that is authorized by a qualifying petition.
