Can You Change Jobs on an H-1B Visa? Transfers, Timelines, and Common Questions

Yes, many H-1B workers can change employers through H-1B portability. The prospective employer must file a new H-1B petition, generally after obtaining a labor condition application (LCA). A worker who meets the portability requirements may usually begin the new job after that petition is properly filed instead of waiting for USCIS approval.

That filing-based start rule is conditional, not automatic. Lawful admission, the period of authorized stay, filing timing, and the worker’s employment history all matter. The new employer, not the employee, drives the petition, and the correct filing basis depends on whether this is a new employer, a second concurrent employer, or a material change with the current employer.

What an H-1B “transfer” actually is

“H-1B transfer” is common shorthand for a new-employer H-1B petition. USCIS identifies “Change of employer” as the Form I-129 basis when the beneficiary will work for a different employer in the same nonimmigrant classification. It is not a transfer of an existing approval from one company to another; the new employer must complete its own filing.

The process is employer-petition driven. The employer normally obtains an LCA from the Department of Labor and then submits Form I-129 to USCIS with the change-of-employer basis and supporting evidence. The petition must describe the offered position, work location, wage and other terms required for H-1B classification.

What the employee does

The worker supplies immigration and employment records, confirms that the proposed role qualifies for H-1B classification, and coordinates a start date that follows the portability rules. The employee does not file the change-of-employer petition personally. A worker may, however, have to provide copies of prior approval notices, passport and admission records, recent pay statements, and evidence of ongoing status so the employer can document eligibility.

When H-1B portability can let you start before approval

USCIS describes portability as a conditional benefit. A qualifying worker may generally begin employment with the new employer once the new petition is filed, but filing alone does not authorize every H-1B worker to start immediately.

Core conditions identified by USCIS

Condition Why it matters
Lawful admission in H-1B status or another qualifying basis The portability rule is tied to the worker’s lawful admission and existing nonimmigrant status.
A nonfrivolous petition filed before the end of the authorized-stay period The filing must be timely. USCIS’s employer-guide wording includes: “The nonfrivolous petition for new employment was filed before the end of their period of authorized stay.”
No unauthorized employment since admission Unapproved or otherwise unauthorized work can affect whether the worker qualifies to use portability.
A petition that properly requests the new employment The employer must submit the required LCA and Form I-129 materials under the correct filing basis.

These requirements are evaluated against the individual record. Someone with a status violation, an unexplained gap in employment, a late filing, or uncertain admission history should not assume that a new filing cures the problem.

How the filing-based start rule works

  1. The new employer prepares the case. It obtains the required LCA and gathers the evidence for Form I-129.
  2. The employer files the petition. The filing must be received while the worker remains within the relevant authorized-stay period and must be nonfrivolous.
  3. The worker checks portability eligibility. Lawful admission, employment history and prior status compliance should be reviewed before setting a start date.
  4. If the conditions are met, work may generally begin after filing. The employee should keep proof of the filing and follow the position, location and wage terms described in the petition.
  5. USCIS continues adjudication. An approval, request for evidence, denial or other action can change the case’s next steps, so the employer and worker should monitor the receipt and notices.

The general rule is not a guarantee of approval. Beginning work under portability while the petition is pending carries risk if USCIS later finds that a requirement was not met or that the petition was not approvable as filed.

What the new employer must file

USCIS materials describe an LCA followed by a new H-1B petition. The LCA addresses the employer’s labor-condition attestations for the offered employment. Form I-129 then requests H-1B classification for the new employer and identifies the filing basis as “Change of employer” when the facts fit that category.

Evidence usually tied to the petition

  • The worker’s passport, admission record and current or most recent H-1B approval notice.
  • Evidence of the worker’s current status and authorized-stay end date.
  • The employer’s offer letter or employment agreement and a detailed description of duties.
  • Information about the worksite, wage and requested validity period.
  • The certified LCA and supporting evidence that the role qualifies for H-1B classification.
  • Recent pay records or other evidence of maintaining status when the worker is already in H-1B employment.

The exact evidence list varies with the case. An employer’s petition preparation should match the facts rather than rely on a generic “transfer” checklist.

How a change of employer differs from other H-1B filings

Not every employment change is a transfer. USCIS distinguishes the change-of-employer basis from an amended petition that reports a material change in employment terms or conditions for the same employer. A different worksite, duties, wage arrangement or other significant change may require an amended filing even when the employer has not changed.

Situation Typical filing concept Key question
Move to a different company New Form I-129, “Change of employer” Has the new employer completed the LCA and petition before the worker’s authorized stay ends?
Work for an additional company while retaining the first job Concurrent H-1B petition by the second employer Has each employer completed its own required filing process?
Major change with the same company Amended H-1B petition Do the new duties, location or conditions materially differ from the approved petition?
Different immigration classification or another petition purpose Applicable Form I-129 basis other than change of employer Does the requested classification and filing basis match the worker’s actual situation?

The employer should select the basis that matches the facts. Calling every case a “transfer” can obscure an amended-petition requirement or a separate concurrent-employment filing.

How long does an H-1B transfer take?

There is no single reliable duration for every H-1B change-of-employer case. USCIS processing estimates vary by form category and the office handling the case, and they can change over time. A current estimate should be checked in USCIS’s processing-time tool for the relevant Form I-129 category and service location.

Historical USCIS medians for context

Filing type Historical national median Qualification
Premium-filed Form I-129 petitions 0.6 months USCIS FY 2026 historical national median through August 30, 2026; not a transfer-specific promise or deadline.
Non-premium-filed Form I-129 petitions 5.1 months USCIS FY 2026 historical national median through August 30, 2026; not a case-specific estimate.

Those figures cover USCIS’s historical Form I-129 categories, not an individualized H-1B transfer study. They do not tell you when a particular petition will be decided, whether an evidence request will be issued, or when the worker can start. Premium processing and ordinary processing are also different service options; the historical medians do not establish a current premium-processing deadline.

Planning around the timeline

  • Allow time for the employer to gather documents and complete the LCA before filing.
  • Set the proposed start date only after confirming portability eligibility and filing status.
  • Expect the case to take longer if USCIS requests evidence, the filing is rejected, or the petition raises questions about the role, wage, worksite or maintenance of status.
  • Do not use a historical median as a promise that approval will arrive within that number of months.

Can you work for two H-1B employers?

Yes, USCIS says an H-1B worker may work for more than one employer when each employer completes the required filing process. The second company generally files its own concurrent H-1B petition; the first employer’s approval does not automatically authorize work for an unrelated company.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Concurrent employment must remain consistent with the petitions. The worker should track the duties, locations, schedules and validity periods for both jobs. If one employer ends its employment, that change does not automatically determine the status of the other petition, but the worker should obtain case-specific advice before changing schedules or relying on the remaining job alone.

Common mistakes that create problems

Starting before a qualifying filing

Filing-based portability is available only when the worker satisfies the underlying conditions. Starting work first and asking the employer to file later can create unauthorized-employment concerns.

Filing after the authorized-stay period ends

A late petition may not support portability. Check the expiration date on the admission record and the dates covered by the existing approval before the employer files.

Ignoring prior unauthorized employment

USCIS identifies the absence of unauthorized employment since admission as a portability condition. A worker with a prior violation should disclose it to qualified counsel rather than assume a new petition erases it.

Using the wrong filing basis

A same-employer material change may need an amended petition, while a second employer needs a concurrent filing. The label “transfer” does not replace the factual analysis.

Assuming an approval is guaranteed

Portability can permit a start while a case is pending, but the petition still must be approvable. A request for evidence or denial can require the employer to stop, respond or reassess the employment plan.

Relying on an outdated processing estimate

USCIS updates processing information. Use the current tool for the specific category and office instead of treating an old national median as a deadline.

A practical worker checklist

  1. Confirm the proposed job. Compare the duties, minimum qualifications, worksite and wage with H-1B requirements.
  2. Check your immigration record. Review the most recent approval notice, admission record, passport and authorized-stay end date.
  3. Review employment history. Collect recent pay statements and identify any gaps or periods when you may not have been authorized to work.
  4. Ask the employer which filing basis applies. Confirm whether it is a new-employer, concurrent or amended petition.
  5. Verify the LCA and Form I-129 plan. The employer should complete the required steps before you rely on portability.
  6. Coordinate the start date. If eligibility is uncertain, obtain a case-specific legal assessment before beginning work.
  7. Keep the filing evidence. Retain the receipt notice, petition copy, LCA information and all USCIS correspondence.
  8. Monitor the pending case. Respond promptly to employer requests and any USCIS request for evidence.

What if you are between jobs, your status document is expired, or the petition is pending?

General portability guidance does not resolve every fact pattern. A worker between jobs may have questions about the end of the prior employment, the authorized-stay period and whether the new petition was filed in time. An expired card or approval notice also does not by itself establish that the underlying status ended or continued; the admission record, approval dates and filing history must be reviewed together.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Likewise, a pending petition does not automatically cure a status problem. If you have a gap in employment, a late filing, possible unauthorized work, an expired authorized-stay period or conflicting immigration records, seek a qualified immigration attorney’s fact-specific assessment before starting or changing work.

Illustrative scenarios

Worker in valid H-1B employment

An H-1B employee remains within the authorized-stay period, has no known unauthorized employment and receives an offer from a new company. The new company prepares the LCA and files a nonfrivolous change-of-employer petition before the period ends. If the worker meets the portability conditions, the general rule may permit starting after filing while USCIS adjudicates the case.

Worker with uncertain status history

An employee discovers a period without pay records and is unsure whether work continued after an earlier petition ended. A new employer may still be able to file, but the worker should not assume immediate portability. Counsel should examine the admission record, approval notices, payroll and filing dates first.

Second job without leaving the first

An H-1B worker wants to keep the original job and add a part-time position. The second employer must complete its own required H-1B filing for concurrent employment. The worker should not begin the second job solely because the first employer already has an approval.

Bottom line for changing jobs on H-1B

Changing H-1B employers is often possible, and an eligible worker may generally start with the new employer after a properly filed change-of-employer petition rather than waiting for approval. Eligibility depends on lawful admission, timely filing before the authorized-stay period ends, no unauthorized employment and a petition that matches the actual job. Processing time has no universal number: USCIS’s FY 2026 historical medians were 0.6 months for premium-filed Form I-129 cases and 5.1 months for non-premium cases through August 30, 2026, but those figures are not guarantees for an individual transfer.
