Sometimes. Under the American Competitiveness in the Twenty-First Century Act (AC21) portability rule, some employment-based applicants may change employers after their Form I-485 (Application to Register Permanent Residence or Adjust Status) has been pending for at least 180 days. The proposed job must generally be in the same or a similar occupational classification as the job described in the underlying immigrant petition, and the petition must remain valid. The rule is not identical for every employment category, and moving the I-485 to a new employment-based basis can start a new 180-day period.
Before resigning or accepting a new position, have an immigration attorney compare your I-140 status, I-485 filing and pending dates, immigrant category, and the actual duties of both jobs. A job title, pay level, or passage of time by itself does not establish portability.

What the 180-day rule actually measures
The relevant clock is the time your I-485 has been pending. USCIS describes the general threshold as 180 days or more of pending adjustment-of-status time. The clock does not begin when you file an I-140, and an I-140 that has been pending for 180 days does not, by itself, give you job portability.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesFor example, if an I-140 was filed in January but the I-485 was not filed until June, the portability analysis uses the I-485 filing and pending dates. The date that matters is when USCIS accepted the adjustment application and it remained pending, not simply when an employer started the sponsorship process.

When the clock can be interrupted
The 180-day condition assumes the I-485 remains pending. A denial, withdrawal, or other event that ends the application can remove the basis for portability. Because the effect of a particular event depends on the case record and USCIS action, obtain a case-specific review rather than assuming that time already elapsed will always be usable.
Four conditions to screen before changing jobs
Portability is a fact-specific eligibility rule. Check all of these conditions together; satisfying one does not cure a problem with another.
| Question | What must generally be true | Why it matters |
|---|---|---|
| Has the I-485 been pending at least 180 days? | USCIS must have had the adjustment application pending for 180 days or more. | The threshold is tied to the I-485, not the I-140. |
| Is the underlying petition valid? | The immigrant petition must remain valid and approvable for portability purposes. | Elapsed time cannot turn an invalid or non-approvable I-140 into a portable one. |
| Is the new job in the same or a similar occupational classification? | Compare the actual duties and occupational classification of the sponsored job with the proposed job. | A different title or similar salary alone does not decide the comparison. |
| Which employment category applies? | The general guidance covers certain approved EB-1, EB-2, and EB-3 petitions, subject to category-specific rules. | Extraordinary-ability and national-interest-waiver cases are treated differently under the general AC21 portability provision. |
| Has the I-485 basis been transferred? | If the application was moved to a different employment-based category using a new I-140, a new portability period may apply. | USCIS says the 180-day period under the new basis begins with the transfer request. |
What “same or similar occupational classification” means
USCIS looks at the substance of the jobs, not just their labels. The comparison is between the position described in the original employment-based petition and the proposed position. Relevant facts can include the core duties, the type of work, required skills, normal occupational classification, level of responsibility, and the setting in which the work is performed.

Why job titles are not enough
An employee might move from “software engineer” to “systems engineer” and still perform substantially related work, while two jobs with the same title could involve materially different duties. Likewise, a comparable salary can support a consistent level of work but does not, on its own, prove that the classifications are the same or similar.
Build a duty-by-duty comparison
Write down the principal duties in the original labor certification or petition and in the new offer. Identify which responsibilities overlap, which are new, and whether the required education, experience, and technical skills remain comparable. Preserve job descriptions, organizational information, and a signed offer or employment confirmation so counsel can assess the comparison against the actual record.
Which employment categories are covered?
The cited USCIS guidance describes portability for certain approved petitions in the first, second, and third employment-based preference categories: EB-1, EB-2, and EB-3. That does not mean every case in those categories qualifies automatically; the I-485 timing, petition validity, and job comparison still control.

Extraordinary ability and national interest waiver cases
USCIS identifies petitions based on extraordinary ability and national interest waivers as outside the general AC21 portability provision. That is not the same as saying a person in one of those classifications can never change employers. Separate rules may permit a change, but the analysis is different from the standard employer-sponsored portability framework. Obtain advice specific to the petition type before treating a new job as permissible.
How transferring the I-485 basis changes the timing
An adjustment application can sometimes be transferred to a different employment-based category using a new I-140. USCIS distinguishes that transfer from ordinary job portability. If you request a transfer, USCIS says you may not rely on portability under the new basis until 180 days after making the transfer request.
That means the original I-485 history does not necessarily give an immediate portability right under the new petition. Record the date of the transfer request and ask counsel how the transfer affects both the original and new bases before changing jobs. Do not assume that an approved new I-140 or an earlier 180-day period eliminates the new waiting period.
A practical decision process before resigning
- Confirm the I-485 dates. Locate the I-485 receipt notice and confirm the filing date and whether USCIS has kept the application pending for at least 180 days. Do not substitute the I-140 filing date.
- Check the I-140 record. Confirm whether the petition is approved, whether it remains valid for your case, and whether any withdrawal, revocation, fraud finding, or other issue could affect its validity. An attorney should review the approval and the underlying filing rather than relying on a verbal summary.
- Identify the exact immigrant category. Determine whether the case is EB-1, EB-2, EB-3, extraordinary ability, national interest waiver, or another classification. Category-specific rules can change the analysis.
- Collect both job descriptions. Obtain the original sponsored position’s duties and the proposed employer’s written description, including title, work location, reporting structure, required skills, and principal responsibilities.
- Compare occupational classifications. Have counsel evaluate whether the new work is in the same or a similar occupational classification. Explain meaningful changes instead of relying on matching titles or compensation.
- Check for a basis transfer. Find out whether you or your representative requested to transfer the I-485 to a different employment-based category. If so, calculate the separate 180-day period from the transfer request.
- Plan the notification step. USCIS guidance references Form I-485 Supplement J for portability notification. Form editions, instructions, filing addresses, and submission routes can change, so verify the current USCIS instructions before filing anything.
- Keep the record consistent. Save the offer, job description, start date, pay information, correspondence, and copies of all filings. Tell counsel about any period of unemployment or material change in duties so the submission accurately describes the case.
What can happen if you change jobs before 180 days?
Changing employers before the I-485 has been pending for 180 days generally falls outside the standard AC21 portability safe harbor. The original sponsoring employer and job may still be important to the pending application, and leaving too early can create eligibility and procedural risks. The exact consequences depend on the petition, the employer’s actions, the reason for the move, and USCIS decisions in the individual case.

Do not treat the absence of an immediate USCIS notice as approval. A person can continue working in another position while dealing with separate employment-authorization rules, but work authorization and green-card portability are different questions. Confirm both before starting the new job.

What if the original employer withdraws the petition?
An employer’s withdrawal, a petition revocation, or a finding that the I-140 was not approvable can affect whether there is a valid basis for portability. The 180-day passage of time does not cure a petition that is invalid. Ask counsel to review USCIS notices, the petition’s approval history, and the timing of any withdrawal or revocation before relying on AC21.
Because the legal effect can turn on when an action occurred and what USCIS decided, keep every notice and do not discard the original petition documentation after changing employers.
Best Value
Evidence that helps evaluate a proposed move
- The I-485 receipt notice and any notices showing it remains pending.
- The approved I-140 notice, the petition classification, and records of any withdrawal, revocation, or successor filing.
- The original labor certification or petition job description, including duties and required qualifications.
- A detailed offer or employment letter for the new job, with duties, location, reporting line, and start date.
- An explanation mapping the old and new duties to the same or similar occupational classification.
- Documents showing any I-485 transfer request, including the date it was made.
- Copies of Supplement J filings and USCIS correspondence, using the current form edition and instructions.
These documents do not guarantee approval. They give an attorney and USCIS the factual record needed to assess the portability question instead of relying on a job title or a short description.
Common mistakes to avoid
Counting 180 days from the I-140
This is the most basic timing error. Portability uses the pending I-485 period. An I-140 that has been pending for 180 days is not a substitute for an I-485 that has reached the threshold.
Assuming an approved I-140 makes every move safe
Approval does not eliminate the same-or-similar-job requirement, the 180-day I-485 condition, or category-specific limits. Petition validity must still be examined in the context of the proposed change.
Using salary as the only comparison
Pay can be one fact, but USCIS’s question concerns occupational classification and the actual work. A higher or lower salary does not automatically establish similarity or dissimilarity.
Ignoring a transfer of basis
A transfer to a new employment-based category can create a new portability clock. Ask for the transfer date and calculate the period under the new basis separately.
Filing an outdated form
USCIS can change form editions and filing instructions. The available guidance references Supplement J but does not establish a current edition number, filing address, or submission method. Check the live USCIS form instructions immediately before preparing a filing.

Questions to take to an immigration attorney
- What date does USCIS recognize as the start of my pending I-485 period, and has it reached 180 days?
- Is my I-140 approved and still valid for AC21 portability?
- Which employment-based category controls my case?
- Do the proposed duties fall in the same or a similar occupational classification?
- Has any I-485 transfer request started a new 180-day period?
- What current Supplement J edition and submission route apply to my case?
- What should happen if the original employer withdraws the job or USCIS issues a request for evidence?
Bottom line for a pending employment-based green-card case
You may be able to change employers after your I-485 has been pending for at least 180 days when the underlying I-140 remains valid and the new job is in the same or a similar occupational classification. The general rule is associated with certain EB-1, EB-2, and EB-3 cases, while extraordinary-ability and national-interest-waiver petitions require a different analysis. A transfer to a new employment-based basis can restart the 180-day portability period. Because the result depends on dates, petition history, category, and real job duties, obtain an individual legal review before leaving the sponsored position.
