Can you appeal an income-tax demand? Deadlines, process and stay options (India, 2026)

Yes. If your Indian income-tax order is appealable, you can usually challenge it before the Joint Commissioner (Appeals) or Commissioner (Appeals) by filing Form 35. Filing the appeal does not by itself stop recovery, so you must separately seek protection from the Assessing Officer and meet the applicable payment conditions.

The practical sequence is: identify the order and service date, preserve the 30-day limitation where it applies, pay the statutory fee, upload a complete Form 35 record, satisfy the admission payment rule, and file a written section 220(6) stay request if immediate collection would cause difficulty.

What can be appealed?

Section 246A of the Income-tax Act covers many of the orders taxpayers commonly dispute, including processing intimations, scrutiny assessments, reassessments and related penalty or assessment orders. Depending on the order and jurisdiction, the first appeal is heard by the Joint Commissioner (Appeals) or the Commissioner (Appeals).

Read the operative order, the notice of demand and the document identification number (DIN) together. The description on the portal may say “intimation,” “assessment,” “penalty,” “rectification” or another category; that label affects both the appeal route and the limitation period. An appeal is appropriate when you challenge the legal or factual determination itself. A rectification request or portal response is generally better for an obvious processing or record error that the authority can correct without re-arguing the assessment.

Appeal versus rectification or grievance

  • Use Form 35 when you dispute an addition, disallowance, interpretation, eligibility decision or other appealable finding.
  • Consider rectification for an apparent mistake in the record, such as a tax credit that was demonstrably omitted or a calculation error that is visible from the existing documents.
  • Use a grievance or portal response for a technical filing problem or an issue that does not require appellate findings. A grievance does not replace the statutory appeal where limitation is running.

Deadlines: when does the 30-day clock start?

For an assessment or penalty, Form 35 should generally be filed within 30 days from service of the notice of demand. For other appealable matters, the period generally runs from communication of the order. This is the position stated in current Income Tax Department guidance and the Income-tax Act, 2025 material published for 2026.

Situation Limitation trigger Practical action
Assessment or penalty Service of the notice of demand Record the date and preserve delivery or portal evidence; count 30 days.
Other appealable order Communication of the order Save the communication date shown on the e-Filing account and calculate the applicable period.
Filing after the period Delay beyond the statutory limit File a condonation request explaining the sufficient cause and the full period of delay.

Download the order, demand notice and DIN from the e-Filing portal immediately. Keep the email, SMS, portal activity record or other proof showing when the document was made available. If the order and demand notice appear on different dates, identify which date is legally relevant for that category rather than assuming the later date controls.

If you are late

The appellate authority may condone delay when sufficient cause is shown. Attach a separate, signed explanation that sets out the chronology and accounts for each day or period of delay. Describe the event, when you learned of it, what action you took, and why filing could not reasonably occur sooner. A bare statement that you were busy or unaware of the law is weaker than a dated explanation supported by evidence such as illness records, a portal outage record or proof that the order was not accessible.

Before you open Form 35

  1. Identify the exact order. Note the assessment year, section cited, DIN, date of order, date of service and the amount shown in the demand notice.
  2. Reconcile the figures. Compare returned income, assessed income, tax credits, interest, prepaid tax and the disputed amount. Separate amounts you accept from amounts you challenge.
  3. Classify the dispute. Decide whether each issue is factual (for example, a credit or expense), legal (interpretation or eligibility), procedural (notice or jurisdiction) or mixed.
  4. Check admission payment. Before filing, determine whether tax on the returned income has been paid, or, where no return was filed, whether the advance-tax equivalent has been paid. If the statutory exemption is relevant, prepare that application with supporting facts.
  5. Choose a recovery strategy. Decide whether to pay the demand, seek section 220(6) protection, or do both in part. Payment and stay are separate decisions.

How to file Form 35 online

The Form 35 process is electronic. The following sequence follows the Income Tax Department’s Form 35 guidance and manual.

  1. Sign in and locate the appeal service. Open the e-Filing portal, choose the income-tax appeal/Form 35 service, and select the relevant assessment year and order type.
  2. Enter order and party details. Provide the DIN, order date, communication or service date, assessing officer details, appellant contact information and the disputed demand figures exactly as shown in the records.
  3. Pay the appeal fee. Use the applicable fee band, save the payment receipt and attach proof when the form asks for it.
  4. Write the statement of facts. Present a chronological, neutral account of the return, notices, replies, order and the specific adjustment. Keep arguments for the grounds of appeal.
  5. Number concise grounds. Give each legal or factual challenge its own numbered ground. State the relief sought and avoid argumentative paragraphs that combine unrelated issues.
  6. Upload the record. Attach the order, notice of demand, fee proof, tax-paid details and documentary evidence supporting each ground. Use readable files and consistent names so the appellate authority can match evidence to a ground.
  7. Verify and submit. Complete verification with Digital Signature Certificate (DSC) or Electronic Verification Code (EVC), as applicable. Save the acknowledgement number and a complete copy of the submitted form.

Documents to assemble

  • Appealable order or intimation, including all pages and annexures.
  • Notice of demand and DIN.
  • Return acknowledgement and computation of income for the relevant year.
  • Proof of tax, tax deducted or collected at source, advance tax and self-assessment tax paid.
  • Appeal-fee receipt.
  • Statement of facts and numbered grounds of appeal.
  • Invoices, agreements, ledgers, confirmations, bank statements, certificates or other evidence tied to each disputed adjustment.
  • Any earlier submissions, notices and replies needed to show what was raised before the Assessing Officer.
  • Condonation application and proof, if the filing is late.
  • Separate section 220(6) stay request and payment evidence, if recovery protection is sought.

Form 35 fee and admission payment

The published Form 35 fee bands are based on assessed income, with a separate band for matters outside those categories.

Basis stated in the guidance Appeal fee
Assessed income up to ₹1 lakh ₹250
Assessed income above ₹1 lakh and up to ₹2 lakh ₹500
Assessed income above ₹2 lakh ₹1,000
Matter outside those income categories ₹250

These are statutory appeal fees, not a percentage of the disputed demand. Retain the payment reference because Form 35 asks for fee details.

Admission also has a tax-payment condition. The Act generally requires payment of tax on the income returned. If no return was filed, the equivalent advance-tax amount is generally required. A permitted statutory exemption may be available where the facts justify it; make that request with the appeal rather than assuming the condition is waived.

Does an appeal automatically stop recovery?

No. Section 220(1) generally gives 30 days from service of a demand notice to pay. Merely submitting Form 35 does not convert the disputed amount into a stayed demand, and collection steps can continue unless the department grants protection or the amount is otherwise dealt with.

Section 220(6) addresses this gap. After an appeal is presented, the Assessing Officer may, in the officer’s discretion and subject to conditions, treat you as “not being in default” for the disputed amount while the appeal remains undisposed. The power is conditional, not automatic, and it does not erase the demand or guarantee a particular outcome.

How to request section 220(6) protection

  1. Address a written application to the Assessing Officer who issued the demand.
  2. Identify the assessment year, DIN, total demand, amount already paid and the precise disputed amount.
  3. Attach the Form 35 acknowledgement and a copy of the appeal.
  4. Explain the prima-facie grounds of challenge and why recovery before disposal would cause financial hardship or other concrete prejudice.
  5. State the payment you can make immediately and attach challans or other proof of payment.
  6. Ask for a written order specifying the conditions, validity period and treatment of any undisputed amount.
  7. Monitor the portal and comply with every condition; a stay can be withdrawn or become ineffective if its terms are breached.

What does the 15% figure mean?

A Central Board of Direct Taxes press release dated 3 March 2016 stated: “where the outstanding demand is disputed before Commissioner (Appeals), the assessing officer shall grant stay of demand till disposal of first appeal on payment of 15% of the disputed demand.” That sentence describes the published 2016 first-appeal guideline. It is not a universal promise for every taxpayer or every later instruction. Before relying on 15%, verify the current departmental direction, any exceptional category and the conditions attached to your order. The Assessing Officer’s section 220(6) discretion and the facts of your case still matter.

Paying the demand or seeking a stay

Choice Advantage Risk or cost
Pay the disputed amount Removes immediate recovery exposure and avoids dependence on discretionary relief. Ties up cash until the appeal or subsequent refund process is resolved.
Seek section 220(6) protection Preserves liquidity while the appeal is pending if the Assessing Officer grants it. Approval is discretionary, conditions may include a payment, and recovery can continue if the request is refused or conditions are breached.
Pay undisputed amount and seek protection for the balance Shows cooperation while limiting the amount for which protection is requested. Requires an accurate disputed-demand calculation and continuing compliance.

Do not treat a stay request as a substitute for filing Form 35. The appeal contests the merits; section 220(6) addresses collection while that contest is pending.

What happens after submission?

First appeals may proceed through the faceless process. Monitor the e-Proceedings area of the e-Filing account, not just email, for notices, requests for information and hearing communications. Respond by the stated deadline and upload evidence in the requested format.

The Form 35 manual says an appellant may request a personal hearing by video conference in faceless appeal proceedings. Make that request in the manner and time allowed by the notice, and explain briefly why oral submissions would assist. Keep proof of every upload, acknowledgement and response.

Responding to a notice

  • Match each question to a numbered ground and identify the exact attachment that answers it.
  • Do not introduce a new factual story that contradicts the statement of facts without explaining the correction.
  • Submit a short index and page references for large evidence files.
  • Check the portal after submission to confirm that the response status changed to filed or submitted.

When professional help is worthwhile

Self-filing can be practical for a clear, low-value adjustment supported by simple records and an uncontested limitation date. A chartered accountant or tax lawyer is more suitable when the demand involves several assessment years, complex additions, jurisdiction or notice defects, transfer-pricing or business evidence, a condonation application, a large disputed amount or a difficult stay negotiation. Professional assistance is particularly useful for separating facts from legal grounds, preserving evidence and presenting a cash-flow case under section 220(6).

Common errors that jeopardize an appeal

  • Counting from the wrong date: using the order date when the category runs from service of the demand notice, or ignoring the communication date for another order.
  • Waiting for a stay before appealing: the stay request does not extend the Form 35 limitation period.
  • Uploading only the order: the notice of demand, fee proof and tax-paid details are part of the filing record.
  • Vague grounds: grounds such as “the order is wrong” do not identify the adjustment or relief sought.
  • Ignoring the admission condition: unpaid tax on returned income, or the applicable advance-tax equivalent where no return was filed, can create an admission problem unless an exemption is properly requested.
  • Assuming 15% is current in every case: the cited figure comes from the 3 March 2016 CBDT release and must be checked against later instructions.
  • Failing to monitor e-Proceedings: a missed faceless notice can leave the authority to decide on the available record.

Bottom line

An eligible Indian income-tax demand can generally be challenged through Form 35 before the Joint Commissioner (Appeals) or Commissioner (Appeals). Protect the limitation period, submit a complete evidence-backed record, meet the statutory admission payment rule, and treat recovery as a separate problem. A written section 220(6) request is the route to seek non-default treatment, but its conditions and any payment requirement must be confirmed for the current year and your specific demand.
