The outcome depends on what the regulator requests, what a court orders, what the exchange agrees to, and which assets or services are affected. Customers might face limits on trading a particular coin, a withdrawal process under court-ordered safeguards, or a platform shutdown with an undertaking to return customer assets.
What can “lose access” mean?
An exchange-related action can affect different things. A restriction on trading one asset is not the same as an account freeze; a court order is not the same as a regulator’s request; and a platform closure does not by itself establish that customers have permanently lost their assets.

- Trading restrictions: You may be unable to buy or sell particular crypto assets while other account functions remain available.
- Withdrawal limits or safeguards: A court order or platform response may restrict transfers while still requiring the exchange to facilitate customer withdrawals.
- Platform closure: An operator may agree to stop operating and undertake to account for and transfer customer assets. That does not guarantee that every transfer will be prompt or uncomplicated.
To understand your position, distinguish the regulator’s allegations and requested relief from a court’s order and from any settlement or undertaking the platform has accepted.

Can the SEC freeze my crypto exchange account?
It can seek emergency measures, but a request is not itself a final court order. The Binance.US case shows why the procedural details matter. On June 6, 2023, the SEC filed for emergency relief that included freezing assets of BAM Management, repatriating customer assets, and other measures. Those were requests for relief—not a final finding that all customer withdrawals were barred. The SEC’s June 17, 2023 announcement described an agreed court order requiring defendants to repatriate assets held for U.S. customers, keep those assets in the United States, and facilitate customer withdrawals, while restricting certain transfers and spending.

The SEC later said that a joint stipulation to dismiss the civil enforcement action with prejudice was filed on May 29, 2025. The 2023 release therefore describes the order and procedural history as reported by the SEC; it should not be read to mean that the lawsuit remains active.
What happened in other SEC actions?
Beaxy: shutdown and an undertaking to transfer assets
On March 29, 2023, the SEC announced that the operators of the Beaxy Platform had agreed to stop operating it, shut it down, account for customer assets and funds, and transfer them to each respective customer. The same announcement said the SEC continued litigating separate charges against founder Artak Hamazaspyan and Beaxy Digital. The operators’ customer-transfer undertaking and those separate allegations were distinct outcomes. Read the SEC’s Beaxy announcement.

eToro: limits on trading selected assets
On September 12, 2024, the SEC announced a settlement under which eToro USA LLC agreed to make only a limited set of crypto assets available for U.S. trading. The SEC said eToro announced a 180-day period for customers to sell other crypto assets. It also described an order provision requiring liquidation and return of proceeds within 187 days for certain assets the company could not transfer to customers. These were terms associated with that specific settlement, not general deadlines for other exchanges. See the SEC’s eToro announcement.

These examples show different possible outcomes, not a standard procedure for every exchange or customer. The SEC’s interpretive release issued March 17, 2026, effective March 23, 2026, addresses federal securities laws as applied to certain crypto assets and transactions, with related CFTC guidance noted on the SEC page. It does not establish a general rule that the release itself blocks or guarantees an individual customer’s exchange access. Read the SEC’s release.

What should you do if your exchange or a coin is affected?
- Read the exchange’s official notice. Identify whether it concerns your whole account, deposits, withdrawals, or trading in particular assets. Check the affected asset and network, any stated deadline, and the procedure for action.
- Check the legal status of the measure. Look for whether the announcement describes allegations, relief requested by a regulator, a court order, settlement terms, or a later update. These have different effects.
- Follow the stated process and keep records. Save relevant notices and transaction records. If withdrawals, transfers, or claims are available, follow the platform’s current instructions and verify destination details carefully.
- Do not assume a deadline from another case applies to you. The 180-day and 187-day periods described above concerned eToro’s 2024 settlement; they are not exchange-wide rules.
- Seek qualified advice if access or a material balance is at stake. The legal and practical consequences depend on the specific platform, order, and account.
Would self-custody prevent an exchange restriction?
Self-custody changes who controls the private keys; it does not recover crypto still held or restricted at an exchange, and it is not a way to defeat a court order. In exchange custody, the custodian controls access to the private keys for assets it holds. With self-custody, you control the keys and are responsible for protecting them.
The SEC’s December 12, 2025 retail custody bulletin explains that wallets hold private keys rather than crypto assets themselves. It warns that a third-party custodian’s hack, shutdown, or bankruptcy may leave an investor unable to access assets. Self-custody removes the custodian from control of the keys but places the security burden on the investor: losing a private key can permanently remove access. A seed phrase can restore a wallet if its hardware or software is damaged, so it must be protected. Read the SEC’s custody bulletin.

How common is access loss after regulatory action?
The SEC examples above establish that access outcomes can differ, but they do not show how often U.S. investors lose access after regulatory action. The cited actions provide case-specific terms and dates, not a population-level frequency estimate.
