U.S. forces ordinarily use overseas bases under an arrangement with the country that controls the territory. That permission can be limited or withdrawn, and permission to station troops does not automatically authorize every activity or military operation from the base. Whether a particular use is lawful depends on the host country’s consent, the terms of the applicable arrangement, and—if force is used—a separate international-law basis.
What “permission” covers
There are three separate questions in any dispute over a U.S. base:
As an Amazon Associate I earn from qualifying purchases.
- May U.S. forces be present? This turns principally on the host state’s consent and the agreement or other arrangement governing the presence.
- May they use the base for this activity? The arrangement may distinguish routine presence, training, transit, construction, or other uses from a specific operation. A host can restrict a use even while permitting U.S. forces to remain.
- May the United States use force against the target? That requires a separate legal basis under international law, as well as consideration of U.S. domestic authority.
These questions are related, but none answers all the others. A U.S. authorization to use force does not itself give the United States permission to use another country’s territory. Likewise, host-state consent to a military presence does not, by itself, establish that a particular attack is lawful.
How overseas basing arrangements work
The Congressional Research Service’s 2025 report, U.S. Overseas Basing: Background and Issues for Congress, describes overseas access as generally arranged diplomatically with foreign governments. The instruments can have different names, including a Status of Forces Agreement (SOFA), Defense Cooperation Agreement (DCA), Visiting Forces Agreement (VFA), or memorandum of understanding (MOU). Some terms may not be public, and the label alone does not establish what activities are allowed.

The arrangement may set limits or conditions on matters such as facilities, personnel, location, duration, or permitted activities. It is also distinct from a defense treaty between the countries: an alliance does not, by itself, tell you the precise terms for a particular base or mission.
What a SOFA does—and does not do
A SOFA generally establishes the legal status and treatment of visiting forces in the host country, including jurisdictional questions. As the Congressional Research Service explains in Status of Forces Agreement (SOFA): What Is It, and How Has It Been Utilized?, a SOFA does not normally serve as authorization for specific exercises, activities, or missions. To determine whether a particular operation is permitted, the relevant basing terms and any later limits or approvals must be examined.

A host can restrict or withdraw access
Permission is not necessarily permanent or unconditional. In a 1999 statement concerning the Conventional Forces in Europe Treaty, a U.S. delegation described host-state consent as arising from sovereign authority and said it could be conditioned on factors such as the size or composition of forces, duration, and location. The delegation also stated that a host could withdraw consent, requiring foreign forces to begin a timely withdrawal. That statement is specific to its treaty context; it is an official U.S. position, not a ruling that resolves every country’s agreement.

Examples in the CRS overseas-basing report illustrate how access can change:
Rank #3
- Four armies, each with their own unique figures
- Advanced rules, Enhanced combat, Elite army units, and New Team gameplay variant
- Country of Origin: China
- Product Type: Board Game
- In the mid-1960s, France ended the U.S. military presence after Charles de Gaulle rejected the existing arrangements.
- In 2003, Turkey blocked the use of Incirlik Air Base for U.S. combat operations against Iraq.
- After Niger’s 2023 coup, its government cancelled the existing SOFA; U.S. forces withdrew and abandoned two bases.
These cases show why an existing alliance or past access should not be treated as proof of unrestricted permission for a later operation.
Permission to use a base is not permission to use force
The United Nations Charter generally prohibits the use of force against another state’s territorial integrity or political independence. The Congressional Research Service’s Constitution Annotated identifies recognized exceptions relevant to this rule, including self-defense after an armed attack and authorization by the UN Security Council. Whether a particular operation fits an exception depends on its facts and legal arguments; the fact that a base is available does not settle that question.

U.S. domestic authority is another separate inquiry. The Constitution Annotated explains that Congress can declare war or authorize more limited hostilities, while presidents have asserted independent constitutional authority in some circumstances. The War Powers Resolution also establishes reporting requirements for specified deployments and hostilities and a statutory termination framework for covered hostilities. The legal basis for a particular operation depends on the applicable authorization or statute, the circumstances, and the constitutional arguments involved.
Does a U.S. base become U.S. territory?
Ordinarily, no. The CRS report says host countries retain title to foreign land and capital improvements used for U.S. bases, and that nearly all overseas bases remain subject to the sovereignty of the state where they are located. Ending the relevant treaty or other agreement prohibits continued use under that arrangement.

The report cautiously notes a few situations in which the United States may be said to exercise de facto sovereignty without the consent of the state in whose legally recognized territory a base lies, naming Al Tanf in Syria and Guantanamo Bay in Cuba. That observation does not settle the legal status of either presence. Each requires analysis of its history, applicable agreements, current positions, and competing sovereignty arguments.
How to assess a specific base or operation
For a particular news report or legal dispute, establish each of these points before drawing a conclusion:
| Question | What to check |
|---|---|
| Territory and sovereignty | Which state has territorial sovereignty, and is that status disputed? |
| Consent instrument | Is there a treaty, basing agreement, SOFA, DCA, VFA, MOU, invitation, or other arrangement? Is it public and in force? |
| Scope | Does it cover presence only, or the specific activity at issue, such as training, transit, or combat operations? |
| Conditions and withdrawal | What limits apply to location, personnel, duration, notice, or termination? Has the host changed or withdrawn consent? |
| International-law basis | If force is used, what basis is asserted under the UN Charter, such as self-defense or Security Council authorization? |
| U.S. domestic authority | What constitutional or statutory authority is asserted, and do War Powers Resolution requirements apply? |
Because some agreements or provisions are not public, the available evidence may not establish the full terms of a particular arrangement. The answer should be stated narrowly when those terms or the relevant legal arguments are uncertain.
