Yes. Under India’s UPI merchant discount rate (MDR) framework announced on 15 September 2026 and scheduled to take effect on 15 October 2026, customers are not to pay MDR as a separate UPI fee. The Department of Financial Services says onboarded merchants cannot pass MDR charges on to customers. The Ministry of Finance says banks have been advised to ensure merchants do not do so. The published materials state the rule, but do not specify a consumer complaint process or a penalty for a merchant that adds the charge.
What the government has said about UPI MDR
The Ministry of Finance describes MDR as a charge within the merchant payment ecosystem, not a fee on customers or a tax collected by the government. It says the charge is distributed among payment participants, including banks and payment application providers. Its 15 September 2026 release says customers are not to pay MDR and that banks have been advised to ensure merchants do not pass it on. The Department of Financial Services FAQ is more categorical: “merchants on-boarded cannot pass on MDR charges to customers while accepting payments through UPI.” Ministry of Finance release, 15 September 2026; Department of Financial Services FAQ, 15 September 2026

That distinction in wording matters. The official FAQ states that onboarded merchants cannot pass MDR on; the Ministry describes the operational direction to banks as advice to ensure they do not. The materials reviewed do not set out how a particular surcharge would be investigated or what penalty would apply.
When the announced MDR rates apply
The framework is scheduled to take effect on 15 October 2026. As of 13 October 2026, these provisions have been announced but their effective date has not yet arrived. The charge categories are not the same for every UPI payment: the official framework distinguishes person-to-person (P2P) transfers from person-to-merchant (P2M) payments, transaction value, merchant classification and business category.

| Payment or merchant category | Announced MDR treatment |
|---|---|
| P2P transfers | Free, regardless of amount. |
| P2M payments up to ₹2,000 | Zero MDR. |
| Qualifying small merchants classified as P2PM and receiving up to ₹1 lakh per month through UPI QR codes | Zero MDR on all transactions. |
| Specified P2M transactions above ₹2,000 | Standard MDR of 0.4%; capped at ₹300 per transaction for transactions of ₹75,000 and above. |
| Transactions above ₹2,000 in listed essential or thin-margin sectors, including railways, telecommunications, insurance, fuel and agricultural inputs | Flat MDR of ₹5. |
| Payments involving mutual funds, securities, stockbrokers and dealers | MDR of 0.02%, capped at ₹300. |
These are merchant-side MDR categories, not permission to add a separate MDR surcharge to the customer’s bill. For a particular payment, the relevant category depends on whether it is P2P or P2M, its value, the merchant’s classification and the business sector. See the Ministry’s announcement and the DFS FAQ for the framework’s terms.
What the rule means at checkout
If a merchant says a UPI payment carries an extra MDR fee, the government’s announced position is that the customer should not be charged that MDR. But the published statements address MDR pass-through specifically. They do not establish that every change to a listed price, or every separate service charge, is automatically illegal; they do not explain how those other charges should be treated.

The Ministry estimates that approximately 96% of all P2M transactions will remain unaffected and that MDR will apply to about 4% of merchant transactions. Separately, the DFS FAQ says more than 95% of total UPI P2M transaction volume is at or below ₹2,000. These are different measures—one is the Ministry’s estimate of transactions unaffected, the other the FAQ’s statement about transaction volume—and should not be conflated. The Ministry release and DFS FAQ state that merchants should not pass MDR on to customers, but neither gives a specific consumer complaint channel, identifies the regulator responsible for an individual complaint, nor names a penalty for a merchant that adds an MDR surcharge. A consumer can distinguish the fee being described from an ordinary price or another charge, but the reviewed official statements do not say how to pursue a dispute.

Earlier government statements provide context, not a substitute for the 2026 framework. In August 2026, the Ministry described an amendment to section 10A of the Payment and Settlement Systems Act, 2007 as an enabling provision, with MDR parameters to be decided after passage of the Taxation and Other Laws (Amendment) Bill, 2026. The September release and DFS FAQ set out the later announced framework. A Lok Sabha answer from August 2025 and the earlier zero-MDR policy for BHIM-UPI and RuPay debit cards concern prior policy stages; neither gives the missing complaint process or penalty for the current announced UPI MDR rule.
