Can Police Track a Phone Without a Warrant? What to Know About Cell-Site Simulators

Sometimes, but there is no single nationwide rule. The answer depends on what information police obtain, how they obtain it, the agency involved, the circumstances, and the law of the jurisdiction. The U.S. Department of Justice (DOJ) generally requires its own law-enforcement components to obtain a probable-cause search warrant before deploying a cell-site simulator in a domestic criminal investigation, subject to stated exceptions. That internal policy does not automatically bind every state or local police department.

The Supreme Court has separately held that the government generally needs a warrant to obtain historical cell-site location records from a wireless carrier. Its decision did not determine the legality of every cell-site-simulator deployment, real-time location request, or tower dump.

What a cell-site simulator does

A cell-site simulator imitates cellular-network equipment so it can interact with phones in its vicinity. In the DOJ’s description, investigators use it in two basic ways: to locate a device whose unique identifier is already known, or to determine the identifier of an unknown device by collecting limited signaling information from phones nearby. The equipment can therefore help distinguish a target phone from other devices in an area, but the exact behavior depends on the model, network conditions, configuration, and deployment.

People sometimes use the term StingRay as shorthand for this category of equipment. The important legal question is not the brand name but the collection method: a simulator communicates directly with nearby phones rather than asking a carrier for records already stored in its systems.

What the simulator is not

  • It is not the same as requesting historical cell-site location information (CSLI) from a wireless carrier.
  • It is not a tower dump, in which an agency seeks records associated with phones that connected to specified carrier towers during a period.
  • It is not a GPS-extraction tool or, by itself, a search of the handset’s files.
  • Under the DOJ policy for criminal investigations, it may not be used to obtain communication contents or data stored on the phone, including texts, emails, contacts, or images.

Those distinctions matter because different technologies produce different privacy questions and may be governed by different statutes, court decisions, and agency rules.

What the DOJ policy requires

The DOJ announced its Department of Justice Policy Guidance: Use of Cell-Site Simulator Technology on September 3, 2015; the announcement page was updated February 5, 2025. The policy generally directs DOJ law-enforcement components to obtain a search warrant supported by probable cause before deploying a cell-site simulator in a domestic criminal investigation. The warrant is sought under Federal Rule of Criminal Procedure 41 or the applicable state equivalent.

Depending on the jurisdiction and the investigative technique, officers may also need authorization under a pen-register or trap-and-trace statute. That is a separate procedural question from whether a probable-cause warrant is required.

Exceptions in the policy

The policy does not create an unconditional warrant requirement for every deployment. It recognizes several exceptions and sets additional conditions:

  • Exigent circumstances: The policy gives protection of life, prevention of imminent evidence destruction, hot pursuit, and prevention of escape as examples. It states that court approval is still required in an exigency, although it does not require a warrant where the Fourth Amendment itself does not.
  • Exceptional circumstances: The policy allows use when the law does not require a warrant and obtaining one is impracticable.
  • Other legally recognized situations: The precise process can depend on the facts, the court involved, and applicable federal or state law.

These provisions describe DOJ policy for DOJ components. They do not establish what every municipal, county, or state agency must do, and a policy violation is not automatically the same question as a constitutional violation.

Limits on collected information

The DOJ guidance says a simulator may not be used to collect the contents of communications or information stored on a phone. That means the policy distinguishes signaling information used to identify or locate a device from the substance of messages, email, photographs, contact lists, and similar handset data. A separate warrant or other lawful authority might be needed for a later search of a phone or for a different source of information.

What Carpenter v. United States decided

In Carpenter v. United States, decided June 22, 2018, the Supreme Court held that the government generally conducts a Fourth Amendment search when it obtains historical CSLI from a wireless carrier and therefore ordinarily must get a warrant supported by probable cause. The records in that case covered 12,898 location points over 127 days, an average of 101 points per day. That figure describes the data acquired about the defendant in that case; it is not a standard amount collected in every investigation.

The Court emphasized the limited scope of its ruling, writing, “Our decision today is a narrow one.” The opinion did not decide whether the same rule applies to real-time CSLI or to tower dumps, and it did not decide the constitutionality of deploying a cell-site simulator. A court assessing a simulator case must therefore apply the relevant facts and local law rather than treating Carpenter as a direct answer.

How the main tracking methods differ

When someone asks whether police tracked a phone without a warrant, first identify who held or collected the information, whether the data was historical or real-time, and whether the method targeted one known device or gathered signals from many nearby phones.

Method Who holds or collects the information Timing and scope What the Supreme Court has said
Historical CSLI Wireless carrier records requested by the government Past location points associated with a subscriber or device over a period Carpenter generally requires a probable-cause warrant; the ruling is narrow
Real-time CSLI Usually obtained through a carrier or live network process Location information as events occur Not resolved by Carpenter
Tower dump Carrier records for devices that connected to specified towers Potentially includes multiple phones in a geographic area and time window Not resolved by Carpenter
Cell-site simulator Equipment operated by investigators that interacts directly with nearby phones Real-time signaling; may locate a known identifier or identify an unknown device among nearby phones Carpenter did not decide simulator use

The legal process can also differ within a category. A warrant, a pen-register order, a subpoena, a court order, an emergency authorization, or no prior warrant may be asserted depending on the agency, jurisdiction, purpose, and claimed exception. The label alone does not establish whether the collection was lawful.

Why the agency and location matter

Federal DOJ policy is department-wide guidance for DOJ components. It is not a nationwide statute that automatically governs local police. State constitutions, state electronic-surveillance laws, local policies, and appellate decisions can impose stricter rules. Some jurisdictions may require a warrant for a particular simulator use even when federal policy would allow an exception; others may litigate the issue under different standards.

Prince Jones v. United States, a 2017 decision of the District of Columbia Court of Appeals, discusses local police use of a cell-site simulator and warrant questions under the facts and law before that court. It is useful as an example of jurisdiction-specific analysis, not as a rule binding courts across the country.

For a real incident, identify the agency that operated the equipment and the court in which the investigation or prosecution is occurring. A statement that “police need a warrant” or “police never need a warrant” is too broad without those details.

When a warrantless deployment might be claimed

Investigators may argue that an exception applied, that the particular information was not protected in the same way as historical carrier records, or that the technology was used under a different statutory authorization. The DOJ policy’s exigency examples illustrate the kinds of immediate threats agencies may cite: a danger to life, imminent destruction of evidence, hot pursuit, or an impending escape.

Even under the DOJ policy, an exigency does not mean officers can ignore the courts altogether; the guidance says court approval is still required. The policy separately recognizes exceptional circumstances when a warrant is not legally required and obtaining one is impracticable. Whether those conditions were actually present is fact-specific and can be challenged later.

What information a simulator can reveal

The policy describes limited signaling information used to locate or identify devices. In a known-device operation, investigators already have an identifier and use the simulator to determine where that device is relative to the equipment. In an unknown-device operation, the simulator can collect identifying signaling from phones in range so investigators can determine which device is of interest.

Because nearby devices may respond, an operation can affect people who are not targets. The policy’s restriction on communication contents and stored phone data is important, but it does not mean the operation collects nothing about non-target devices; the technology’s described function involves signaling from devices in the simulator’s vicinity. The exact data retained, filtering procedures, and deletion rules depend on the agency’s policy and the deployment.

How to evaluate a suspected phone-tracking incident

  1. Determine the source. Ask whether the allegation concerns carrier records, a simulator, a tower dump, a handset search, or another tool. Do not treat those methods as interchangeable.
  2. Identify the time frame. Historical records and real-time collection raise different questions. Note the dates, duration, and geographic area described in any warrant, order, affidavit, or report.
  3. Identify the agency and court. Determine whether the operation involved a DOJ component, another federal agency, state police, or local officers, and where the case is being litigated.
  4. Find the claimed legal authority. Review the warrant, Rule 41 application, pen-register order, emergency paperwork, or other authorization. Check what technique and device identifiers the document actually covers.
  5. Check the stated purpose and scope. Compare the equipment’s described use with the authorization. A document authorizing carrier records may not authorize direct simulator deployment, and a device-location authorization may not authorize a search of handset contents.
  6. Raise the issue promptly with counsel. A defense lawyer can seek discovery about the equipment, challenge the collection, and assess suppression or other remedies under the governing jurisdiction’s law.

These steps do not determine the result by themselves. They organize the factual questions a court will need to answer.

Key terms in plain language

  • Cell-site simulator: Equipment that imitates cellular-network infrastructure and exchanges signaling with phones nearby.
  • Historical CSLI: Past location records maintained by a wireless carrier.
  • Real-time CSLI: Location information supplied as a device is being tracked, rather than a historical record retrieved later.
  • Tower dump: A request for records associated with devices that connected to specified cell towers during a defined period.
  • Pen register or trap-and-trace authorization: A statutory court process that may be relevant to signaling or dialing information, depending on the jurisdiction and investigative technique.
  • Probable-cause warrant: A judge’s authorization based on a showing that evidence of a crime will likely be found in the place or information described.

What remains unsettled

The Supreme Court has not supplied one rule covering every form of phone-location collection. Carpenter addresses historical carrier-held CSLI and expressly leaves real-time CSLI and tower dumps open. It does not answer whether a particular simulator deployment is a search requiring a warrant, what process is sufficient, or how an emergency changes the analysis.

Those unresolved questions make the facts of the operation decisive: the technology used, the information acquired, the duration and geographic range, the agency’s policy, the authorization obtained, and the law of the jurisdiction. A reliable answer must state those qualifications rather than converting one federal policy or one local appellate decision into a nationwide rule.
