A studio can ship AI-assisted or AI-generated art, audio, writing, code or other assets when its provider contract permits the use, every uploaded reference is licensed, the final material does not infringe someone else’s rights, and the team complies with registration, storefront and jurisdiction-specific disclosure rules.
Commercial permission from an AI provider is a contract promise. It does not automatically create exclusive copyright in an output, prove that the output is original, or protect a studio from claims involving a recognizable person, trademark, fictional character, music recording or substantially similar artwork.

Start with three separate legal questions
Studios often collapse “Can we use this?” into one question. In practice, release clearance requires three different answers:
- Does the provider contract allow the intended use? Check the plan, model, service-specific restrictions, indemnity terms and the version of the terms that applied when the asset was generated.
- What rights exist in the asset? In the United States, copyright protection depends on human authorship. A prompt by itself normally does not supply enough human expression, while creative selection, arrangement, editing or transformation can protect the human contribution.
- Could the asset violate someone else’s rights? Commercial use brings copyright, trademark, publicity-right, contract and platform-policy exposure. An AI-generated file is not automatically cleared merely because a model produced it.
Document each answer separately. A contract may let you distribute an output while the output remains difficult to protect as your exclusive copyrighted work, and a copyrightable composite can still contain an infringing third-party element.

How U.S. copyright protection works for AI game assets
Human authorship is the controlling test
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, states that generative-AI output is protectable only when a human author determines sufficient expressive elements. The Office distinguishes a bare prompt from perceptible human-authored material, creative arrangements and modifications. A detailed text instruction can influence a result, but describing the desired result is not the same as fixing the expressive choices that copyright protects.
The Office summarized the rule this way: “The Copyright Office confirms that the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” That means an AI-assisted workflow is not disqualified merely because a model participated.
What can count as a human contribution
Protection can attach to the parts your team actually authors. Depending on the facts, that may include an original character design built around generated studies, a hand-edited texture, a scene assembled from many elements, animation cleanup, shader work, sound editing, or the creative arrangement of otherwise unprotectable components. The stronger the team’s expressive control and the more clearly it is recorded, the easier it is to identify the protectable contribution.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteFor example, an artist who generates dozens of rough concepts, chooses a composition, redraws the silhouette, paints distinctive details, builds the final texture set and integrates it into a bespoke scene has a substantial human-authored record. A person who types one prompt, accepts one image unchanged and labels the file “studio original” has a much weaker copyright position in that image itself.

Registration requires disclosure
When registering a game or other work, the Copyright Office requires applicants to disclose AI-generated material and identify the human-authored contribution. Do not claim a fully machine-generated image as wholly studio-authored simply because an employee wrote the prompt. Describe what remains in the final work and identify the human-created selection, arrangement, editing or other contribution.
A game can still receive protection as a larger human-authored work even when it contains unprotectable AI material. Protection then covers the studio’s original code, writing, level design, art direction, composition and other human expression—not an automatic exclusive right over every generated fragment.
Provider terms: permission is not the same as ownership
Read the exact terms for the account, model and date used. Provider language changes, and service-specific rules can override a general ownership statement.

| Adobe Firefly | Adobe describes Firefly as built for commercial and educational work and says it uses safeguards intended to reduce infringement risk. | Some outputs can include non-generative Adobe Stock material under separate terms. Submitting output to an Adobe-hosted gallery can also grant Adobe a broad marketing and reuse license under product terms. |
These statements allocate contractual rights between a customer and a provider. They do not guarantee that an output is copyrightable, original, free of a likeness or trademark, or safe under every country’s law. Third-party rights and infringement risk
Inputs can create a problem before generation
Clear every image, texture, scan, voice, music stem, logo, reference sheet and likeness uploaded to a model. A contractor’s reference pack, a fan-made character sheet or a copied photograph may carry restrictions that follow the workflow. Keep the license or written permission with the generated asset, not only in an email folder that may be lost when a contractor leaves.
Outputs can still resemble protected material
Review high-visibility results for substantial similarity to a protected artwork, recognizable fictional character, brand identifier, recording or distinctive character voice. Also check whether a real person’s face or voice appears, because publicity and privacy rights can apply even where copyright does not.
U.S. fair use is fact-specific. Section 107 lists four factors: the purpose and character of the use, including its commercial nature; the nature of the copyrighted work; the amount and substantiality used; and the effect on the potential market or value. A commercial game may weigh differently from a noncommercial experiment, and a model-generated file is not a blanket fair-use defense. The Copyright Office treats training on copyrighted works, infringement by outputs and licensing as distinct policy questions, so a studio should analyze each one rather than assume that a provider’s training practice clears its own release.
Escalate unusual cases
Obtain qualified intellectual-property advice when an asset imitates a living artist’s distinctive style, uses a recognizable person or voice, depicts a protected brand or fictional character, incorporates uncertain datasets, or relies on an indemnity with exclusions. Keep the legal conclusion and the facts reviewed in the asset record.

EU obligations affect your vendor review
European Commission guidance on general-purpose AI providers says the EU AI Act requires providers to maintain copyright policies and publish summaries of training content, with the relevant obligations applying from August 2, 2025. This is principally a provider obligation, but it gives a studio concrete procurement questions:
- Can the provider show its copyright policy?
- Is a training-content summary available?
- Does the provider explain licensing, opt-out or rights-management mechanisms?
- Does the contract identify which entity is responsible for claims and what an indemnity excludes?
Those documents improve provenance review; they do not grant ownership of an output or remove national copyright, trademark, personality-right or contract risks. Apply the law of each launch market and the terms governing your suppliers, employees and contractors.

A practical clearance workflow
- Inventory the scope. List every AI-assisted asset, including files used in trailers, store screenshots, social posts and downloadable updates. Mark whether players will see it or whether it was only an internal productivity aid.
- Freeze the contract record. Save the provider’s terms, plan or subscription tier, model and version, generation date, terms effective date, enterprise addendum and any indemnity language. Re-check the terms before launch if generation occurred months earlier.
- Clear every input. Attach licenses or permissions for reference images, scans, voices, likenesses, logos, textures, music stems and other uploads. Remove material whose provenance cannot be established.
- Record the generation event. Preserve the prompt, negative prompt or parameter settings where applicable, input files, output identifier, model version and account used. Keep the original output as well as the edited master.
- Make human authorship visible. Have artists and designers document meaningful selections, redraws, compositing, paintovers, arrangements, animation cleanup, shader work, sound edits or writing changes. Keep dated source files and revision history.
- Run rights review. For prominent assets, check similarity, trademarks, publicity and privacy concerns, content-policy restrictions and any contractual limits on redistribution. Route unusual likeness, style-imitation or dataset questions to IP counsel.
- Prepare registration language. Identify the AI material that remains and describe the studio’s human-authored contribution for any copyright application. Never present an unchanged machine output as wholly human-created.
- Complete release checks. Review storefront and regional disclosure requirements immediately before submission, record the answers, and retain the approved build, asset list and sign-offs.
What to keep in an audit trail
A useful record lets a reviewer reconstruct how an asset was made and which rights were checked. For each asset, retain:
- Asset ID, project, department and whether it ships to players or appears in marketing.
- Provider, account or plan, model and version, generation date and the terms effective on that date.
- Prompt and settings, uploaded references, output files and every retained variation.
- Licenses or permissions for inputs, including voice, likeness, logo, scan, texture and music documentation.
- Names of human contributors, dated edits, source files, compositing or arrangement decisions and approval history.
- Similarity, trademark, publicity-right, privacy and content-policy review notes for high-visibility assets.
- Registration disclosures, storefront answers, jurisdictional checks and counsel’s written conclusion when advice was obtained.
Store a frozen copy of the provider terms rather than relying on a link that may later change. Record the exact model and version because a provider can alter training, output or retention behavior between releases.
Choosing a lower-risk workflow
Compare tools and production methods against the same questions instead of choosing solely on image quality or speed.

| Decision axis | Questions for the studio |
|---|---|
| Output rights | Does the contract allocate output rights, and are there service-specific exceptions? |
| Human contribution | Can the team show creative selection, arrangement, editing or transformation? |
| Training and provenance | Does the provider publish a copyright policy or training-content summary? |
| Indemnity and remedies | Is there an enterprise indemnity, and what exclusions, caps or procedures apply? |
| Confidentiality | Are prompts and uploads private, retained or used for service improvement? |
| Platform fit | Does the target storefront require disclosure or impose content safeguards? |
| Auditability | Can the studio preserve model and version, terms, prompts, inputs, edits and approvals? |
A workflow that produces slightly less spectacular outputs but gives you clear provenance, private handling and strong contractual remedies can be easier to ship than one that creates uncertain rights-review work late in production.
Common mistakes that delay or endanger a release
- “The tool says commercial use, so we are covered.” Commercial-use language is permission from the provider, not an originality guarantee or a release from third-party claims.
- “The prompt makes us the copyright owner.” Prompting alone may not provide the human expressive control required for protection in the United States.
- “We can delete the source files after export.” Without prompts, inputs, versions and edits, the studio may be unable to prove provenance or explain its human contribution.
- “A public gallery is harmless.” Uploading unreleased material can trigger broad provider licenses or confidentiality concerns, depending on the service terms.
- “One storefront rule covers every platform.” Disclosure categories and questions vary and can change; review each destination immediately before submission.
- “AI art cannot infringe.” Similarity, trademarks, likenesses, voices and unlicensed inputs remain fact-specific risks.
Bottom line for a commercial game
Use AI assets when you can show a rights chain: a provider contract that permits the use, licensed inputs, a documented human contribution where protection matters, review for third-party rights, and accurate platform and jurisdiction disclosures. The safest production practice treats each generated asset like a sourced external contribution—catalogued, reviewed and approved—rather than like automatically owned studio property.
