Stake.us’s current terms do not name Florida as an excluded state, but that does not establish that the service is legal under Florida law. The terms also bar play where local law prohibits it and make customers responsible for checking their eligibility. Florida’s official guidance reviewed here does not provide a Stake.us-specific legal ruling.
Does Stake.us allow players in Florida?
In the Stake.us Terms & Conditions accessed October 8, 2026, Florida is not among the named excluded U.S. states. The list names Washington, New York, Nevada, Idaho, Kentucky, Michigan, Vermont, New Jersey, Delaware, West Virginia, Pennsylvania, Rhode Island, Connecticut, Maryland, Louisiana, Montana, Arizona, Tennessee, California, Illinois, Indiana, and Maine. The terms also exclude other jurisdictions where applicable law precludes play and locations Stake excludes at its discretion. Read Stake.us’s Terms & Conditions.

That answers the platform-access question only in a limited sense: Florida is absent from the named-state list reviewed. It is not a guarantee that every Florida resident or situation is eligible, and the terms may change. Stake says customers must be legally allowed to participate, must not reside in or access the service from an excluded territory, and are responsible for checking local law. The terms also prohibit bypassing territorial restrictions.
Does Florida law establish that Stake.us is legal?
The Florida sources reviewed do not make a definitive determination about Stake.us. The company describes its service as a sweepstakes-style platform rather than real-money gambling, but that is the operator’s characterization—not a finding by a Florida agency or court about the legality of its specific games and prize mechanics.

Stake’s terms describe Gold Coins as virtual currency for Standard Play, with no monetary value or prize redemption, and Stake Cash as sweepstakes entries for Promotional Play. They state: “THE PLATFORM AND GAMES DO NOT OFFER REAL MONEY GAMBLING, AND NO ACTUAL MONEY IS REQUIRED TO PLAY.” These descriptions explain the company’s stated structure; they do not independently settle how Florida law applies.
What Florida’s sweepstakes-promotion rules cover
Florida Statutes §849.094 addresses game promotions involving chance and prizes that are conducted in connection with, and incidental to, the sale of consumer products or services. It does not, by itself, resolve whether every sweepstakes casino or a particular platform falls within its scope. Read Florida Statutes §849.094.

For qualifying promotions with total prizes valued above $5,000, the Florida Department of Agriculture and Consumer Services (FDACS) says operators generally must file at least seven days before the promotion begins. A surety bond or trust statement may also be required, subject to the agency’s stated exception. This is a requirement for promotions covered by the statute, not proof that Stake.us is covered or that the state has approved its model. See FDACS game-promotion guidance.
FDACS further says that accepting a filing is not an endorsement, approval, or recommendation, and compliance with the promotion rules does not authorize an activity or shield it from other laws.

Who can answer a Stake.us-specific legality question?
FDACS says it does not regulate internet casinos. Its FAQ states: “No, FDACS does not have regulatory authority over these activities/entities.” The department advises contacting local law enforcement or consulting private legal counsel to determine whether a particular operation is legal. Read the FDACS FAQ.
Florida’s Chapter 849 contains gambling provisions, including §849.14 concerning wagers on contests of skill, but the chapter page does not analyze Stake.us’s specific model. Read Florida Statutes, Chapter 849.

What to check before relying on access
- Review the live terms: Check the current excluded-state list and any general restrictions before participating; Stake reserves the right to update its terms and exclude additional jurisdictions.
- Separate access from legality: A site loading or an account being available does not establish that participation is lawful for you.
- Get individual advice if needed: The cited Florida guidance does not decide Stake.us’s status. For a personal legal conclusion, consult a Florida attorney.
- Do not evade location rules: Stake’s terms prohibit circumvention of territorial restrictions.
