A company’s ability to use your voice depends on what it does with the audio, where you are, the notice and permission you received, the recording’s retention and deletion, and whether the speaker is a child. Training an AI model and creating a voiceprint to identify you are different uses with different legal questions.
The short answer: possession is not unlimited permission
A company may be able to process a recording you supplied, but a recording’s existence does not by itself authorize every later use. The relevant facts include the collection notice, the purpose originally described, any separate opt-in or written release, the speaker’s location, the company’s role, retention and deletion practices, and whether the company creates a biometric template.

“AI training” usually means retaining or processing audio to build, tune, test, or evaluate a model. “Identification” means analyzing vocal characteristics to recognize, verify, or identify a speaker, often by creating or matching a derived template. One recording can be used for both purposes, and each use can raise separate notice, permission, security, retention, and deletion issues.
This is a general explanation, not an individualized legal conclusion. A dispute turns on the law that applies to the speaker, the company, the product, and the specific data lifecycle.

Recording, voiceprint, and model: three different things
The raw recording
The raw recording is the audio file or stream: your words, pauses, background sounds, and other information captured by a microphone. A company might keep it, transcribe it, send it to a service provider, let employees review it, or use it as an input to a machine-learning system.
A derived voiceprint or template
A voiceprint is a derived representation of vocal characteristics intended to recognize or identify a speaker. It is not interchangeable with the original audio. Illinois law expressly lists a “voiceprint” as a biometric identifier and defines biometric information by reference to information based on a biometric identifier that is used to identify an individual. See the statutory definitions in 740 ILCS 14/10.
That definition does not mean every voice recording is automatically a legally regulated voiceprint everywhere. Whether a particular audio file, feature set, or template is covered depends on the applicable law and how the company uses it.
A trained or fine-tuned model
A model is software whose parameters have been adjusted using data. The model may not contain a playable copy of your recording, but the company may still retain the source audio, transcripts, labels, embeddings, logs, checkpoints, or other derived data. Deleting the original file therefore does not automatically answer whether every derivative has been deleted or can be reconstructed.

What “using your voice for AI training” can involve
Training use can range from a narrow quality-improvement workflow to a broad secondary use. A service might use clips to improve speech recognition, classify commands, test noise handling, or fine-tune a model for a new product. The important question is not merely whether the company says “AI improvement,” but what data is used, for what purpose, and under what controls.
- Collection and storage: Is the complete audio retained, or is it discarded after a transcript or feature extraction?
- Human access: Can employees or contractors listen to samples, and what access controls and review procedures apply?
- Sharing: Are recordings sent to processors, affiliates, researchers, or other vendors?
- Scope: Is the use limited to the service you requested, or does it include future products, advertising, or general model development?
- Deletion: Can you delete the source recording, transcript, labels, embeddings, and training or evaluation copies?
The Federal Trade Commission’s June 2023 “Hey, Alexa!” business blog described allegations that Amazon used Alexa voice recordings to train algorithms and discussed acquisition, retention, access, deletion, and data-derived products. The example is enforcement context and a description of allegations; it is not a rule that every company’s training practice is lawful or unlawful. The FTC’s Commissioners stated that “machine learning is not a license to break the law.” Read the agency’s account at the FTC blog.
How speaker identification changes the legal question
Identification systems extract vocal features and compare them with a stored reference. A system might verify that a person is the account holder, search a database for a likely match, or flag a voice for human review. The system may store a voiceprint, an embedding, a template, or another representation rather than the full recording.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesIdentification can trigger biometric-specific duties in jurisdictions that regulate biometric identifiers. Illinois’s Biometric Information Privacy Act (BIPA), for example, names a voiceprint in its definition of biometric identifiers. Section 15 addresses collection, disclosure, retention, and destruction requirements for covered biometric identifiers and information; consult the current statutory text at 740 ILCS 14/15. The exact scope, exceptions, amendments, and relevant case law matter for any Illinois dispute.

A company may therefore face different questions for the same clip: whether it could retain the audio, whether it could derive a voiceprint, whether it gave the required notice, whether a specific written release was required, how long the template is kept, and whether it is shared or used for a new purpose.
Which rules may apply?
Illinois biometric requirements
For covered conduct, BIPA requires a written release before a private entity collects or otherwise obtains covered biometric identifiers or biometric information, and it includes public retention schedules and destruction guidelines. Do not assume that every recording meets the statute’s definitions or that a policy statement substitutes for the required release. Location, entity, purpose, and statutory exceptions must be checked against the current law.
European Union GDPR
For processing subject to the GDPR, an organisation must identify an appropriate legal basis before processing personal data. Consent is one of six possible bases, not the only one. The European Data Protection Board explains that the correct basis depends on the processing context in its legal-basis guidance.
That framework does not automatically validate a company’s voice processing. The organisation still needs to match the chosen basis to the actual purpose, provide the required information, and comply with any additional rules that apply to biometric data, children, international transfers, retention, access, or deletion.

U.S. consumer-protection enforcement
The FTC can examine whether a company’s statements and practices are unfair or deceptive, including claims about privacy, deletion, access, or AI improvement. The agency’s May 18, 2023 biometric policy statement describes biometric information as sensitive and identifies potential misuse risks. It is an agency policy and enforcement framework, not a statute that independently resolves every voice-recording question. See the FTC policy statement.
Children’s recordings and COPPA
Under the FTC’s COPPA guidance, an audio file containing a child’s voice is personal information. For a covered operator, verifiable parental consent is generally required before collecting it. The FTC described a narrow policy for a temporary voice recording used solely to replace written words in a search or command: the file must be held briefly, used only for that purpose, and covered by clear collection, use, and deletion-policy notice. It cannot be repurposed before destruction. The October 2017 guidance is at the FTC’s COPPA announcement.

Use the following sequence before deciding whether a company’s conduct was permitted. Keep copies of the relevant policy, consent screen, email, and support responses; wording and settings can change.
Recommended Free Tools
- Pin down the people and places. Record where the speaker was located, where the company is established, and whether a vendor or call-center operator handled the audio. These facts can change the applicable rules.
- Capture the collection notice. Save the spoken notice, app screen, terms, privacy notice, and any separate checkbox or written release shown before recording. Note whether the notice mentioned training, personalization, human review, identification, authentication, sharing, or retention.
- Ask what data exists. Request a plain-language inventory: original audio, transcript, labels, embeddings, voiceprint or template, logs, backups, and model-training or evaluation copies.
- Separate the purposes. Ask whether the audio was used to provide the requested service, train or fine-tune a model, test a system, authenticate an account, identify a speaker, or create a product for another customer.
- Check access and sharing. Ask which employees, contractors, processors, affiliates, or other parties could access the recording or derived data, and what controls and audit procedures apply.
- Check retention and deletion. Find the retention period for each data type, the deletion method, exceptions for backups or legal holds, and whether a deletion request reaches derived datasets, templates, and model-development copies.
- Look for a user control. Determine whether a setting, opt-out, or separate choice controls AI-improvement use. Record when you changed it and what the company says happens to data already collected.
- Match the facts to the jurisdiction. If the speaker is in the EU, compare the stated processing to the organisation’s GDPR legal basis. If the speaker is in Illinois, examine whether a covered voiceprint or biometric-information collection occurred and whether the required written release and retention disclosures were provided. For a child, assess whether COPPA applies.
What to ask before allowing a voice feature
- Will the company keep the raw recording, or only a transient signal?
- Will it create a voiceprint, embedding, or other speaker template?
- Is the audio used for model training, fine-tuning, testing, or human quality review?
- Can the company identify me from the voice, or is it only responding to words?
- How long are recordings and derived data retained?
- Can I delete both the source audio and data derived from it?
- Are service providers or other companies allowed to use the data for their own models?
- Is a separate opt-in, written release, or parental consent required?
A privacy-policy statement may explain a practice, but it is not automatically equivalent to consent where a law requires a specific written release or another legal basis.
Best Value
If you object to the use
Start with a written request to the company’s privacy or support contact. Identify the account, approximate recording date, device or service, and the exact uses you are questioning. Ask for the categories of data held, purposes, recipients, retention periods, deletion procedure, and whether a voiceprint or model-derived representation remains after deletion.
Do not assume that an immediate account deletion erases every copy. Ask specifically about transcripts, annotations, embeddings, templates, backups, and training or evaluation datasets. If the response is incomplete, preserve the evidence and consider the regulator or complaint route available where the speaker lives. A lawyer can assess deadlines, statutory requirements, and remedies for a particular jurisdiction.
What the FTC examples do—and do not—show
The Alexa matter illustrates why the data lifecycle matters: the FTC blog discussed allegations involving algorithm training, children’s recordings and transcripts, employee access, retention, and deletion rights. Those allegations show the kinds of practices regulators scrutinize; they are not a finding that every voice assistant or every company has the same facts.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
The COPPA guidance similarly illustrates a narrow exception, not a general permission to retain children’s voices. A short-lived command recording collected solely to substitute for written text must still be covered by notice and a deletion policy, and it cannot be put to another use before destruction.
Training versus identification at a glance
| Question | Training a model | Identifying a speaker |
|---|---|---|
| Main activity | Using audio to build, tune, or evaluate a model | Deriving or matching vocal characteristics to recognize or verify a person |
| Central legal question | Was the recording obtained and reused consistently with notice, applicable law, and consumer rights? | Does the system create or use a covered biometric identifier, such as a voiceprint under Illinois law? |
| Lifecycle to investigate | Source audio, transcripts, labels, access, retention, deletion, and derived model data | Template creation, matching, protection, sharing, retention, and destruction |
| Important limitation | “AI improvement” does not erase privacy obligations | Not every audio recording is automatically a voiceprint under every law |
Bottom line
Companies can sometimes use voice recordings for AI training or speaker identification, but neither use receives a universal pass. Determine whether the company retained raw audio, trained or fine-tuned a model, created a voiceprint, or used the voice to authenticate or identify someone. Then evaluate the notice, permission or legal basis, jurisdiction, child-specific rules, access, retention, deletion, and sharing. Those details—not the label “AI”—decide the real privacy question.
