Can Border Agents Search Your Phone Without a Warrant? What U.S. Travelers Should Know

Generally, yes. At a U.S. port of entry, Customs and Border Protection (CBP) can search a traveler’s phone without first getting a warrant. But the method matters: CBP distinguishes a manual review from an equipment-assisted search, and its policy sets a higher threshold for the latter. Courts also differ on how the Constitution applies to more intrusive searches, and the Supreme Court has not set a phone-specific rule for searches at the border.

Where this rule applies—and what “without a warrant” means

This article concerns searches by CBP at U.S. ports of entry, such as when travelers arrive in the country. The border-search exception is different from the rules that generally apply to police searches inside the country. A border search may proceed without a warrant, but that does not mean every search method is treated alike or that every search is automatically lawful.

It helps to separate two questions: whether officers need a warrant, and whether they need individualized suspicion. Recent appellate decisions have rejected a general warrant requirement for phone searches at the border. For brief manual searches, the Fourth and Seventh Circuits have also said individualized suspicion is not required under their precedents. More intrusive forensic searches raise a distinct issue, and the constitutional limits can depend on the federal circuit and the facts.

CBP’s two categories of device search

CBP’s public guidance distinguishes a “basic” search from an “advanced” search. These are agency policy categories; they should not be mistaken for a single nationwide constitutional rule.

CBP category What CBP describes CBP policy threshold What courts say
Basic search An officer manually reviews device contents without external equipment. CBP’s published guidance does not state an individualized-suspicion threshold for a basic search. The Fourth Circuit and Seventh Circuit have treated manual searches as routine when applying their respective precedents. The Fourth Circuit has noted that an unusually lengthy or intense manual search may raise other Fourth Amendment questions. Fourth Circuit, United States v. Belmonte Cardozo (July 13, 2026); Seventh Circuit, United States v. Eta (July 6, 2026).
Advanced search CBP connects external equipment to review, copy, or analyze device contents. CBP policy requires reasonable suspicion of a violation of a law CBP enforces or administers, or a national-security concern, plus prior approval from a senior manager at Grade 14 or equivalent. The Fourth Circuit treats forensic searches as nonroutine under its precedent. The constitutional standard for forensic searches is not settled nationwide by a Supreme Court ruling specifically about phones at the border. CBP’s device-search guidance; Belmonte Cardozo.

CBP says travelers must present electronic devices and the information resident on them in a condition that allows examination. That statement describes CBP’s guidance; it does not, by itself, establish the precise legal consequences of declining access for every traveler or circumstance. Those consequences are not addressed here as a categorical rule.

What the appellate cases establish—and what they do not

Manual searches

In United States v. Belmonte Cardozo, the Fourth Circuit said routine border searches do not require individualized suspicion and held that manual phone searches fall into that category under its precedent. The opinion distinguished forensic searches, which can recover deleted material and create a durable copy. It also recognized that an unusually lengthy or intense manual inspection may present a separate constitutional question.

In United States v. Eta, the Seventh Circuit applied its precedent that brief manual searches of electronic devices at the border require no warrant, probable cause, or individualized suspicion. The court referred to an approximately half-hour manual search in an earlier case as a typical brief procedure. That description is not a universal time limit for every border search.

Forensic searches and differences between circuits

The Fourth Circuit’s treatment of forensic searches as nonroutine is a rule under that circuit’s precedent, not a nationwide Supreme Court holding. A September 2026 Second Circuit opinion, United States v. Alisigwe, and its dissent illustrate continuing disagreement about the constitutional balance. A dissent is not the court’s holding. Together, these cases counsel against assuming that one appellate court’s rule governs every port of entry.

The Supreme Court has not directly decided the constitutional standard for searching a phone at the border. Riley v. California, which concerned searches of phones incident to arrest, is not itself a ruling about border searches. A traveler’s location and the search method can therefore matter when assessing which court’s precedent applies. See the Second Circuit’s United States v. Alisigwe opinion (September 17, 2026).

How common are device searches?

CBP reports that in fiscal year 2024, fewer than 0.01 percent of arriving international travelers encountered by CBP at a port of entry had electronic devices searched. The figure is limited to that year and that denominator; it does not describe every border encounter or later years. CBP, “Border Search of Electronic Devices at Ports of Entry”.

How travelers can prepare

  • Carry less sensitive data when practical. Review what is stored locally on the device and remove data you do not need for the trip. This is general privacy hygiene, not a guarantee that a device will not be searched.
  • Back up important information. Keep a secure backup before traveling so that losing access to a device does not also mean losing the only copy of important files.
  • Follow work and client procedures. If a device contains employer, customer, or client information, check the relevant cross-border data-handling rules before departure.
  • Do not treat accessories as a legal solution. A privacy screen or signal-blocking pouch does not change CBP’s search authority or reliably prevent an inspection.
  • Get advice for a specific high-stakes situation. If your device is seized, or you face potential immigration or criminal exposure, consult a qualified lawyer. Do not assume that refusing access has no consequences, and do not lie to or obstruct officers.
