Can an Indian YouTube Channel Stream Licensed Bhajans Overnight Without a Claim?

Not reliably. A licence may give you permission to use a bhajan recording, but it does not guarantee that YouTube will leave an overnight livestream uninterrupted or claim-free. YouTube scans live streams for third-party matches and says a stream can be interrupted even when you have a licence if the rights holder has not added your channel to its Content ID allowlist. A replay may also receive a Content ID claim after the live broadcast ends.

Why a licence may not prevent a YouTube interruption

YouTube Help says it scans live streams for third-party content. When it identifies a match, it may replace the stream with a placeholder, issue a warning, temporarily interrupt the stream, or terminate it if the matched content remains. YouTube also warns that a licensed stream can still be interrupted when the channel is not on the relevant rights holder’s Content ID allowlist.

As an Amazon Associate I earn from qualifying purchases.

That is a platform-enforcement issue, not a ruling that your use is legally infringing. A Content ID match or claim and a legal finding of infringement are not interchangeable. But an overnight programme is exposed to practical disruption if a match is detected and remains in the stream.

Ask each relevant rights holder, or its Content ID administrator, to allowlist the exact YouTube channel before scheduling the broadcast. YouTube’s guidance is explicit: “If your channel isn’t added to their allowlist, your live stream can be interrupted even if you’ve licensed the third-party content.” Allowlisting is not a substitute for obtaining permission, and no licence or allowlist can guarantee that YouTube will never detect or interrupt a stream.

Identify every right in each bhajan recording

A recording can involve separate rights in the sound recording and in the underlying musical and literary works, including the composition and lyrics. Who controls those rights depends on the particular track and its contracts. Permission from one party may not clear the others.

What you plan to use What to verify
The particular recorded performance Identify the sound-recording owner or administrator and obtain permission covering the planned YouTube use.
The composition and lyrics embodied in the recording Identify the relevant rights holders or administrators. IPRS says its licences cover musical and literary works in its repertoire; it does not, by that fact alone, establish permission for the sound recording.
A track listed in the IPRS database Check the database and contact IPRS if needed, but do not treat a missing entry as proof that no rights exist: IPRS says its public database may not be exhaustive.

IPRS explains that using a sound recording can also use the underlying musical and literary works. It says sound-recording rights may need to be obtained from the recording owner or administrator, which may include a recording company or an administrator such as PPL or Novex. The controlling parties vary by track, so confirm rather than assume that one organisation can clear the entire programme.

Get written permission for the exact broadcast and replay

Before going live, review the written licence against the actual schedule and channel. It should clearly cover the intended use, rather than simply saying that you may use or perform the music. Confirm the following for every recording or repertoire covered:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Platform and use: communication to the public through a YouTube livestream, including use as continuous or overnight programming.
  • Territory: whether permission covers India only or worldwide availability. A territorial restriction does not replace the need for a Content ID allowlist.
  • Duration: the complete overnight broadcast and any repeat or continuing use you plan.
  • Revenue model: whether the licence covers monetization, YouTube ads, sponsorship, or any other revenue connected with the stream.
  • Replay: whether the completed livestream may remain available as an archive, and for how long. Permission for a live event does not automatically establish permission for later hosting or repackaging.
  • Content ID handling: which channel ID must be allowlisted, who will submit the request, and how any mistaken match or claim should be handled.

Keep the signed permission, track list, correspondence, and any instructions for releasing a claim accessible to the person monitoring the stream. A general licence, an invoice, or an assurance that a song is devotional is not a substitute for confirming that the specific rights and uses are covered.

Do not assume an online-event tariff covers an overnight music feed

IPRS publishes an online live-events tariff covering public performance in live-streamed online events involving live music, music videos, or DJ sound recordings. Its terms put responsibility on the licensee to obtain additional rights required by law, state that the tariff does not cover synchronization licensing, and say later hosting or repackaging requires a separate applicable licence. The document says it is subject to member approval and applies from 1 July 2020. Confirm with IPRS whether the current terms and category fit a continuous overnight bhajan stream before relying on that tariff.

The tariff document lists these minimum per-event amounts and says the fee is the greater of 5% of gross revenue and the applicable minimum. These are figures in the document applicable from 1 July 2020, not a verified current quote for a proposed overnight stream; confirm current rates, scope, taxes, and eligibility with IPRS.

Free, ad-supported, or ticketed without a sponsor Up to two hours ₹20,000
Free, ad-supported, or ticketed without a sponsor More than two hours ₹30,000
Sponsored or sponsor-backed ticketed event Up to two hours ₹60,000
Sponsored or sponsor-backed ticketed event More than two hours ₹1,00,000

The tariff’s event categories and terms do not establish that it applies to every always-on music feed. A tariff payment also would not by itself prove that separate sound-recording rights, replay rights, or Content ID allowlisting are in place.

Does the religious-ceremony exception cover an overnight YouTube stream?

The Copyright Office’s summary of section 52 describes an exception for performance or communication of a literary, dramatic, or musical work or sound recording in the course of a bona fide religious ceremony. That description is limited. It does not establish that every devotional broadcast, monetized stream, or 24-hour music feed qualifies, and it does not resolve whether a particular channel’s programme is a bona fide ceremony.

Do not rely on the exception simply because the recordings are bhajans or the channel has a religious purpose. Whether it applies depends on the specific facts and law. If you intend to rely on it, get advice on the exact programme and its circumstances before broadcasting.

Pre-stream clearance checklist

  1. Inventory the programme: make a track-by-track list, identifying each recording and the underlying composition and lyrics as far as possible.
  2. Trace the rights: confirm the sound-recording owner or administrator and the relevant musical and literary rights holders. Check the IPRS repertoire database, but do not treat absence from it as conclusive.
  3. Match permission to use: obtain written confirmation for YouTube livestreaming, the territory, overnight duration, monetization or sponsorship, and any archived replay.
  4. Arrange allowlisting: ask the relevant rights holder or Content ID administrator to add the exact channel before going live; retain confirmation and claim-handling instructions.
  5. Assign a monitor: have someone able to check YouTube Studio during the broadcast and respond to a warning, restriction, or interruption using the platform’s instructions.
  6. Verify the replay separately: after the broadcast, check the archived video and its restrictions. A stream that had no on-air warning can still receive a Content ID claim after it ends.

If YouTube interrupts the stream or claims the replay

  • A live warning or interruption appears: check YouTube Studio for the specific restriction or notice. Follow YouTube’s directions and remove or stop the flagged content as instructed; do not simply restart the same programme on the assumption that your licence will prevent another interruption.
  • You have permission but the channel was not allowlisted: contact the rights holder or its Content ID administrator with the exact channel details and request allowlisting. Keep the written licence available, but do not assume it will automatically clear a live match.
  • A replay receives a claim: compare the claim with the written licence’s archive terms and the track list. Use YouTube’s resolution process only with a sound basis and the documentation required for the specific claim.
  • One organisation says it cleared the music: ask whether that clearance includes the sound recording as well as the composition and lyrics, and whether it covers both livestreaming and replay. A gap in any one of those areas can leave the use uncleared.
  • You are unsure whether a tariff or legal exception applies: pause the planned use until the relevant organisation or a qualified adviser confirms the scope for your actual programme.

A stream without an interruption is not proof that the rights were cleared, and an interruption is not by itself a court determination of infringement. Treat platform status, permissions, and legal advice as separate questions.

Or let it run in the cloud

If the recordings are cleared and you want the YouTube stream to continue without keeping a home computer on, StreamNeo runs uploaded videos from the cloud: upload the recording or build a playlist, add your YouTube stream key, and go live. It plays uploaded videos to YouTube; it does not clear music rights or prevent a rights holder or YouTube from making a claim. Nothing has to stay on at home; uploads stream as made, up to 4K 60fps, at one price per slot; StreamNeo automatically recovers if YouTube drops the stream. The first day is free with no card, one free day per account. Monthly pricing is $9.99 per month.
