No—an AI tool is not itself an authorized prescriber. In the United States, AI may help organize health information or suggest options for a clinician to consider, but that is not the same as issuing a prescription. You may be able to get a prescription through telehealth without an in-person visit, but an authorized clinician—not the AI—must prescribe it and meet applicable requirements.
What counts as an AI prescription?
A medication suggestion is not a prescription. A chatbot that names a drug, estimates a dose, or says a medicine might help has not thereby created a valid prescription. Prescribing is a clinical and legal act by an authorized practitioner; an AI-generated answer does not become one just because it sounds specific or appears in a health app.

AI can still be involved in care. A tool might summarize a patient’s reported symptoms, flag a possible drug interaction, or present treatment options to a clinician. The clinician evaluates the information, applies professional judgment, and decides whether to prescribe. The key distinction is who makes and authorizes that decision.

The FDA’s Clinical Decision Support Software Guidance, dated January 29, 2026, addresses how particular software functions may be treated under federal medical-device law. It does not grant prescribing authority to AI. Some clinician-facing decision-support functions may fall outside the device definition if they meet statutory criteria; other software functions may remain medical devices subject to FDA oversight. The classification depends on the function and its intended use, not simply on whether a product uses AI.

Clinician-facing recommendations
FDA describes relevant non-device clinical decision support as software that provides recommendations to health care professionals rather than a specific output or directive, does not replace or direct the professional’s judgment, and enables the professional to independently review the basis for the recommendation. Examples on the FDA’s Digital Health Policy Navigator include evidence-based clinician order sets and drug-interaction or allergy notifications.
Patient-facing answers and specific directives
FDA says software intended for patients or caregivers does not meet the cited statutory criterion for software limited to supporting or providing recommendations to health care professionals. The agency also identifies software that provides a specific preventive, diagnostic, or treatment course or directive as an example that does not satisfy that clinician-facing criterion. That does not, by itself, determine the regulatory status of every patient-facing tool; the specific function and intended use matter.

In practical terms, a patient-facing AI answer should not be treated as a clinician’s order, and a clinician-facing decision aid should not be confused with an autonomous prescriber. FDA’s software criteria address regulatory treatment of functions; they do not establish that every tool making medication-related recommendations is FDA-approved.

AI-assisted care versus a prescription
| What happens | Who receives or makes the decision | Is it a prescription? |
|---|---|---|
| An AI explains general medication information or responds to a patient’s question | The patient receives the output; no clinician decision is implied | No. It is information, not an authorized prescription. |
| Software flags an interaction or offers options for a clinician to review | A health care professional receives decision support and must assess its basis | No. The software’s recommendation is not itself the clinician’s prescribing decision. |
| A clinician evaluates a patient in person or through telehealth and authorizes medication | An authorized practitioner makes the clinical decision | Potentially, if applicable prescribing, licensing, and other requirements are met. |
Can you get a prescription without an in-person doctor visit?
Sometimes. Telehealth can connect a patient with an authorized practitioner who may prescribe when applicable federal and state requirements are met. That is different from getting a prescription from AI: the remote visit changes how the clinician evaluates the patient, not who holds prescribing authority.

HHS says a DEA-registered practitioner may prescribe Schedule II–V controlled substances through telemedicine without first conducting an in-person medical evaluation when the required conditions are met. HHS also reports that the federal telemedicine flexibilities for controlled-medication prescriptions have been extended through December 31, 2026. These provisions concern authorized practitioners and controlled substances; they do not create a blanket rule for every medication, state, telehealth visit, or AI service. State law and the circumstances of care can also matter.
How to assess an AI medication tool
Do not infer that a tool can prescribe—or that FDA has approved it—from labels such as “AI doctor,” “AI pharmacist,” or “prescription assistant.” Look at what the software actually does and who is responsible for the decision.

- Who gets the output? Is it presented to a patient or caregiver, or to a health care professional?
- What does the output do? Does it provide information or options, or issue a specific treatment directive?
- Who retains clinical judgment? Can a qualified professional independently review the basis for a recommendation and make the decision?
- Who authorizes the prescription? If medication is prescribed, identify the authorized practitioner and the care pathway—not just the software brand.
- What rules apply? Requirements may depend on the medication, state, and whether controlled substances are involved.
The reviewed federal sources do not establish the regulatory or prescribing status of any particular AI product. Check the service’s stated clinical process and verify whether an authorized clinician is involved before relying on it for treatment.
What to do if an AI recommends medication
- Do not start, stop, or change a prescription solely because an AI recommended it. A tool may lack important information about your diagnoses, allergies, other medicines, or circumstances.
- Ask a licensed health care professional to assess the recommendation. Share the exact medication, dose, and the context in which the AI suggested it.
- For a new prescription, confirm who is prescribing. A telehealth clinician may be able to evaluate you remotely, but the clinician—not the AI—must make and authorize the prescribing decision.
- For a possible urgent reaction or emergency, seek timely medical help. Do not wait for an AI response to manage a serious or rapidly worsening condition.
What the rules do not establish
FDA’s guidance is about software functions and medical-device regulation, not a universal approval or ban covering every AI health product. HHS’s telemedicine extension concerns controlled substances and authorized practitioners, not all prescriptions. The federal sources discussed here do not settle each state’s licensing and prescribing rules or establish the status of a named AI prescribing service.
