It cannot safely copy the source game’s expressive implementation—such as code, artwork, music, dialogue, characters, animations, or audiovisual sequences—without permission or a strong legal defense. AI does not create a blanket copying exemption. Fair use, trademark, patent, contract, publicity, and platform rules can change the analysis.
This is a U.S.-focused explanation, not case-specific legal advice. Rules can differ in other countries and can change through legislation or court decisions.

The basic line: mechanics are not the same as expression
U.S. copyright law separates an idea or system from the particular way a creator expresses it. Section 102(b) of Title 17 states: “In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery.” A game mechanic considered as a rule or method—matching tiles, jumping over hazards, managing resources, taking turns, or advancing through levels—is usually on the unprotected side of that line.

The implementation can still be protected. The source code that runs the mechanic, the written rules and tutorial text, the level layouts and artwork, the characters, animation timing, sound effects, music, dialogue, and the audiovisual presentation may contain copyrightable expression. Two games may independently use a health bar, a three-lane runner, or a deck-building loop. That does not give either developer permission to copy the other game’s sprites, code, soundtrack, or distinctive story.

The practical question is therefore not “Did the new game use the same mechanic?” It is “What expression was taken, from what source, with what permission, and how recognizable is the result?”
Examples of functional ideas
- A rule that three matching symbols clear from a board.
- A turn order in which players collect resources, build, and attack.
- A progression loop in which a character earns experience and unlocks abilities.
- A camera perspective, control scheme, or high-level objective considered as a method of operation.
Examples of expressive material
- A particular source-code segment, shader, script, or decompiled routine.
- Character drawings, 3D models, textures, interface artwork, and animation files.
- Music, sound recordings, voice lines, dialogue, quest text, and fictional lore.
- A distinctive sequence of scenes, level art, cinematics, or other audiovisual compilation.
Which parts of a game can be protected?
A commercial game commonly contains several overlapping works. Section 102(a) identifies literary, musical, dramatic, pictorial, graphic, sculptural, and audiovisual works as copyright subject matter. The Copyright Office treats video games as examples of audiovisual works for registration purposes. Protection applies only to original expression, not to every functional constraint or commonplace element.
Code and scripts
Computer programs are generally treated as literary works. An AI system that reproduces a recognizable portion of a game’s source code, comments, variable structure, or distinctive implementation may create infringement risk even if the final game changes the user interface. Reimplementing the same behavior from a mechanic’s description, without copying source files or nonfunctional expressive structure, is a different situation. Decompiling, extracting, or feeding proprietary code into a model can also violate a license or confidentiality agreement, independent of copyright.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesArt, models, interfaces, and animation
Sprites, concept art, textures, models, user-interface graphics, and animation frames are pictorial or graphic expression. A prompt that produces a nearly identical character, logo-like emblem, map, or texture does not become lawful merely because a model generated the pixels. Similarity in a genre convention—such as a space helmet or medieval sword—is less significant than copying a distinctive combination of shapes, colors, costume details, pose, and other expressive choices.
Music, sound, writing, and story
Original compositions, sound recordings, dialogue, item descriptions, cut-scene scripts, and fictional settings can have separate rights. Recreating a recognizable melody, voice line, paragraph, character backstory, or sequence of scenes can be risky even when the gameplay is new. A model’s output should be checked for memorized or unusually specific material before release.

The audiovisual game as a whole
The player’s presentation—how scenes, camera movement, animation, sound, and interface elements are arranged—may be protected as an audiovisual compilation. Reproducing a famous opening sequence, a distinctive boss introduction, or a near-identical set of screens can raise a stronger claim than sharing an abstract rule.
What AI changes—and what it does not
The U.S. Copyright Office’s Part 2 report on artificial intelligence, released January 29, 2025, distinguishes authorship of new material from infringement of existing material. AI assistance or the inclusion of AI-generated material in a larger human-created work does not automatically prevent copyright protection. Human-authored portions that are perceptible in the finished work, plus creative human selection, arrangement, or modification, can support protection. Material determined entirely by a machine is not protected simply because someone wrote a prompt.

That authorship rule answers who may claim rights in your new game; it does not grant permission to copy a source game. If a model outputs recognizable protected art, code, music, characters, or dialogue, ordinary infringement analysis still applies. A human editor cannot make an unauthorized copy lawful merely by touching it up.
The Copyright Office received more than 10,000 responsive comments for its AI work. Questions about training models on copyrighted works, licensing, and allocation of liability remain policy and legal issues rather than settled nationwide rules. Do not assume that a model provider’s terms, a “generated” label, or a commercial subscription guarantees that training data or outputs are cleared for your particular release.
Can you train an AI on game art or code?
Training and output are separate issues. Copying or uploading game files may be restricted by copyright, an end-user license agreement, trade-secret law, or a nondisclosure obligation. A developer who owns the files, has a license that permits machine learning, or uses public-domain or expressly authorized data has a stronger position than someone who scrapes proprietary assets.

U.S. law has not produced a single, blanket answer that makes all training on copyrighted games lawful or unlawful. The purpose of the use, the copies made during training, the source’s terms, the resulting market effects, and the model’s behavior can matter. Keep a record of where training material came from, what permissions apply, and which model terms govern commercial use. If you cannot explain the provenance of a dataset, do not treat it as cleared.
When can fair use help?
Section 107 lists criticism, comment, news reporting, teaching, scholarship, and research as examples of purposes that may qualify as fair use. It does not create an automatic exception for AI, games, or “transformative” prompts. Courts weigh all relevant facts, including the purpose and character of the use, the nature of the original work, the amount and importance of what was taken, and the effect on the potential market.
A review video that shows short clips while analyzing design choices presents a different risk profile from a commercial game that ships another developer’s characters, textures, music, or levels. A parody or research prototype may have arguments that a market-substituting release lacks, but commerciality alone does not decide the issue. Changing colors, adding a new story, or running copied assets through an AI tool does not by itself create permission. The Copyright Office’s fair-use guidance explains that only the copyright owner may authorize a derivative version unless a defense such as fair use applies.
If your project depends on fair use, identify exactly what is taken, why it is needed, how much is used, and why the use does not substitute for the original. Obtain legal advice before launch rather than treating fair use as a design shortcut.
Other rights can restrict a supposedly “legal” clone
Copyright is only one layer of analysis. A project can avoid copyright infringement and still create other problems.

- Trademark: Names, logos, slogans, and source-identifying symbols can cause confusion about sponsorship or affiliation. Do not use another game’s title or branding to market your own.
- Trade dress: A distinctive combination of visual features, menus, packaging, or presentation may signal a source even when individual elements are commonplace.
- Patents: A patent may cover a particular technical method or gameplay-related system for its term. Copyright’s idea exclusion does not cancel a valid patent.
- Contracts and licenses: End-user licenses, developer agreements, marketplace terms, and model-provider terms may prohibit copying, scraping, reverse engineering, or commercial redistribution.
- Publicity and privacy rights: A character or performer’s recognizable likeness, voice, or name may trigger state or national rights separate from copyright.
- Platform rules: Console, mobile-store, distribution, and advertising policies can remove a game or listing even when a copyright claim is uncertain.
How different must an AI-assisted game be?
There is no universal percentage, polygon count, or number of altered pixels that guarantees safety. Focus on whether the new work appropriates protected expressive choices that are recognizable in context. A functional resemblance can be acceptable while a different-looking game still infringes if it reproduces a character, scene, music cue, or code structure.
Use this development process to reduce avoidable risk:
- Describe the design in functional terms. Write the mechanic, objective, controls, and progression without naming or depicting the source game’s expressive assets.
- Build from clean inputs. Prefer your own designs, public-domain material, or assets with a license that covers your platform, territory, duration, modification, and commercial distribution.
- Separate references from production files. Keep inspiration boards away from model-training datasets and shipping asset folders. Do not provide proprietary game files to a model unless you have permission.
- Document human decisions. Record who selected, arranged, edited, or redrew AI-assisted material and retain prompts, model version, settings, and source files.
- Run an expression review. Compare characters, environments, interface screens, music, dialogue, animation timing, and code for recognizable similarities—not just the mechanic.
- Clear names and likenesses. Search trademarks, obtain releases where needed, and remove branding or celebrity-like elements that could imply endorsement.
- Keep an audit trail. Store invoices, licenses, contributor agreements, dataset manifests, and takedown or replacement procedures so a disputed asset can be isolated quickly.
Choosing a safer workflow
| Workflow | What you use | Main advantage | Main risk to manage |
|---|---|---|---|
| Independent development | Your own mechanic implementation and original or cleared assets | Best control over provenance and similarity | Accidental resemblance or an unreviewed AI output |
| AI-assisted creation | Models for ideation, drafts, code suggestions, or edits, followed by human review | Speed and iteration while preserving human creative control | Memorized output, unclear training provenance, and limited protection for machine-determined material |
| Licensed reuse | Assets or code supplied under a written license | Defined permission and deliverable terms | Scope limits, attribution, third-party components, or license termination |
| Unlicensed extraction or cloning | Copied files, decompiled code, or near-identical expressive presentation | Fastest apparent replication | High copyright, contract, trademark, and platform risk |
Evaluate each workflow against six questions: what exactly is copied; who owns or licensed the source; how similar is the expression; is the purpose criticism, research, or commercial substitution; what human contribution is perceptible; and which non-copyright rights apply.
Common situations
“I made a game with the same core loop.”
That can be lawful if the code, art, text, sound, characters, and presentation are independently created and no contract or patent blocks the implementation. Keep development records showing how the game was designed and built.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →“The model produced a character that looks like the famous game’s hero.”
Do not ship it on the assumption that generation makes it original. Redesign the silhouette, costume, colors, accessories, pose, name, and backstory, then conduct a human similarity review. Remove logos and other source-identifying details.
Best Value
“I used a few original game screenshots in a review.”
Limited clips used for criticism or comment may have a fair-use argument, but the result is fact-specific. Use only what is reasonably necessary, add genuine analysis, and do not present the footage as a substitute for the game.
“I trained on files from a game I legally purchased.”
Ownership of a copy is not the same as permission to reproduce, extract, reverse engineer, or train on its contents. Read the applicable license and obtain advice if the dataset or planned release is commercial.
When to consult an intellectual-property lawyer
Get advice in the relevant jurisdiction before release if the game uses a named game’s characters or art style, relies on model training with game files, includes decompiled or copied code, imitates a distinctive audiovisual sequence, uses a person’s likeness or voice, or depends on a fair-use theory. Counsel can review licenses, patents, trademarks, contracts, dataset provenance, and a similarity audit together; a copyright-only review may miss the decisive issue.
Practical decision rule
If you are borrowing the rule, redesign the implementation. If you are borrowing a recognizable asset or expressive sequence, obtain permission or replace it. If an AI system made the output, verify both its provenance and its similarity before distribution. Those steps do not guarantee immunity, but they address the distinctions U.S. law actually makes.
