Yes, some AI-enabled medical software can support diagnosis or treatment, but that does not mean a general AI chatbot or symptom-checker app is authorized or proven to do so. In the United States, oversight depends on what a particular software function is intended to do, who uses it, what information it analyzes, and the consequences if it is wrong. FDA guidance current as of October 4, 2026 distinguishes certain lower-risk wellness and clinical decision-support functions from software that may be a medical device.
What “AI health app” can mean
“AI health app” is not a single regulatory category. An app might offer general health information, help someone track a wellness goal, interpret an individual’s symptoms, calculate a patient-specific risk score, recommend treatment, or control a medical device. Those functions carry different implications. The fact that an app uses AI—or runs on a phone—does not by itself determine whether FDA regulates it.

The relevant question is what the app is meant to do in practice. Its marketing claims, inputs, outputs, intended users, and role in care all matter. FDA states: “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.” FDA’s overview of AI-enabled medical devices describes a risk-based approach that considers intended use and technological characteristics.
When an AI app may fall under FDA device oversight
Software functions that analyze an individual’s information and provide a specific diagnostic or treatment output are an important signal of possible FDA device oversight. That could include a patient-specific diagnosis, risk score, treatment plan, or directive. FDA’s software policies are function-specific and platform-independent: software does not escape the device framework just because it is an app, and being an app does not automatically make it a regulated device. The agency focuses on device software functions whose failure could pose a risk to patient safety. FDA’s January 29, 2026 final Clinical Decision Support Software Guidance clarifies which clinical decision-support functions may be excluded from the device definition under section 520(o)(1)(E) of the FD&C Act. Calling a feature “CDS” does not make it exempt. The criteria are conditional and include whether recommendations are for health care professionals, whether the software gives a specific output or directive, how time-sensitive the decision is, and whether the professional can independently review the basis rather than primarily relying on the recommendation. FDA says existing digital-health policies still apply to functions that meet the device definition, including functions intended for patients or caregivers.
The Navigator identifies examples that may fail the non-device CDS criteria, such as specific diagnostic or treatment courses, specific follow-up directives, time-critical alerts, patient-specific treatment plans, and disease-specific risk scores. This is why an app’s actual function matters more than a label such as “AI assistant” or “clinical decision support.”
How wellness and self-management features differ
Some lower-risk functions are treated differently. FDA identifies examples such as tracking caloric intake, coaching to support behavioral change, and helping patients self-manage a disease without specific treatment suggestions. It also says some software that automates simple provider tasks is not a focus of oversight at this time. These examples are not blanket exemptions for every product marketed as wellness software; a patient-specific diagnostic or treatment output may put a function within FDA’s device oversight focus.

FDA’s guidance should be read function by function rather than as a guarantee based on branding. A wellness tracker that records information is not the same as software that interprets the information to tell an individual what condition they have or what treatment to take.
AI-enabled devices can support diagnosis and treatment
AI can be incorporated into devices for medical uses. FDA’s examples include an imaging system that provides diagnostic information for skin cancer, software that sharpens images, systems that detect diabetic retinopathy from retinal images, a sensor that estimates heart-attack probability, and algorithms that automate insulin dosing from continuous glucose monitor readings. These examples establish that AI-enabled device functions can support diagnosis or treatment; they do not establish that an unrelated chatbot or symptom checker has the same intended use, authorization, or clinical validation.
FDA reported more than 1,600 AI-enabled medical devices authorized for marketing in the United States as of September 2026. That is the agency’s device count—not a count of consumer health apps and not an accuracy measure. Depending on the product and its intended use, FDA premarket pathways can include 510(k) clearance, De Novo classification, or premarket approval. A general count of authorized devices cannot tell you whether a particular app works well for a particular person or condition.

How to check an app’s claims
Use the specific function you plan to rely on—not the product’s general AI branding—as the unit of evaluation. These checks can help you understand what a claim does and does not establish; they do not replace a product-specific regulatory determination or professional medical advice.

Identify the condition, task, and intended user: patient, caregiver, or clinician. General education differs from triage, diagnosis support, treatment recommendations, and device control.
- Trace the app’s inputs to its output. Note whether it uses self-entered information, images, sensor signals, or medical-device data, and whether it returns general information or an individual score, diagnosis, or directive.
- Verify any claimed FDA status for the exact product and function. Check that the manufacturer’s claim matches the product identity and pathway in FDA’s public device information. “FDA registered,” “AI-powered,” or availability in an app store is not, by itself, proof of clearance or approval.
- Look for evidence tied to the intended use. Performance evidence needs to match the claimed task and target population. Do not infer an app’s accuracy from another product or from FDA’s overall count of AI-enabled devices.
- Review privacy and data practices separately. Read the app’s privacy notice and check how data is shared, as well as whether the service has a relationship with a covered entity or business associate.
- Check how it handles limits and urgent situations. Look for clear limitations and directions to professional or emergency care when appropriate; do not treat an app’s answer as a substitute for urgent care.
Does HIPAA cover AI health apps?
Not necessarily. HIPAA applicability depends on the app’s role and relationships, including whether a developer creates, receives, maintains, or transmits protected health information for a covered entity or its business associate. Consumer health information held by an app that is not offered by a HIPAA covered entity or business associate may fall outside HIPAA, while other federal protections can still apply.
Device oversight and privacy compliance are separate questions. Depending on the app and its data practices, potentially relevant rules include the FTC Act, the FTC Health Breach Notification Rule, HIPAA Rules, the FD&C Act, and COPPA. The FTC Mobile Health Apps Interactive Tool and HHS health-app resources help explain which frameworks may apply in different circumstances.
Why there is no single accuracy answer
There is no one clinically meaningful accuracy figure for “AI health apps” as a whole. Apps may answer different questions, use different inputs, target different users, and produce outputs with different consequences. The FDA’s reported total of more than 1,600 authorized devices is not an accuracy statistic, and it says nothing by itself about an unnamed symptom checker or chatbot. To assess performance, look for evidence for the exact product, intended use, and population it claims to serve.
