Yes, potentially. In U.S. federal court, a video is not automatically inadmissible because AI created or altered it. The party offering it generally must authenticate it under Federal Rule of Evidence 901, and the video must also satisfy other applicable evidence rules. The result depends on what the video is offered to prove, the foundation for it, the nature of any challenge, and the court’s jurisdiction.
What does “AI-generated video” mean in an evidence dispute?
The label can describe very different exhibits. A party might openly offer a generated reconstruction to illustrate an account or explain other evidence. Or a party might claim that a video is a genuine recording of an event when it was fabricated or materially altered. Courts need to assess the exhibit in light of the claim made for it; the two situations do not raise identical foundation questions.

| What is offered | Central question | Other issues that may matter |
|---|---|---|
| An acknowledged AI-created reconstruction or visualization | Is there an adequate foundation for using this generated material for its stated purpose? | Whether it is illustrative rather than proof that the depicted event actually occurred; whether its methods and assumptions are reliable if specialized analysis is offered. |
| A video offered as a genuine recording of an actual event | Is there evidence supporting the claim that this is the recording it is said to be? | Who or what it depicts, when and where it was made, whether it is complete, and whether the offered copy was altered. |
Neither a realistic appearance nor an allegation that a video is a deepfake resolves these questions by itself. The proponent’s claim and the evidence supporting or challenging it matter.

How is a video authenticated in federal court?
Federal Rule of Evidence 901(a) requires the proponent to produce evidence “sufficient to support a finding that the item is what the proponent claims it is.” Rule 901(b) gives nonexclusive examples of how that foundation can be established, including testimony from a witness with knowledge, distinctive characteristics considered with the surrounding circumstances, and evidence describing a process or system and showing that it produces an accurate result.

For a video, the relevant foundation depends on what the party says the exhibit is. Possible evidence to investigate may include testimony about its source, circumstances surrounding its creation or receipt, records relating to the file, or evidence about a process used to create or handle it. These are potential avenues, not a universal checklist or a guarantee of admission. The applicable rules and the specific dispute control.
Authentication is only one step. The commentary to Rule 901 explains that satisfying authentication “by no means assures admission” because another rule, such as the hearsay rules, may still bar the evidence. A court can therefore find that an item is what its proponent claims and still exclude it on a separate ground.

What if a party claims the video was fabricated or altered?
A concrete challenge and unsupported speculation are not the same. The court must assess the evidence and arguments under the rules that apply in that jurisdiction; a bare assertion that a video “could be AI” does not itself establish that it is fake or dictate one nationwide procedure. Likewise, the proponent’s assertion that a recording is genuine does not settle a properly supported authenticity dispute.

Relevant questions may include what exactly is disputed—identity, timing, location, completeness, or alteration—and what evidence bears on that point. A New York appellate decision, Matter of M.S. (M.H.), discusses competing approaches to video authentication and authorities rejecting unsupported deepfake speculation. Its reasoning is tied to its jurisdiction and facts, not a binding nationwide standard.

When can technical or expert analysis help?
Technical analysis may be relevant when the dispute turns on how a file was created, processed, or changed, but no detector result or metadata review should be treated as conclusive merely because it is technical. The materials cited here do not establish that a particular commercial detector is reliable, or that expert testimony is necessary in every video dispute.
When a party offers expert testimony, Federal Rule of Evidence 702 requires the proponent to show that it is more likely than not that the witness is qualified, the testimony will help the factfinder, it rests on sufficient facts or data and reliable principles and methods, and those methods were reliably applied to the case. The rule governs the admissibility of expert testimony; it does not make every technical conclusion true or automatically authenticate the video itself.

The Federal Evidence Rules Advisory Committee’s November 2025 agenda included a draft Rule 901(c) addressing claims that evidence was fabricated in whole or in part using generative AI. Under the draft, a party alleging fabrication would first need evidence sufficient to support a finding of fabrication and warrant an inquiry; if that threshold were met, the proponent would then have to demonstrate that the item was more likely than not authentic.

The U.S. Courts reported on May 5, 2026, that the committee was evaluating AI-generated and AI-processed evidence, including authentication, reliability, and whether deepfake evidence called for a rule change. Those materials describe a proposal and an ongoing evaluation, not an operative federal Rule 901(c). They do not establish whether a later change was adopted; readers dealing with a current case should check the rule in force and the court’s current guidance.

Why does the court system and location matter?
The Federal Rules of Evidence apply in most U.S. federal proceedings, but they do not make every state court follow identical rules. State provisions and decisions can differ, and the federal examples above should not be treated as a nationwide rule for all courts or as applicable outside the United States.
The November 2025 federal committee agenda also discusses Louisiana civil procedure provisions concerning attorneys’ reasonable diligence to verify evidence authenticity and pretrial discussion of exhibit authenticity and admissibility, including concerns about material suspected to be AI-generated or altered. Those are jurisdiction-specific procedural provisions, not a national evidence rule. The New York decision discussed above likewise should be read in its own legal and factual setting.
What should someone do when a video’s authenticity matters?
- Identify the claim precisely. Distinguish an openly generated illustration from a file offered as an authentic recording, and specify what the video is meant to establish.
- Identify the disputed point. Separate questions about who or what appears, when or where a recording was made, whether it is complete, and whether it was altered.
- Consider the available foundation. Depending on the case, relevant evidence may include a knowledgeable witness, surrounding circumstances, source records, or process evidence. No single item is a universal prerequisite.
- Keep admissibility issues separate. Authentication does not resolve hearsay or other objections; expert testimony, if offered, must satisfy the applicable expert-evidence rule.
- Check the controlling jurisdiction and current rules. Federal rules, state rules, and decisions from other jurisdictions are not interchangeable. For a live case, a lawyer familiar with the relevant court can assess the specific exhibit and procedure.
This is general U.S. legal information, not advice about the admissibility of a particular video or a specific case.
