Yes, an AI chatbot provider may disclose information to police or another government authority in response to valid legal process or, under some providers’ policies, a narrowly defined emergency. That is not the same as automatically reporting every concerning conversation. Safety review, account enforcement, and responding to a government demand are separate processes, and the rules depend on the service, account, location, and applicable law.
What “reporting” can mean
The phrase can describe different actions. A provider may disclose account information or conversation content after receiving a government request. Separately, it may review conversations for safety or enforce its own rules. A safety review or account action does not, by itself, establish that a conversation was sent to police.

- Government request: A provider evaluates legal process and may disclose data covered by a valid request.
- Emergency disclosure: Some policies allow disclosure without waiting for ordinary legal process when a specified, serious and immediate danger exists.
- Safety review: A provider may analyze content or behavior for harmful activity or policy violations, sometimes with human reviewers.
These distinctions matter: a policy that permits disclosure under defined conditions does not say that routine conversations are automatically reported.

ChatGPT and OpenAI
OpenAI’s December 2025 Law Enforcement Policy says the company may disclose user data in response to valid legal process. It also describes a limited emergency route when OpenAI believes disclosure is necessary to prevent danger of death or serious physical injury. The relevant OpenAI entity and process can differ by the user’s location and service.

OpenAI says it generally provides notice before disclosure unless legally prohibited. It may withhold notice in exceptional circumstances, including emergencies where notice could create danger or situations where notice would be counterproductive, such as a compromised account. Its policy describes delayed notice when a legal restriction ends.
The OpenAI Privacy Policy describes other potential sharing circumstances, including legal compliance, safety, fraud prevention, and policy violations. The law-enforcement policy is therefore not the only policy relevant to possible disclosure.

OpenAI also says its systems analyze user content and behavior for policy violations and harmful activity, and that some patterns may be reviewed by a trained team. Its user-safety explanation discusses serious-risk response and crisis resources. This is a separate safety process; it does not establish that every safety flag is sent to police.
Google Gemini
Google says it reviews government requests, may narrow requests it considers too broad, and may object to producing information. The applicable process depends on which Google entity provides the service and the law that applies. Google generally describes notice before disclosure, subject to legal restrictions and exceptions such as account compromise and emergencies. Google’s Gemini Apps Privacy Hub says chats may be processed to meet applicable law, legal process, or an enforceable governmental request. It also says chats may be reviewed for safety and policy enforcement—even when Keep Activity is off or temporary chats are used. Google says those settings do not prevent the described safety review; that statement alone does not establish what the settings change about other data handling.

Anthropic’s help-center explanation of government requests says it evaluates requests for legal validity and may reject ones it considers overly broad or vague. It also describes an emergency exception where imminent physical harm or death may occur and providing information without delay may avert it. The available explanation does not establish a complete account of notice rules, jurisdiction-specific thresholds, or request statistics, so those details should not be inferred.

In that report, non-content requests include account details such as name, email, payment information, and transaction history. Content requests seek material such as text or files entered into or produced through OpenAI services. The figures count OpenAI requests and disclosures during that reporting period; they are not statistics for all chatbot providers and cannot estimate an individual user’s chance of disclosure.
What privacy controls can and cannot tell you
History, activity, and temporary-chat controls are specific to a service and may affect some aspects of data handling. They should not be treated as a blanket promise that no review or disclosure can occur. Google’s Gemini notice, for example, expressly says safety review can still happen when Keep Activity is off or temporary chats are used. The reviewed provider policies do not establish that a VPN, deletion control, temporary chat, or opt-out prevents compliance with a valid demand for data the provider still holds.
- Read the current privacy notice and law-enforcement policy for the exact chatbot and product.
- Check whether you are using a personal account or one managed by a school or employer; managed accounts may have different terms or customer arrangements.
- Look up what a history or activity setting changes, rather than assuming it affects every retention, safety, or disclosure pathway.
- Avoid entering information you would not want handled under that service’s policies.
Why the answer can vary by user
Providers’ policies are not interchangeable. The applicable entity, product, account type, location, and law can affect what process applies and whether notice is possible. The cited materials cover official information from OpenAI, Google, and Anthropic; they do not establish equivalent current rules for every chatbot, managed account, country, or law-enforcement mechanism. Policies and controls can change, so consult the linked provider pages for current terms. This is a privacy-policy explainer, not legal advice.
