Can AI Agents Make Payments Without Human Approval? Safety and Legal FAQs

Yes, an AI agent can technically initiate or complete a payment without a person approving that individual transaction when the payment system accepts the agent’s instructions. That technical capability is not the same as legal authority, valid user consent, or protection from loss. Whether the payment is allowed, who is responsible for an error, and how a dispute is resolved depend on the mandate you gave the agent, the payment provider’s rules, the transaction, and the law in the relevant jurisdiction.

What “without human approval” actually means

There are two very different designs. An agent may prepare a payment for a person to review, or it may be authorized to send the instruction directly to a bank, card network, wallet, or merchant. The second design removes transaction-by-transaction approval, but it does not remove the need to establish who instructed the payment and what the agent was allowed to do.

Preparation-only agents

A preparation-only agent can select an invoice, fill in a payee and amount, and present a confirmation screen. The human remains the final approver. This limits the agent’s ability to move money, but it still requires checking that the displayed payee, amount and purpose match the user’s intent.

Execution-capable agents

An execution-capable agent holds a delegated permission, payment token or other credential that allows it to submit the instruction. It might pay recurring bills, buy an approved category of goods, or rebalance a service account automatically. The payment system can execute the instruction even if the agent is software rather than a person. Execution, however, does not prove that the instruction was within the user’s authority or that the credential was not compromised.

Capability is not authorization

The central distinction in the IMF’s How Agentic AI Will Reshape Payments (Note No. 2026/004, April 2026) is between an agent’s ability to act and the authority behind an action. Authentication asks whether the system is dealing with the expected agent or credential. Authorization asks whether that agent was permitted to make this particular payment. Intent asks whether the payment reflects what the user actually meant.

An agent can therefore make a technically valid payment that is still outside its mandate. Examples include paying the wrong recipient after a prompt-injection attack, exceeding a spending ceiling, buying an excluded product, or using an old instruction after the user withdrew permission. A successful network authorization does not by itself answer those questions.

How an agent payment should be understood

  1. Mandate: The user or business defines what the agent may do, for whom, under which conditions and for how long.
  2. Authentication: The payment participants verify the agent, the account or token it uses, and, where required, the person or business that delegated authority.
  3. Instruction: The agent creates a payment request containing details such as amount, recipient, currency, timing and purpose.
  4. Policy checks: The payment system, the account holder or an independent control evaluates limits, recipient rules, fraud signals and other conditions.
  5. Execution: The payment provider accepts, rejects or holds the request. A hold can route a high-risk or ambiguous transaction to a human.
  6. Records and dispute handling: Systems preserve the delegation, the agent’s instruction, checks performed, execution result and any later changes so the parties can investigate a dispute.

This chain matters because a dispute may concern any link: a stolen credential, a manipulated instruction, a policy failure, or an agent that misunderstood the user’s request.

Is there a universal rule requiring a person to approve every payment?

No universal rule is established by the official material available for this topic. Payment regulation is evolving, and requirements differ by country, payment instrument, consumer or business status, and the particular delegation arrangement. The IMF, Federal Reserve and Bank for International Settlements all describe unresolved questions around identity, intent, accountability, fraud and liability rather than announcing one global human-approval requirement.

In the United Kingdom, the Competition and Markets Authority’s guidance Using AI Agents: Complying with Consumer Law (9 March 2026) is directed at businesses. It says a business may be responsible if an AI agent it uses does something illegal. That is a UK consumer-law compliance statement, not a complete rule for every payment dispute or a finding that every agent payment is automatically the business’s liability.

The UK government told Parliament on 4 September 2026 that it was consulting on modernising payment-services regulation and that the Financial Conduct Authority had a sandbox cohort exploring agent-led payments and commerce. Those activities indicate that policy and market arrangements are still developing.

The European Commission’s AI Act Service Desk describes its agent-specific regulatory considerations as preliminary. It states that, from 2 August 2026, Article 50 transparency rules apply to agents intended to interact with natural persons or generate content. That transparency requirement does not itself decide whether an agent may make a payment or who bears a resulting loss.

Who is responsible if an AI agent makes an unauthorized payment?

There is no single answer for every country or transaction. The IMF notes that existing liability regimes can be ambiguous when an agent hallucinates, misdirects funds or acts beyond its authority. Responsibility may turn on whether the agent acted within the delegated mandate, whose conduct caused the harm, what the principal instructed, and what the payment agreement says.

Questions investigators will ask

  • What exactly did the user authorize: a category, recipient list, maximum amount, time window or one-off instruction?
  • Was the agent and its credential authenticated, or could another party have taken control?
  • Did the agent receive a malicious or misleading instruction, and were safeguards available to detect it?
  • Did the provider apply the agreed limits and fraud controls?
  • What do the account, card, wallet and merchant terms say about unauthorized transactions, refunds, chargebacks and delegated access?
  • Can the parties produce reliable records showing the instruction, policy decision and execution?

Because these facts differ, do not assume that the account holder, agent developer, payment provider or merchant is always liable. Obtain jurisdiction-specific legal advice for a significant loss or a business deployment.

Why authentication, intent and records are difficult

The Federal Reserve identifies authentication, liability and fraud as major trust challenges. Governor Christopher J. Waller said in a speech dated 29 September 2026: “Existing fraud detection and prevention systems, calibrated to human behavior, may not translate well to agents.” An agent can act faster, at higher volume and with patterns unlike a person shopping online, so a control tuned to human behavior may miss or misclassify activity.

The Reserve Bank of Australia’s Merchant Choice in Payments: Summary of Submissions (2026) records stakeholder concerns that compromised agents or credentials could generate unauthorized payments or actions outside authority. Stakeholders also questioned how chargebacks could be assessed when participants cannot identify the agent or access dependable instruction records. These are concerns reported in submissions, not measured prevalence data.

The Bank for International Settlements captured the trust problem in its speech Payments in the Age of AI Agents (5 October 2026): “The biggest barrier to scaling agentic commerce, particularly the agent-delegated model, is building sufficient trust among buyers and sellers.” Trust requires more than a login; it requires evidence of the delegation and a way to determine what the agent was supposed to do.

Controls to use before an agent can spend money

The following controls are practical recommendations derived from the risks identified by the IMF, RBA, Federal Reserve and BIS. They are not a universal checklist or a certification standard.

Write a narrow mandate

  • Specify permitted transaction types and prohibited categories.
  • Set per-transaction, daily and cumulative limits.
  • Restrict recipients to an approved list where possible.
  • Define currencies, geographic regions, expiry dates and recurrence rules.
  • State whether the agent may change a supplier, subscription or bank detail.

Separate routine and consequential payments

Allow unattended execution only for predictable, low-value transactions whose recipient and purpose are known. Require a human review for a new payee, unusual amount, changed bank details, high-value purchase, legal commitment, investment, loan, donation or irreversible transfer. A rule can be triggered by amount, novelty, risk score or uncertainty rather than by every payment.

Authenticate the whole instruction chain

Use strong authentication for the delegating user, the agent identity and the payment credential. Keep delegation credentials separate from general account passwords, make them revocable, and avoid giving an agent unrestricted access to an account when a scoped token or sub-account is available.

Apply an independent policy check

Do not rely on the same agent that proposes a payment to be the only system deciding whether it is allowed. A separate policy service or payment control should evaluate amount, recipient, timing, velocity and known risk indicators. If the agent’s explanation conflicts with the structured payment data, pause the transaction.

Keep durable, reviewable logs

Record the original user mandate, revisions and revocation; the agent identity and software version; prompts or structured instructions that affected the payment; policy decisions; authentication events; timestamps; and the final provider response. Protect logs from alteration and retain them for the period required by applicable law and payment terms.

Plan revocation and recovery

Provide a rapid kill switch, token cancellation and account lock procedure. Know how to contact the payment provider, report an unauthorized transaction, request a reversal or initiate a chargeback. Test the procedure before enabling unattended payments; a control that exists only on paper is not a useful response plan.

What current activity says about agent payments

Market activity is emerging, but the available figures should not be read as a measure of the entire agent-commerce market. Visa’s 2026 article reports roughly $15.0 million in adjusted on-chain volume across 109.6 million transactions since May 2025. The figure is presented as on-chain data associated with that report, not a forecast or total market size.

The RBA’s 2026 submission summary says one stakeholder referred to reports of a 4 percent merchant fee for one AI-agent purchase channel in early 2026. That is a reported fee for one channel, not a typical or independently verified rate.

Experian announced an Agent Trust initiative on 30 April 2026 with Visa, Cloudflare and Skyfire as collaborators. The announcement does not establish a live consumer product, universal availability or an affiliate offering, so it should not be treated as proof that a particular trust service solves authorization or liability.

How to decide whether to allow unattended payments

  1. Classify the transaction: Separate low-value, reversible routine bills from high-value or irreversible transfers.
  2. Define the mandate: Write limits, recipients, categories, duration and review triggers in a form the payment system can enforce.
  3. Map accountability: Identify the agent operator, credential issuer, payment provider, merchant and dispute contact.
  4. Test failure cases: Simulate a compromised credential, wrong recipient, duplicate payment, prompt injection, provider outage and revoked authority.
  5. Start small: Use a low limit and a restricted account or token; expand only after logs and alerts show that the controls work.
  6. Review regularly: Revoke unused permissions, update recipient lists and reassess the arrangement when the agent, provider or law changes.

Bottom line

AI agents can make payments without real-time human approval, but a successful transaction is not proof of valid authorization and does not settle who pays when something goes wrong. Treat unattended payment as delegated authority: define a narrow mandate, authenticate the agent and instruction, impose independent limits, preserve evidence, and require human review whenever the amount, recipient or consequence is outside a well-understood routine.

Frequently Asked Questions

Can I revoke an AI agent’s payment authority after granting it?

That depends on the credential and payment arrangement. Use a revocable token or permission where available, document the revocation time, and confirm with the provider that pending and recurring instructions were cancelled.

Does a payment provider’s successful authentication prove that I approved the transaction?

No. Authentication can show that a recognized credential or agent submitted the request. It does not by itself prove that the transaction matched your intent or stayed within your mandate.

Should a business treat an AI agent like an employee for compliance purposes?

Do not assume a universal legal equivalence. A business can still bear responsibility for conduct carried out by an agent it uses under applicable local consumer, payments and contract rules, so obtain advice for the relevant jurisdiction.

What evidence should I preserve after an agent payment dispute?

Keep the delegation terms, changes and revocation records; agent and credential identifiers; the structured payment data; policy and authentication events; timestamps; provider responses; and communications with the merchant or payment provider.
