Yes. A store can accuse you or report you if an item appears not to have been paid for. But an accusation is not a conviction, and a missed scan does not by itself establish that you committed a crime. Whether it is shoplifting depends on the law where it happened and the facts, including any intent the offense requires.
What can happen after a missed scan?
Keep these stages separate: a store employee may suspect or accuse you; store personnel may try to detain you; police or a prosecutor may pursue a case; and a court may decide guilt. A store’s decision to report an incident does not establish criminal intent, and a report is not the same as a criminal charge or conviction.

There is no single nationwide answer to whether a self-checkout mistake is a crime. The governing state law and the circumstances matter. The examples below illustrate differences in the law; they do not predict the outcome of a particular incident.
Why the state and the offense matter
Florida
Florida’s 2026 statute defines retail theft to include taking possession of or carrying away merchandise with intent to deprive a merchant of its possession, use, benefit, or full retail value. The same statute allows a merchant or employee with probable cause to detain a person in a reasonable manner for a reasonable time to recover merchandise or for prosecution. Florida Statutes § 812.015 (2026).

North Carolina
North Carolina separately makes it an offense to willfully conceal merchandise while still on store premises. Its merchant-detention protection is conditioned on probable cause and detention on or reasonably near the premises, in a reasonable manner and for a reasonable length of time. The state also says that mere possession of goods or presenting improperly priced merchandise for checkout is not, by itself, prima facie evidence of guilt under its price-tag or product-code transfer provision. That limited rule should not be treated as a rule for every shoplifting allegation. North Carolina General Statutes, Chapter 14, Article 16.
New Jersey
A New Jersey appellate opinion affirmed a shoplifting conviction in a case involving a shopper who failed to scan a detergent bottle at self-checkout. It establishes that a self-checkout incident can lead to prosecution and conviction on particular facts; it does not mean every missed scan is intentional or that a similar case will have the same result. What details may matter?
A scan discrepancy shows that an item may not have been paid for; it does not, on its own, explain why. In assessing an incident, relevant circumstances may include whether you tried to scan the item, whether the barcode failed, where the item was in the cart, what the register displayed, what you did before leaving, and what you said after being stopped. If the store stops you or you receive official notice
- Keep the interaction calm and avoid guessing or making statements you do not understand.
- Save receipts and any relevant checkout or store communications you have. Write down what happened while you remember it, including what the register showed and what you did with the item.
- If police contact you, you are charged, or you receive official court paperwork, speak with a licensed attorney in the state where the incident occurred. Local law and the specific facts determine what to do next.
