Sometimes—but only within limits Congress has set. A President cannot rewrite or repeal federal gun-sale statutes by executive order. The President can direct agencies to carry out existing laws, and agencies such as the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) may change regulations when Congress has delegated authority to do so. Any such action must fit the statute, follow required procedures, and withstand court review.
What a President can—and cannot—change
Congress establishes federal firearms laws, including the principal statutory framework in the Gun Control Act and the National Firearms Act. The President’s constitutional role is to execute those laws, not to make new statutes. The Constitution Annotated explains that executive officers administer laws through actions that can include rulemaking and administrative decisions, while distinguishing that work from lawmaking. That distinction leaves room for meaningful executive action. If Congress has authorized an agency to administer a statute or fill in specified details, the President may direct the agency’s priorities, and the agency may issue or revise rules within that delegated authority. But neither an executive order nor an agency rule can independently repeal a statutory requirement or exceed the authority Congress granted.
Why the source and form of an action matter
“Changing the rules” can refer to different things, and they do not have the same legal effect:

- Executive direction: A President may instruct executive agencies to review or administer policy. That direction does not itself amend federal statutes or necessarily change the rules that apply to the public.
- Agency guidance or enforcement decisions: These may affect how an agency carries out the law, but their effect depends on their content and legal authority. They do not automatically replace a statute or a binding regulation.
- Proposed rule: A proposal signals a possible regulatory change. It is not, by itself, an effective final rule.
- Final rule: An agency may issue a binding regulation under authority delegated by Congress, subject to applicable procedures, statutory limits, effective-date requirements, and judicial review.
For a particular change, check the legal authority it cites, whether it is proposed or final, its effective date, and whether a court has stayed, enjoined, or vacated it.
How courts assess presidential authority
The Supreme Court’s decision in Youngstown Sheet & Tube Co. v. Sawyer is a leading guide to presidential power. President Truman ordered the seizure of steel mills during the Korean War without specific authorization from Congress, and the Court held the seizure unconstitutional. Justice Robert Jackson’s concurrence set out a framework that looks at the President’s action in relation to Congress: authority is strongest when Congress has authorized the action, less clear when Congress has not spoken, and weakest when the action conflicts with Congress’s expressed or implied will. Applied to firearms policy, the key question is not simply whether a President announced a change. It is whether Congress gave the relevant agency authority to make that change, whether the action follows the governing statute and procedures, and whether Congress has limited or opposed that authority.

ATF’s page for RIN 1140-AA98 describes a proposed change concerning firearms equipped with stabilizing braces. The proposal would remove two paragraphs added by ATF’s 2023 rule addressing whether a firearm is designed or intended to be fired from the shoulder. ATF also says the 2023 rule has been enjoined, stayed, or vacated in several courts. The proposal is therefore not a blanket presidential declaration about the legal status of every brace-equipped firearm, and its status must be read alongside the relevant court orders. In April 2026, ATF and the Department of Justice announced that a review conducted in compliance with Executive Order 14206 had produced 34 final and proposed notices. Those categories are important: an announcement that includes proposals does not mean every proposed change is already in force. ATF’s brace-related FAQ says the proposal does not categorically declare all braces lawful or exempt. Classification depends on statutory definitions and the facts of the particular firearm; ATF also says it continues to enforce applicable laws, including the Gun Control Act and National Firearms Act. How the Second Amendment fits in
In District of Columbia v. Heller, the Supreme Court recognized an individual right to possess firearms and said that the right is not unlimited. The Court also said its opinion should not be understood to cast doubt on longstanding prohibitions or laws imposing conditions and qualifications on commercial firearm sales. That discussion is relevant context, not a ruling that every federal sales regulation is constitutional. - Identify the action: Is it an executive order, agency guidance, proposed rule, or final rule?
- Find its statutory authority: Which law does the agency rely on, and did Congress delegate authority over the subject?
- Check the procedure: Has the agency completed any required rulemaking process?
- Confirm when it applies: What is the effective date, and has a court stayed, enjoined, or vacated the action?
- Consider the legal challenge: A rule may be contested as exceeding statutory authority, failing required procedures, or violating constitutional limits.
