In the United States, a federal court injunction can prohibit specified conduct such as making, selling or importing infringing panels. A U.S. International Trade Commission (USITC) Section 337 exclusion order can direct Customs and Border Protection to refuse entry of covered Samsung Display panels or modules, while a cease-and-desist order can restrict covered inventory already in the country. Neither remedy automatically stops every Samsung Display shipment worldwide.
What has to be true before shipping is stopped?
A patent dispute does not itself create a shipping ban. A complaint, investigation or request for emergency relief is only a request for action. Shipping is legally blocked when a court or the USITC issues an operative order, and the order remains effective after considering any stay, bond, presidential review or appeal.

The controlling questions are:
- Which forum issued the order? A district-court injunction and a USITC exclusion order use different enforcement mechanisms.
- What products are described? “Samsung Display panels” may mean a bare OLED panel, a complete display module, a component, or a finished phone containing the panel.
- Who is covered? Limited USITC orders normally identify particular respondents and their products; a court injunction binds the parties and others who receive notice and act in concert with them under the applicable rules.
- Where would the conduct occur? A U.S. order generally addresses U.S. importation or conduct within the court’s reach, not exports to every country.
A shipment decision therefore requires reading the actual order, its definitions and any Customs instructions—not relying on the word “injunction” in a headline.

| Issue | Federal district-court injunction | USITC Section 337 exclusion order |
|---|---|---|
| Legal authority | Issued by a federal court in a patent case, based on the court’s jurisdiction and the injunction standard. | Issued by the USITC after a Section 337 investigation into importation and related unfair acts. |
| Where enforcement occurs | Through the court, including contempt proceedings against people or companies bound by the order. | At the U.S. border by Customs and Border Protection; a related cease-and-desist order can address inventory already in the United States. |
| Typical product language | Prohibits specified acts involving products that practice the asserted claims, as defined by the judgment or injunction. | Defines covered articles, often by product type, patent claims and respondent; Customs applies the exclusion at entry. |
| Geographic reach | Conduct within the court’s personal and subject-matter jurisdiction, subject to the order’s terms. | Importation into, sale for importation into, or sale within the United States after importation. |
| Timing | Can be preliminary or permanent; a motion alone has no blocking effect. | Remedial orders become effective when issued and become final after a 60-day presidential-review period unless disapproved by the U.S. Trade Representative. |
The practical difference is that an exclusion order can stop a covered article before release into the United States even when the importer is not the original patent defendant. A district-court injunction is enforced through the court’s commands to parties and persons within its reach; it is not a general Customs directive.

How a USITC order could stop an OLED shipment
Exclusion at the border
A Section 337 limited exclusion order can direct Customs to exclude products of named respondents that meet the order’s product and patent definitions. The relevant statutory situation is importation into the United States, sale for importation, or sale within the United States after importation. Customs may detain an entry and require the importer to show that the goods are outside the order or redesigned to avoid it.
Inventory already in the United States
An exclusion order addresses entry. If covered inventory is already in the country, the Commission may also issue a cease-and-desist order restricting sale, marketing or other specified activity. The exact prohibitions and the parties bound appear in that order; they should not be inferred from the exclusion order’s title.
Finality and review
USITC remedial orders are issued by the Commission. They are subject to a 60-day period in which the U.S. Trade Representative may disapprove an order for policy reasons. A company must also check for a stay, bond requirement, modification, presidential action or judicial review before treating an order as immediately enforceable in a particular transaction.

337-TA-1351: no violation, March 19, 2025
The USITC instituted Investigation 337-TA-1351 on a complaint alleging that imported active-matrix OLED display panels and modules for mobile devices infringed U.S. Patent Nos. 9,818,803, 10,854,683, 7,414,599 and 9,330,593. The Commission’s case record reports a final determination of no violation on March 19, 2025, and termination of the investigation. Because there was no violation determination, that proceeding did not produce a panel-shipping exclusion order.

337-TA-1378: recommendation, not an operative ban
In a separate trade-secret investigation, the administrative law judge recommended a limited exclusion order directed to respondents’ “OLED display modules, OLED display panels, and components of OLED display modules or panels” made using misappropriated trade secrets. The notice describes a corrected recommended duration of 14 years and 8 months. That figure is a recommendation by the administrative law judge, not a final Commission order. It cannot by itself instruct Customs to stop shipments. The Commission’s final determination and remedial order must be checked before relying on any exclusion.
Pictiva’s 2026 preliminary-injunction motion
An Eastern District of Texas docket in 2026 records Pictiva’s motion for a preliminary injunction against Samsung Electronics and Samsung Display in an OLED patent case. The docket entry proves that the motion was filed; it does not establish that the judge granted it. A shipper should look for an entered order stating the prohibited products, claims, parties, effective date and any bond before treating the motion as a shipment ban.
A separate claim-construction order addresses six OLED-related patents, including an encapsulation patent. Claim construction can change which panel structures are alleged to practice a claim, but it is not itself an injunction and does not authorize Customs to exclude goods.

Does an order cover a bare panel, a module or a phone?
Product scope is often the decisive issue. OLED supply chains use “panel,” “module” and “display” inconsistently, so the order’s definitions control.

Bare OLED panel
A bare panel is the display substrate and organic-emitting layers before additional electronics, cover glass or housing are integrated. If an order expressly covers “OLED display panels,” an entry described as a panel may fall within it, but classification and technical evidence still matter.
Display module
A module can include the panel plus driver integrated circuits, flexible printed circuits, touch-sensing layers or other assemblies. An order that lists “OLED display modules” may reach a module even when a bare-panel description would not. The 337-TA-1378 recommendation expressly used both “OLED display modules” and “OLED display panels,” as well as components of either.
Components
Some orders include components, while others cover only the finished article. A component can be covered even when it is shipped separately, but only if the order’s language and claim limitations encompass it.

A phone containing an accused panel is not automatically covered merely because the panel is. The order must reach the finished device directly or define covered articles broadly enough to include products containing the infringing panel or module. Importers should obtain a written scope analysis rather than assume that a phone is either included or excluded.

Preliminary versus permanent relief
Preliminary injunction
A preliminary injunction is temporary relief while a case continues. The court generally evaluates likelihood of success, irreparable harm, the balance of equities and the public interest, and may require a bond. The injunction takes effect only when entered, and its terms may be narrowed, stayed or dissolved on appeal.
Permanent injunction
A permanent injunction follows a merits judgment or settlement and can continue for the period stated in the order. It may contain exceptions for redesigns, licensed products, repair or other specified activities. A final judgment still must be read with the injunction; the existence of a patent victory does not reveal the exact shipping restrictions.
USITC recommendation versus Commission order
An administrative law judge’s recommended determination is an important procedural step but is not the same as a Commission remedial order. The Commission may adopt, modify or reject the recommendation. Only the operative Commission order, after any applicable review period, provides the basis for Customs enforcement.

U.S. shipments versus worldwide exports
A U.S. district-court injunction generally governs conduct tied to the court’s jurisdiction. A USITC exclusion order is aimed at importation into the United States and related U.S. sales. Neither automatically prohibits a shipment from South Korea to Germany, Vietnam or another country.
Best Value
Exports to another market require a separate analysis under that country’s patent law, customs rules and any local injunction or exclusion remedy. The same panel could be lawful for one destination and blocked in another. A multinational supply chain should map each leg—manufacture, transfer to an assembler, import, sale and final-device distribution—against the orders in every relevant jurisdiction.
A practical shipment-check procedure
- Obtain the operative document. Get the signed court injunction or final USITC exclusion and cease-and-desist orders, not just a complaint, press release or docket motion.
- Confirm status. Check the effective date, presidential-review period for a USITC order, stays, bonds, appeals and later modifications.
- Match the parties. Compare the manufacturer, exporter, importer, distributor and downstream assembler with the respondents and persons bound by the order.
- Match the article. Identify the exact SKU, panel generation, module configuration, driver electronics and any finished device. Compare those characteristics with every product definition and patent-claim limitation in the order.
- Map the transaction. Determine whether the conduct is importation, sale for importation, U.S. sale after importation, domestic inventory movement or an overseas shipment.
- Check Customs instructions. For a USITC order, review the entry requirements and any exclusion-process guidance provided to Customs. Preserve technical documentation supporting a non-covered or redesigned product.
- Escalate uncertainty. Seek a formal scope ruling, advisory opinion or court clarification when the order allows one. Do not rely on a broker’s informal description for a high-value shipment.
Common mistakes and how to avoid them
- Treating a filing as a ban: A complaint or preliminary-injunction motion does not stop shipping until relief is entered.
- Using “Samsung Display panels” as a legal category: The order may distinguish panels, modules, components and devices containing them.
- Assuming every Samsung product is covered: Limited orders identify respondents and product language; unrelated models or suppliers may fall outside the order.
- Ignoring inventory already landed: A cease-and-desist order may restrict domestic stock even when the import entry has cleared.
- Assuming a U.S. order is global: Other destinations require independent legal analysis.
- Relying on an old case summary: Orders can be modified, reviewed or terminated. The current docket and Commission record control.
Bottom line for the current record
A patent-based order can stop covered Samsung Display panels or modules from entering the United States, and a court injunction can prohibit specified manufacture, use, sale or importation. The block is never automatic for every panel or every shipment: product definitions, patent claims, named respondents, procedural posture and geography determine the result.
For the proceedings identified here, 337-TA-1351 ended with a no-violation determination on March 19, 2025, so it created no exclusion order. The 337-TA-1378 14-year-and-8-month period was an administrative-law-judge recommendation requiring Commission action. The 2026 Eastern District of Texas docket shows a preliminary-injunction motion, not proof that an injunction was granted. Before releasing or rerouting goods, verify the latest entered order and its scope.
