A lender can take a mortgage, deed of trust, or another security interest as part of a home-improvement loan. If you default, that arrangement can eventually expose the property to foreclosure. But the label “home-improvement loan” does not answer the question by itself: an unsecured personal loan used to pay a contractor generally does not give that lender a mortgage lien, while a contractor, subcontractor, or supplier might have a separate mechanic’s lien under state law. PACE financing creates a different risk because repayment is collected through the property-tax system.
What actually determines whether your home is at risk?
Read the documents, not just the product name or the contractor’s description. A lien risk exists when an agreement gives a creditor an enforceable interest in the property or when state law gives another claimant a right to attach the property. The signed note, mortgage or deed of trust, security agreement, contractor-financing contract, and local land records are more important than an advertisement calling the product a “home-improvement loan.”

A lender’s consensual mortgage lien
With a secured loan, you agree that the home will serve as collateral. The document may be titled mortgage, deed of trust, security instrument, or something similar. It normally identifies the property by a legal description, states the debt secured by the property, and gives the creditor remedies after default. Recording that instrument in the county land records provides public notice and can establish priority against later interests, subject to state rules.
The Consumer Financial Protection Bureau explains that a home-equity loan lets a borrower use “the equity in your home as collateral.” It also warns that if the borrower cannot repay, “the lender could foreclose on your home.” That warning applies to the collateral arrangement, not to every loan whose proceeds happen to pay for repairs.

An unsecured installment loan
An unsecured personal or installment loan is based on your promise to repay and does not normally grant the lender a mortgage interest in your house. The lender may sue for a money judgment or use other collection remedies allowed by law, but those consequences are different from an agreed lien that can support foreclosure. Do not assume a loan is unsecured merely because the application was completed online or because the contractor says no “mortgage” is involved; confirm that no deed of trust, mortgage, or equivalent security agreement is included.
Federal Regulation Z commentary distinguishes a lien retained as part of a credit transaction from an independent contractor lien where the contractor is not a party to the loan and is paid with proceeds of an unsecured bank loan. That commentary addresses federal rescission analysis. It does not decide every state-law question about whether a contractor or supplier can later claim a lien.
A contractor, subcontractor, or supplier mechanic’s lien
A mechanic’s or materialman’s lien is not the same as a lender’s mortgage lien. It can arise when someone furnishes labor or materials that improve the property and is not paid. Depending on the state, the claimant may have to send a preliminary notice, record a claim by a deadline, file a foreclosure action within another deadline, or satisfy other formal requirements. Priority can depend on when work began, when a mortgage was recorded, and other state-specific facts.
The CFPB’s Regulation Z commentary gives an example of a mechanic’s or materialman’s lien retained by a subcontractor or supplier of the contractor-creditor, even when the contractor-creditor waived its own security interest. That example should not be read as a nationwide rule that every unpaid contractor can lien every home. Eligibility, notice, recording, amount, priority, and enforcement are controlled largely by state law.

PACE financing and property-tax exposure
Property Assessed Clean Energy (PACE) financing is repaid through property taxes rather than a conventional monthly loan payment alone. The assessment increases the tax bill. The CFPB cautions that unaffordable payments or nonpayment could put the homeowner at risk of losing the property through a tax sale. This is a property-tax collection risk; it is not proof that all home-improvement lenders take a conventional mortgage.
Home-equity lines of credit
A home-equity line of credit (HELOC) is open-end credit secured by the dwelling. Regulation Z § 1026.40 covers these plans, and its commentary discusses situations such as a senior lien that may adversely affect a creditor’s security. A HELOC can therefore place the home behind the line of credit even though the account works more like a reusable credit line than a one-time renovation loan.
Compare the main financing and lien paths
| Arrangement | What may secure the obligation | Default or nonpayment exposure | Separate contractor lien possible? |
|---|---|---|---|
| Home-equity loan | Mortgage, deed of trust, or equivalent security instrument on the home | Foreclosure is possible if the borrower defaults and required legal steps are followed | Yes. A contractor or supplier claim is governed separately by state law |
| HELOC | Security interest in the dwelling under an open-end credit plan | Collection and possible foreclosure; the line’s terms control freezes, repayment, and acceleration | Yes, if state lien requirements are met |
| Unsecured installment loan | No agreed mortgage interest in the home, assuming the documents contain no real-property security clause | Money-collection remedies may apply; a foreclosure right does not arise merely because proceeds paid for repairs | Yes. The contractor’s claim is independent and state-specific |
| Contractor-financed credit | Could be a mortgage, a security agreement, or no property collateral; inspect the contract | Depends on the collateral and default clauses | Potentially. Subcontractor and supplier rights may survive a contractor’s waiver in some circumstances |
| PACE assessment | A property-tax assessment attached to the property under the local program | Nonpayment can lead to tax collection and, according to the CFPB, possible tax sale | Separate contractor claims remain possible under state law |
The table describes general categories, not a determination for a particular property. Your state’s recording, notice, priority, and enforcement rules and the wording of your documents control.

How to find out whether your own loan is secured
- Gather every signed document. Locate the promissory note, loan estimate or closing disclosure if one was provided, mortgage or deed of trust, security agreement, contractor-financing contract, change orders, and payment receipts. A short application summary is not a substitute for the signed agreement.
- Search for collateral language. Look for phrases such as “grant a security interest,” “mortgage,” “deed of trust,” “encumber,” “collateral,” “legal description,” “power of sale,” “acceleration,” or “right to foreclose.” A cross-reference to an attached security instrument is significant even if the main note does not use the word “lien.”
- Confirm the property description. A document that identifies your street address and legal description, parcel number, or lot and block is more likely to create a real-property interest than a generic unsecured note. Check every attachment and exhibit.
- Check the county land records. Search the recorder, clerk, or register of deeds for the county where the property is located. Look for a mortgage, deed of trust, assignment, release, notice of default, or recorded contractor lien. Recording systems and search methods vary; an online index may not display every document immediately.
- Review payoff and default sections. Note whether missed payments trigger acceleration, late charges, a right to sell the collateral, or obligations to pay taxes, insurance, and assessments. These provisions explain what the creditor may attempt after a default.
- Separate the lender from the builder. Identify who signed the credit agreement, who received each payment, and who performed or supplied the work. A lender’s statement that its loan is unsecured does not automatically resolve a contractor’s separate lien claim.
- For PACE, inspect the tax bill and program papers. Confirm the assessment amount, installment schedule, transfer or payoff rules, and what happens if property taxes are delinquent. Treat the assessment as a tax obligation rather than assuming it behaves like a conventional second mortgage.
What happens if you stop paying a secured loan?
Default does not usually transfer the house immediately. The creditor must follow the contract and applicable foreclosure law, which can require notices, cure periods, filings, and a sale process. The exact timeline differs by state and by whether the foreclosure is judicial or nonjudicial. A recorded mortgage can also affect refinancing or sale because the lien generally must be paid, released, or otherwise resolved before clear title is delivered.

An unsecured lender generally cannot convert an unsecured renovation loan into a mortgage simply by declaring a default. It may pursue a judgment or other remedies authorized by law. If a judgment lien is possible in your state, that is a separate legal issue from an agreed mortgage and should be evaluated under local rules.
PACE nonpayment follows a different path because the charge is collected with property taxes. Delinquent taxes can trigger tax-lien enforcement and, ultimately, a tax sale under local law. The CFPB’s warning is about that tax-sale exposure, not a prediction that every PACE account will be foreclosed.
Can a contractor put a lien on your house if you paid with a loan?
Possibly. Paying the contractor with borrowed money does not itself guarantee that the contractor, subcontractor, or supplier was paid in a way that eliminates state-law lien rights. If money remains unpaid, a claimant may try to record a mechanic’s lien even though your loan was unsecured or the lender has no mortgage.

Do not assume that the lender’s payoff letter, a contractor’s verbal promise, or a dispute over workmanship automatically removes the lien. A title company, real-estate lawyer, or other qualified local professional can explain the available release, bond, payment, or court procedures for your jurisdiction.
Why state law and lien priority matter
Federal consumer-credit rules help explain disclosures and the difference between a security interest and an independent contractor lien, but they do not determine every property-law question. State law can decide:
- whether a particular improvement supports a mechanic’s lien;
- which preliminary and final notices must be sent and to whom;
- where and when a lien claim must be recorded;
- how long the claimant has to sue to enforce it;
- the priority of a contractor lien compared with a mortgage, HELOC, tax lien, or other encumbrance; and
- how a disputed or invalid lien can be released or removed.
Those rules can change by state and sometimes by county. A conclusion based on another state’s form or deadline may be wrong for your property.

Questions to ask before signing renovation financing
- Is the loan secured by the home, and what exact document creates the security interest?
- Will the lender record a mortgage or deed of trust? If so, when and in what position relative to existing liens?
- What events count as default, and can the balance be accelerated?
- Are taxes, insurance, assessments, and contractor payments my responsibility under the agreement?
- Is the contractor the creditor, or am I borrowing from a separate bank or finance company?
- What happens if the work is incomplete, defective, or disputed?
- Could subcontractors or suppliers record liens, and what proof of payment or lien waivers will I receive?
- For PACE, how will the assessment appear on the tax bill, and what are the payoff and property-sale procedures?
- Which state’s law and which county’s recording office govern the documents?
Three common fact patterns
Home-equity loan used to remodel a kitchen
The borrower signs a note and a deed of trust identifying the house. The renovation purpose does not change the collateral: the deed of trust is the document that puts the home at risk if the borrower defaults. A contractor’s unpaid invoice would be a separate issue.

Unsecured bank loan paid directly to the builder
The note contains no mortgage, deed of trust, or property-security clause. The bank’s loan is not secured by the house merely because the proceeds financed construction. However, an unpaid subcontractor or supplier may still assert whatever lien rights state law provides.
PACE assessment for energy upgrades
The homeowner signs program documents and the charge appears with property taxes. The central risk is delinquent-tax enforcement, including the possibility of a tax sale, rather than assuming the account is an ordinary second mortgage. The tax bill and program rules must be reviewed before signing.
When to get local legal help
Prompt advice is especially important if you received a foreclosure notice, notice of default, tax-delinquency notice, recorded mechanic’s lien, demand to pay a lien, or a deadline to file an objection. Bring the signed agreements, land-record copies, tax bills, invoices, payment history, and all notices. A qualified professional in the property’s jurisdiction can determine whether the lien was properly created, whether priority is being asserted correctly, and which deadline applies. If a foreclosure or tax-sale date is approaching, do not wait for a lender or contractor to resolve the dispute informally.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThe practical answer
A home-improvement lender can put a lien on your home when you agree to use the property as collateral, commonly through a mortgage or deed of trust. An unsecured loan used for repairs does not become secured just because of its purpose. Contractor, subcontractor, supplier, and PACE-related claims are different pathways with different documents and consequences. The only reliable way to classify your situation is to read the signed agreements, check the county land records and tax bill, and apply the law of the state where the property sits.
