Can a GST Case Law From Another State Be Relied on in Your Case?

Yes. You can cite and argue a GST decision from another State, but a High Court judgment from a different State is ordinarily persuasive—not automatically binding—in your case. The Supreme Court of India is different: Article 141 of the Constitution makes its declared law binding on all courts in India. What matters for any particular dispute is the forum hearing it, the exact issue and statutory text, and whether later decisions or amendments have changed the position.

Is a High Court judgment from another State binding, or only persuasive?

Ordinarily, a High Court judgment is binding within the relevant judicial hierarchy and territory; a High Court in another State does not automatically bind the court hearing your case. Its reasoning may still be persuasive. A court may find it useful where it addresses the same GST provision and issue, but you should explain why its reasoning fits rather than assume the court must follow it.

The controlling authorities to check first are Supreme Court decisions and decisions of the High Court governing the forum where your dispute will be heard. A decision’s relevance also depends on its precise holding, not simply the fact that it concerns GST or a similar subject.

The Supreme Court’s rule

Article 141 of the Constitution of India states: “The law declared by the Supreme Court shall be binding on all courts within the territory of India.” Read the Constitution of India. Check what the Supreme Court actually decided on the issue; a judgment’s binding force concerns its declared law, not every observation in it.

How to assess an out-of-State GST decision

Before relying on a decision, establish what it decided and whether it remains good law. Use these checks:

  1. Identify the decision-maker. Determine whether the decision is from the Supreme Court, a High Court, a GST Tribunal, or an Authority for Advance Ruling (AAR). These bodies do not have identical precedential or statutory effects.
  2. Identify your forum. Check which court or authority will hear your dispute, and look for controlling Supreme Court and relevant local High Court decisions on the issue.
  3. Pin down the proposition. Identify the ratio—the legal proposition necessary to the decision—and distinguish it from background facts or observations that did not determine the outcome.
  4. Compare the law and facts. Check the exact statutory provision and version in force, the legal issue, material facts, procedural stage, and relief sought. Similar subject matter alone does not establish that a ruling applies.
  5. Check what happened afterward. Look for an appeal, stay, reversal, later ruling that distinguishes the decision, or an amendment or notification that changed the relevant law.
  6. Frame the argument accurately. Present an out-of-State High Court decision as persuasive where appropriate, explain why its reasoning should be followed, and do not describe it as binding unless an authority supports that claim.

Does territorial jurisdiction prevent you from citing another State’s judgment?

No. The ability to cite a judgment and a court’s territorial jurisdiction are separate questions. In Union of India v. Mohit Minerals, which arose from a Gujarat High Court decision about IGST on ocean freight, Supreme Court material discusses an objection that the Delhi High Court could not decide issues concerning other States without those States being parties. That is a jurisdiction and parties issue in the proceeding; it does not, by itself, establish that a litigant cannot cite an out-of-State judgment as persuasive authority. Read the Supreme Court judgment in Mohit Minerals.

How should you treat GST Tribunal decisions and advance rulings?

GST Tribunal decisions

A GST Council agenda document discussing a national tribunal with State benches records that coordinate or State bench judgments were contemplated as having persuasive value for one another. That is evidence of the Council’s discussion and stated approach, not itself a binding court holding or a definitive statement of current tribunal practice. Check the applicable law, the tribunal’s status and rules, and any relevant precedent before relying on a particular bench decision. See the GST Council agenda document.

Advance rulings

The GST Council’s official AAR directory identifies rulings by applicant and State or Union Territory, alongside questions, order details, and rulings. That structure is a reminder to examine the specific order rather than assume that an advance ruling for another taxpayer governs your case. Check the statutory provision on whom the ruling binds, the parties and facts, and any subsequent history. Browse the GST Council’s AAR directory.

What to verify before relying on a case

  • The court or authority that issued the decision and its place in the hierarchy.
  • Whether its force in your forum is binding or persuasive.
  • The exact statutory text and version it interpreted.
  • How closely its facts, procedural posture, and relief match your dispute.
  • Whether an appeal, stay, reversal, later precedent, amendment, or notification affects it.

A live GST dispute can turn on those details, the applicable State High Court precedent, and the relief sought. This is general legal information, not an assessment of the outcome of an individual case.
