Usually, yes—if “full pre-deposit” means the entire disputed GST demand. A first appeal generally requires payment of the tax amount you admit as payable plus the statutory pre-deposit on the remaining disputed tax. You do not normally have to pay the whole demand before appealing.
The answer changes if you cannot pay even the statutory pre-deposit. An appellate authority ordinarily cannot waive or reduce a mandatory deposit merely because payment would cause financial hardship. Your possible routes are to identify earlier payments that can legally be credited, check whether a special statutory rule applies, or seek case-specific relief from a constitutional court. None of those routes creates an automatic hardship exemption.

What “full pre-deposit” means in a GST appeal
Taxpayers often use “full pre-deposit” to mean two different things:
- The full disputed demand: the entire tax, interest, penalty, fine or fee demanded in the order.
- The statutory pre-deposit: the percentage of disputed tax that must be paid to activate the appeal and obtain the statutory stay on recovery.
These are not the same. For a normal first appeal, you generally pay the amount admitted as due and the prescribed percentage of the remaining disputed tax. Paying only that amount can be enough to pursue the appeal even though the balance demand remains unpaid.

If you cannot pay the statutory percentage itself, the appeal may be treated as defective or not filed. Financial difficulty alone does not give the Appellate Authority a general power to suspend, lower or eliminate the deposit.
First appeal: the ordinary Section 107 rule
Deadline and filing form
Section 107 of the Central Goods and Services Tax Act provides the usual first appeal against an adjudication decision. The appeal is generally due within three months from communication of the order. The Appellate Authority can allow a further month where sufficient cause prevented timely filing. State and Union Territory GST enactments contain corresponding provisions, but the applicable local law and current amendments must be checked for the order in question.
The GST Portal uses FORM GST APL-01 for the first appeal. The portal’s final acknowledgment, FORM GST APL-02, is described in its FAQ as the point at which the appeal is considered filed. Preserve the order, proof of communication, payment challans, ledger extracts and the acknowledgment generated by the portal.
What must be paid
Before the appeal can proceed, the appellant generally must:
- Pay the tax, interest, fine, fee and penalty amount admitted to be payable under the order.
- Pay the statutory pre-deposit on the tax that remains disputed.
- Submit the appeal in the prescribed form within the permitted period, or obtain condonation where available.
The pre-deposit is calculated with reference to disputed tax. Do not automatically apply the percentage to every rupee of interest, fine, fee or penalty shown in the order. The order type and the wording of the applicable provision can change the calculation, particularly for penalty-only or other special orders.

Effect of compliance
Once the admitted amount and required pre-deposit are paid and the appeal is properly filed, recovery of the balance disputed demand is deemed to be stayed under the statutory scheme. The stay is not a forgiveness of the liability: the dispute continues before the appellate authority, and an adverse outcome can make the remaining amount recoverable.
Current pre-deposit percentages
The Finance (No. 2) Act 2024 amendment discussed by the GST Council took effect on 1 November 2024. For the central provisions discussed in the Council’s 55th meeting agenda, the disputed-tax deposit is 10% at both the Section 107 (first appeal) and Section 112 (Tribunal appeal) stages. The Section 112 deposit is subject to a maximum of ₹20 crore.

When you cannot pay even the statutory deposit
The Appellate Authority usually cannot waive it
A statutory appellate authority must exercise powers given by the GST law. It normally cannot create an equitable hardship waiver for a mandatory pre-deposit. In Gaurav Jain & Anr. v. Joint Commissioner (Appeals-II), CGST (Delhi High Court, 31 July 2026), the court treated the deposit as a statutory condition and noted that the authority had no statutory or inherent power to waive or reduce it simply because the taxpayers said they could not afford it.
The Delhi case was decided on whether a 2025 amendment applied to those taxpayers. The court did not establish a universal constitutional waiver. It left the broader challenge and alternative request for writ relief open. Therefore, the case supports a limited proposition: ask the Appellate Authority to apply the statute correctly, but do not assume it can rewrite the deposit requirement.

Writ-court relief is exceptional and fact-specific
A High Court exercising writ jurisdiction may examine an exceptional case, such as a jurisdictional error, denial of natural justice, or a dispute about money already paid. That is different from a routine application asking a statutory authority to excuse a cash shortage. A court may decline to interfere, require a deposit, or grant narrowly tailored protection. No general success rate or automatic hardship test has been established.
Recommended Free Tools
Obtain advice promptly if considering writ proceedings. Filing a writ petition does not by itself suspend recovery or extend the statutory appeal deadline unless the court orders that result.
Check whether an earlier payment can count
Before concluding that you cannot meet the deposit, reconcile every payment with the specific demand. A payment may already be available for credit even if it was not originally described as a pre-deposit.
Electronic liability register allocation
CBIC guidance explains that a payment can be allocated to a demand through the electronic liability register. Download the relevant liability register, payment history and demand order, then match the amount, date, tax period, registration number and demand reference. Ask the department or portal support to correct an allocation that is demonstrably linked to the same demand, rather than paying a second time without checking.
Payments made through DRC-03
Some payments made through FORM GST DRC-03 can be adjusted through FORM GST DRC-03A. Whether a particular amount qualifies depends on how the original payment was recorded and whether it can be mapped to the demand. Keep the DRC-03 ARN, DRC-03A details (if used), challan, ledger entry and correspondence together. An unallocated balance in the cash ledger is not automatically proof that the statutory pre-deposit has been satisfied.

A recent court example
An Allahabad High Court order dated 20 January 2026 set aside a rejection and directed the authority to decide an appeal without insisting on a further deposit where the record concerned money already deposited and whether it should be adjusted toward the demand. That outcome turned on credit and adjustment of an existing payment. It is not a rule that poverty or commercial difficulty excuses the pre-deposit.
Tribunal appeals while the GST Tribunal is not operational
Section 112 appeals present a practical problem when the GST Appellate Tribunal is not functioning for the relevant case. Circular 224/18/2024-GST describes a way to preserve the taxpayer’s position.
- Use the portal’s payment-towards-demand flow to pay an amount equal to the required Tribunal-stage deposit against the demand.
- Retain the payment proof and ensure the amount is visible against the correct demand, not merely as an unallocated cash-ledger balance.
- Provide the undertaking or declaration specified in the circular, stating that the appeal will be filed when the Tribunal becomes operational.
- File within the applicable statutory time limits and follow any later portal or Tribunal instructions.
When the circular’s conditions are met, it states that recovery of the balance will stand stayed. This procedure is not a permanent waiver and does not remove the obligation to lodge the Tribunal appeal when the forum is available. Check the current circular text, portal workflow and any subsequent notification before paying.
A practical decision path
- Identify the order. Record the issuing authority, order number, tax period, date of communication and whether it is a tax demand, penalty-only order, detention or seizure order, or another special category.
- Identify the forum. Decide whether the next step is a first appeal under Section 107 or a Tribunal appeal under Section 112. The applicable deposit and filing process depend on this choice.
- Separate admitted and disputed amounts. Make a schedule for admitted tax, disputed tax, interest, fine, fee and penalty. Do not use the total demand as the pre-deposit base unless the law for that order expressly requires it.
- Apply the current percentage. For central provisions affected by the 1 November 2024 amendment, use 10% of remaining disputed tax, subject to the ₹20 crore Section 112 cap. Verify the operative text for the order date and the relevant State or Union Territory law.
- Reconcile previous payments. Check the electronic liability register, cash ledger, DRC-03 records and any DRC-03A adjustment before calculating a fresh payment.
- Calculate the deadline. Count three months from communication for a Section 107 appeal and assess whether a further month for sufficient cause is available. Do not assume a pending representation stops the clock.
- File and preserve proof. Submit APL-01 or the applicable Tribunal procedure, pay through the correct demand reference, obtain the acknowledgment, and save every generated document.
- Escalate unusual problems quickly. If the portal rejects a payment, an earlier payment is not credited, or the case involves a special order, obtain written professional advice and consider appropriate statutory or writ remedies before the deadline expires.
Examples of how the calculation works
Example 1: disputed tax remains after an admitted amount
An order determines ₹12 lakh of tax, of which the taxpayer admits ₹2 lakh and disputes ₹10 lakh. Under the 10% rule applicable to the central provisions described above, the statutory deposit on the disputed tax would be ₹1 lakh, in addition to payment of the ₹2 lakh admitted amount. The taxpayer would not ordinarily need to pay the entire ₹12 lakh to lodge the first appeal. Interest, fee, fine and penalty must still be dealt with according to the order and the applicable statutory provisions.
Example 2: an earlier payment is available
If ₹1 lakh was already paid through DRC-03 and the records show that it can be adjusted to this demand, the amount may satisfy all or part of the calculated deposit. The result depends on the official allocation and adjustment records; the fact that money left the bank account is not, by itself, conclusive.
Best Value
Example 3: Tribunal-stage cap
Suppose the remaining disputed tax is ₹300 crore. Ten percent would be ₹30 crore, but the Section 112 deposit is capped at ₹20 crore under the 2024 amendment described by the GST Council. Confirm that the cap applies to the particular appeal and that no later amendment changes the position.
Special situations that need separate checking
- Penalty-only orders: the ordinary disputed-tax calculation may not fit; check the specific appeal provision.
- Detention, seizure or confiscation matters: these can follow different statutory routes and release conditions.
- Orders under State or Union Territory GST laws: compare the local enactment, notifications and portal instructions with the central rule.
- Orders communicated before or after an amendment: transitional provisions and the effective date can affect the required amount.
- Multiple demands or tax periods: make sure a payment is credited to the exact order and period being appealed.
Common mistakes that jeopardize an appeal
- Calculating 10% of the entire demand instead of the remaining disputed tax, or applying the percentage to items that are not part of the statutory base.
- Assuming inability to pay is itself a waiver ground before the Appellate Authority.
- Relying on the old 20% Tribunal figure without checking the post-1 November 2024 amendment.
- Treating a DRC-03 payment as automatically credited without verifying the demand allocation.
- Waiting for the Tribunal to become operational and missing the statutory time limit or the declaration/payment conditions in Circular 224/18/2024-GST.
- Confusing a portal FAQ statement about a possible lower percentage with a general discretionary power that the statute and courts do not provide.
- Failing to preserve APL-02, challans, ARN numbers, ledger extracts and proof of communication.
What the GST Portal FAQ does—and does not—mean
The GST Portal FAQ describes a statutory minimum pre-deposit of 10% of disputed tax for the first appeal and mentions that a lower percentage may be declared after approval by competent authorities. Read that wording cautiously. It does not mean that an individual Appellate Authority can grant a personal reduction because the taxpayer is short of funds. Before relying on any lower percentage, identify the legal notification or approval that applies to the exact order and confirm the current portal instructions.
Bottom line for a taxpayer deciding whether to file
If you mean the entire disputed demand, you can generally pursue a GST appeal after paying the admitted amount and the statutory pre-deposit. If you mean you cannot pay even that statutory amount, the appeal ordinarily cannot proceed on hardship alone. First verify the current percentage, calculate only the relevant disputed tax, search for creditable earlier payments, and check whether a special Tribunal or order-specific procedure applies. Because deadlines and amendment effects are decisive, have a GST litigation adviser review the order and payment trail before the filing window closes.

Does borrowing money change the GST pre-deposit rule?
No. The law looks at whether the required amount has been paid and properly credited, not at the source of the funds. Borrowing may be a commercial decision, but it does not reduce the statutory percentage.
Can a pending request to correct a DRC-03 allocation extend the appeal deadline?
Not automatically. Treat the statutory deadline as continuing unless the law or a court order provides otherwise, and file a protective appeal where legally available while pursuing the allocation correction.
Is a writ petition guaranteed to suspend recovery when the taxpayer cannot pay?
No. A High Court may grant case-specific protection, but hardship alone does not guarantee a stay, waiver or reduction.
