For an Indian employer, GST input tax credit (ITC) on food and outdoor-catering services is generally blocked—even when the caterer is an outside vendor. A narrow exception may apply if a law requires the employer to provide the relevant meal or canteen service. CBIC Circular 172/04/2022-GST says that exception applies to the food and outdoor-catering restriction too. The caterer’s invoice alone does not establish eligibility.
When can a company claim GST ITC on employee meals?
Start with the restriction in section 17(5)(b)(i) of the Central Goods and Services Tax Act, 2017: it blocks ITC on food and beverages and outdoor-catering services, subject to specified exceptions. One exception concerns goods or services that an employer is obliged to provide to employees under a law in force.

CBIC Circular 172/04/2022-GST clarifies that the employer-obligation proviso applies to all of section 17(5)(b), including food and outdoor catering. That can allow credit where the employer can establish that a law applicable to it requires the particular service. It does not make every employee meal eligible, and the ordinary conditions for claiming ITC still apply. Read Circular 172/04/2022-GST.

How to check whether the exception applies
- Identify the actual supply. Check what the caterer provided—such as food, restaurant service, outdoor catering or a bundle—and who is named as recipient on the tax invoice. A vendor’s label alone does not determine the GST treatment.
- Check the premises and rate category. Establish where the service was supplied and whether the premises fall within the applicable “specified premises” category. Compare the facts with the current rate entry and notification; do not infer the rate from the ITC question.
- Find the legal requirement. Ask whether a law in force applicable to this employer requires it to provide this meal or canteen service to these employees. A company policy or general welfare practice should not be treated as a legal mandate without advice establishing that it qualifies.
- Verify that the law applies to this establishment. For a factory, check the relevant state rules, the factory’s status and worker count, and any exemption. Do not rely on the central Act’s threshold alone.
- Keep supporting records. Retain the relevant law or rule, establishment and worker-count records, canteen arrangement, caterer contract, tax invoice and evidence linking the billed service to the required facility. These records help substantiate the position; they are practical guidance, not a separately stated statutory checklist.
- Apply the restriction if no mandate is established. Treat section 17(5)(b)(i) as the starting point and seek qualified GST advice before claiming credit where the legal obligation is uncertain.
What the factories-law example does—and does not—prove
Section 46(1) of the Factories Act, 1948, empowers State Governments to make rules requiring a canteen in a specified factory where more than 250 workers are ordinarily employed. The central provision is enabling language; it is not, by itself, a universal canteen mandate for every factory above that headcount. Whether a particular employer must provide a canteen depends on the applicable state rules and the facts, including any exemption. See section 46 of the Factories Act, 1948.
Even where a canteen is legally required, assess whether the specific service in the caterer’s invoice relates to that requirement. The obligation and the billed service must be connected; a general catering arrangement does not automatically establish that every charge qualifies.

Keep the supplier’s GST rate separate from the company’s ITC
The GST rate charged by the caterer and the employer’s eligibility to claim ITC are separate questions. The CBIC rate schedule lists a 5% rate—2.5% CGST plus 2.5% SGST—for a specified outdoor-catering category at premises other than “specified premises,” subject to a condition that the supplier has not taken input tax credit on goods and services used to provide that service. The schedule treats specified-premises cases separately. The correct entry depends on the service, location, premises classification and applicable notification, so check the current rate schedule and the actual invoice. Employee payments and education-institution guidance need separate analysis
If employees pay part of the meal cost, or the employer provides meals free or at a subsidy, analyse the payment and supply arrangements separately. The cited Act and circular do not conclusively settle every recovery or onward-supply pattern; contract terms and payment flows may matter. Avoid assuming that employee contributions automatically permit or prevent the employer’s ITC claim.
CBIC Circular 28/02/2018-GST and its corrigendum address mess catering for educational institutions. They are not a general rule for company employee meals. CBIC’s sectoral FAQ also contains a canteen-provider response saying tax paid for canteen services is unavailable as credit; read that general response alongside the later Circular 172 clarification that the legal-obligation proviso applies across section 17(5)(b).
