You need rights to rebroadcast each episode and the material inside it, and YouTube says licensed third-party content can still interrupt a live stream if the relevant rights holder has not added your channel to its Content ID allowlist. Check the rights and allowlist status before you go live.
What determines whether you can rebroadcast an episode?
There is no blanket answer for podcasts as a category. It depends on the rights to the specific recording, the works included in it, the way you plan to use it, and the relevant rights holders’ Content ID settings. YouTube’s livestream terms put responsibility on the broadcaster to have the necessary rights for the live content worldwide, including applicable music licensing rights. YouTube’s livestream terms and conditions describe that responsibility.

Get permission for the actual broadcast
Ask the podcast owner or other rights holder for written permission that expressly covers a continuous YouTube livestream. Confirm whether it also covers keeping an archive or replay, monetization, the territories in which the stream may be available, and how long the permission lasts. Permission to publish an episode as a podcast does not, by itself, establish permission for your separate 24/7 rebroadcast.

Check every included work
The podcast producer may not own or control everything heard in an episode. Music, sound effects, interview clips, and other recordings or works may involve separate rights holders. Verify that the permission covers these elements too; YouTube’s terms specifically call out music licensing rights and participants such as artists, record labels, and publishers.

Confirm the exact channel is allowlisted
If a rights holder uses Content ID, ask that owner to add your YouTube channel to its allowlist. YouTube specifically advises creators who have licensed third-party content to request allowlisting. Without it, a live stream may still be interrupted even if you have permission. See YouTube’s guidance on copyright issues with live streams.
What YouTube can do during the live stream
YouTube scans live streams for third-party content matches. If it detects a match, it may warn you, replace the stream with a placeholder image, temporarily interrupt the broadcast, or terminate it if the material remains. A match is not proof that you lack permission, but having permission does not prevent automated detection or necessarily prevent enforcement during the broadcast. The allowlist is a separate practical step.

What happens to the archive?
Decide before broadcasting whether to retain an archive. YouTube says Content ID claims are made after a live stream ends if you choose to archive it. That means the archived video can face a claim even if the live broadcast itself completed. Confirm that your license also covers the retained replay, and review any claim or restriction affecting the archived video.

Content ID claims, interruptions, and strikes are not the same
A Content ID claim can block a video, monetize it (including possible revenue sharing), or track its viewership; the outcome can vary by territory. Claims generally affect the video rather than the whole channel. A live broadcast may separately be interrupted or terminated under YouTube’s live-stream rules. A claim is distinct from a copyright removal request or copyright strike. YouTube explains claim outcomes in Learn about copyright claims.

Why fair use is not a reliable no-claim plan
Fair use is case-specific, and copyright exceptions differ by jurisdiction. YouTube says automated Content ID systems cannot determine fair use. If you believe a claim is mistaken, YouTube has a dispute process, but disputing a claim does not guarantee that an initial match or live interruption will not happen. Read YouTube’s explanation of fair use and seek qualified legal advice for a specific rights question.
Pre-stream rights checklist
- Obtain permission for continuous YouTube rebroadcast of the specific episode.
- Confirm the license covers any archive or replay, monetization, territories, and duration you intend.
- Verify rights for music, clips, sound effects, and other third-party material inside the episode.
- Ask each relevant Content ID rights holder to allowlist the exact YouTube channel.
- Choose whether to archive the broadcast, understanding that archived streams may receive claims after they end.
- Keep written permissions and allowlist confirmation available in case a match or restriction occurs.
