What California’s “No Robo Bosses Act” does
The sponsor, state Senator Jerry McNerney’s office, says SB 947 bars employers from relying solely on automated decision systems (ADS) to make firing or disciplinary decisions. When an ADS assists with those decisions, the announcement says employers must provide human oversight and verification. It also says workers must be informed when an ADS was used. The sponsor’s September 30, 2026 announcement describes the policy, but does not replace the enacted statutory text.

In practical terms, “robo boss” is shorthand for automated systems influencing termination or discipline—not a prohibition on all AI at work. The sponsor describes the law as covering ADS in those decisions. HR Dive characterizes the systems as including AI, machine learning, and similar processes, but the precise statutory definition has not been established here.

The enrolled bill text was not available in the sources used here to verify the effective-date clause independently, so the date should be understood as the date reported by that outlet. HR Dive’s October 1, 2026 report also summarizes the law’s human-review requirement.

The sponsor announcement and HR Dive agree on the central idea of human involvement when automated systems support firing or discipline, but describe the decision trigger differently: the sponsor says employers cannot rely “solely” on ADS, while HR Dive describes human corroboration when an employer “primarily” uses an ADS. Those summaries should not be treated as interchangeable statutory language.

The exact ADS definition, covered decisions, exceptions, notice timing and content, remedies, penalties, and detailed enforcement procedures have not been verified against the enacted text. The sponsor announcement names the California Labor Commissioner, state Attorney General, and local prosecutors as enforcement actors, but the complete enforcement scheme remains unconfirmed here. Do not assume the details of earlier proposals apply to SB 947 without checking its final language.
McNerney said in the sponsor’s announcement: “No worker should ever be fired or disciplined by a robo boss. Artificial intelligence systems have the potential to increase productivity, but they’ve also been prone to errors, bias, and misjudgments.” That is the senator’s statement supporting the law, not statutory wording.
