California’s new workplace measures do not ban employers from using AI or prevent AI-related layoffs. They address narrower issues: human review and notice when automated systems help discipline or terminate a worker, notice when technology displaces workers, and state planning for possible workforce disruption. The practical details of SB 951 should be checked against its enacted text before workers or employers rely on a particular deadline.
Can AI fire you under California’s new laws?
SB 947 addresses automated decision systems (ADS) used in discipline or termination. In its signing announcement, Senator Jerry McNerney’s office describes the law as barring an employer from relying solely on an ADS to discipline or fire a worker, requiring human oversight and verification when an ADS assists those decisions, and requiring notice to workers if an ADS was used. That is a safeguard for how certain consequential decisions are made, not a promise that a worker cannot be fired or laid off. The available announcement describes human involvement and disclosure; it does not describe a general ban on workplace AI. For the exact legal duties, definitions, exemptions, and effective date, consult the enacted statute and official state guidance rather than treating a sponsor’s summary as the complete rule. What if technology replaces a job?
SB 951 is listed in the governor’s announcement as “Employment: technological displacement: notice.” A California Senate committee analysis dated April 8, 2026, described the proposal as requiring 90 days’ advance notice before technological displacement and quoted its stated purpose of written notice to affected workers and the California Employment Development Department (EDD) before mass layoffs driven by AI. That description comes from a committee analysis, not the enrolled statute. The available material does not establish the enacted law’s final scope, covered employers, exemptions, deadlines, or effective date. Do not assume that every AI-related job change triggers a 90-day notice requirement; check the final statutory text and official guidance for the circumstances that qualify. Advance notice is not a ban on a layoff and does not, by itself, guarantee a job, retraining, severance, or replacement income.
How the state is preparing for wider AI-related disruption
A separate executive order issued by Governor Gavin Newsom on May 21, 2026, directs state agencies to study AI’s effects on work and develop recommendations. The order calls for work on early warning signals and data collection, consideration of possible California WARN Act revisions, and exploration of possible transition support, training, severance standards, employment insurance, and worker ownership. These are subjects for agency review and policy development, not a package of benefits already guaranteed to every displaced worker. What California’s AI unemployment tracker can—and cannot—show
EDD’s AI and Labor Market tracker is an early-signals tool. It groups unemployment-insurance (UI) claims by occupational exposure, not by a verified reason for an individual’s job loss. Its two exposure measures answer different questions:
- Potential exposure: whether large language models may reduce the time needed for tasks in an occupation by at least half.
- Observed exposure: the extent to which tasks in an occupation are performed using Anthropic’s Claude, according to the tracker’s usage measure.
For August 2026, EDD reported a three-month average of about 52,200 initial claims in occupations with high potential AI exposure, about 1.2% below the previous month’s three-month average. It separately reported about 71,800 initial claims in occupations with high observed AI exposure, about 1.0% below the previous month’s three-month average. These are preliminary administrative measures, not counts of AI-caused layoffs, and the two figures should not be added together or treated as alternative estimates of one population. EDD cautions that exposure does not prove AI caused a specific unemployment claim. The dataset can omit people who do not claim UI, quickly find another job, leave the labor force, are ineligible, or are self-employed. Occupation codes are self-reported, low-count cells may be suppressed, and figures can be revised. The tracker therefore offers context about claims in exposed occupations, not a definitive statewide count of Californians whose jobs AI has eliminated.

What workers and employers should check next
- For an automated discipline or termination decision, review the enacted SB 947 text and official Labor Commissioner guidance for the exact human-review and notice requirements.
- For a technology-related displacement or mass-layoff notice question, confirm SB 951’s final text, effective date, coverage, and any exceptions in official state materials before relying on a 90-day deadline.
- For transition assistance, distinguish services that are currently available from proposals agencies are still studying. The executive order identifies training and support as planning topics but does not endorse a particular provider.
