California’s Fish and Game Commission is scheduled to consider petitions to change the state’s marine protected area network during its October 13–16, 2026 meeting. The vote is expected during the week of October 15, but had not occurred as of October 3. The proposals include new protected areas, changes to existing areas and tribal harvest exemptions; they are not a statewide ballot measure or a decision by the California Coastal Commission.
What the Commission is considering
California’s marine protected area network covers parts of the state’s 840-mile coastline and includes 125 marine protected areas, according to Inside Climate News. In 2023, the state opened a petition process for proposed changes. The news outlet reports that 20 petitions were submitted, five of them tribally led or co-led.
The petitions reflect different requests, not one uniform proposal or blanket fishing ban. Some seek new protected areas; others would change an existing area or allow tribal harvest under an exemption. The Commission is to consider agency evaluations and public comment before deciding what, if anything, to approve.
How the tribal proposals differ
Inside Climate News describes three tribal petitions as seeking new marine protected areas and two as seeking tribal harvest exemptions without creating a new area. The Commission’s May 5–6, 2026 meeting index records several specific requests. These are petition proposals, not rules already in force.

The details matter: sites, boundaries, permitted activities and requested exemptions differ. The Commission’s official meeting schedule and petition materials provide the public record as it considers the requests.
Why state agencies disagree
The Department of Fish and Wildlife (CDFW), which manages the MPA network, evaluates petitions using a framework adopted by the Commission in 2009. As described by Inside Climate News, that framework includes scientific metrics and ecological spacing. The Ocean Protection Council (OPC) assesses petitions against broader policy priorities and uses a precautionary approach that considers climate scenarios.

Their recommendations diverge on newly proposed tribal MPAs:
- CDFW recommends denial of the newly proposed tribal MPAs and suggested exploring a separate State Marine Cultural Preservation Area designation under State Parks.
- OPC recommends approval of all but one of the proposals.
- Both agencies generally support tribal take exemptions, according to the reporting.
The suggested cultural-preservation designation is not an established alternative. Inside Climate News reports that the state has not established or managed such an area, and State Parks had not said whether it would pursue one.

Why tribal participation and co-management are central
The dispute is about more than ecological boundaries. The Marine Life Protection Act passed in 1999, and Inside Climate News reports that tribes were left out as formal stakeholders at the time. The petitions therefore raise questions about cultural stewardship, government-to-government participation and who has decision-making authority over marine resources.
For the Santa Ynez Band, the Mishopshno proposal is tied to cultural places and practices. Chairman Kenneth Kahn told Inside Climate News: “Co-management is extremely important because of the cultural significance. Our tribe has been connected to the multiple areas that we’re trying to preserve since time immemorial.”

Eva Pagaling, co-founder of Ocean Origins and a Santa Ynez Band community member, described the distinction between access and authority: “Being able to co-manage an area doesn’t just give you access, it gives you the ability to have decision-making power.” Tolowa Dee-ni’ Nation Natural Resource Department director Rachel McCain similarly described the meaning of harvest: “Traditional harvest has so much more behind it. It’s tied to culture and life ways and existence and identity. It’s way deeper than just catching fish.”
What co-management would mean in practice remains unsettled. Fish and Game Commissioner Eric Sklar said, “Were all just figuring it out as we go.” CDFW marine region manager Craig Shuman said, “We don’t need any change to state law to do it. We’ve just got to sit down with each individual tribe, and figure out what that means to them.” These comments describe an open process, not an agreed framework or guaranteed outcome. Sklar also told the outlet: “I suspect my fellow commissioners will give real deference to what the tribes are looking for and what their concerns are.”

Which commission is involved—and what happens next
The pending decision belongs to the California Fish and Game Commission, not the California Coastal Commission. The Coastal Commission’s Tribal Consultation Policy, adopted in 2018, guides that separate agency’s staff consultation and consideration of tribal cultural resources in its planning and permitting decisions; it is not the policy or vote at issue here.
The Fish and Game Commission’s October 13–16, 2026 meeting is the scheduled decision window. As of October 3, the final vote and disposition of the petitions were still pending. The Commission’s meeting page is the place to check for current schedule details and petition records.
